Horner City Treasurer of the City of Rexburg, a municipal corporation of Madison Coun[y, Idaho, under and by virtue of the laws of the State of Idaho, in such cases made and provided, did on the 6th day of ~gl,tst 1982, mark as delinquent installments or assessments on the "Local Improvement District Docket" for Local Improvement District No. 22 in the City of Rexburg, Idaho, for the property hereinafter described, and did within ten (10) days thereafter prepare and issue to the City of Rexburg, Idaho, a municipal corporation, in which such Local Improvements District is located, a Delinquency Certificate, to the property included in such delinquent assessment or installment, which said delinquency certificate contained, besides a description of the property sold, the facts necessary to be set out, pursuant to Section 50-1739 I.C.A. all as shown by the terms of the delinquency certificate No. ~.~,2- hereinafter set forth. AND, W HEREtCS,~tne property on which the installments or assessments have not been paid and for which a delinquency certificate was issued, being situated in the City of Rexburg, Madison County, Idaho, is more particularly described in the description hereinafter set forth; and WHEREAS, the property described in said delinquency certificate issued and heretofore described was not redeemed, and two years having lapsed from the date of said delinquency certificate, and the property not having within said time been redeemed by any person; and WHEREAS, due notice of the expiration of the time of redemption has been given to the person in the actual possession of said premises herein described, and to the person in whose name and same stands or stood assessed upon the assessment records of the County Assessor's office of Madison County, Idaho, and where no person was in the actual possession or occupancy of such land or lots, and where the person in whose name the same stood or stand of record in the County Assessor's office of the County of Madison, State of Idaho, could not upon deligent inquiry be found in the state, the notice of the expiration of the time of redemption was posted in a conspicuous place upon said land or lots in a substantial manner, all as provided for by Section 50-1745 I.C.A. and all as fully appears by the proof of notice of expiration of time of redemption filed in the City Treasurer's office; and WHEREAS, said property heretofore described has never been redeemed and the time for redemption has expired, Richard R. Horner , Cit Treasurer of the NOW, 'THEREFORE, THIS INDENTURE WITNESSETH, that I, y' City of Rexburg, a municipal corporation of Madison County, Idaho, as aforesaid, by virtue and ih pursuance of the law in such cases made and provided, and in consideration of the provisions of the statutes of the State of Idaho, have granted, bargained, sold, conveyed and confirmed, and by these presents do grant, bargain, sell, convey and confirm unto said City of Rexburg, a municipal cor oration of Madison County, Idaho, its successors and assigns forever, the said property, as fully and absolutely as I, Richard R. Hporner City Treasurer of the City of Rexburg, may or can lawfully sell and convey the same; that is to say, all and singular the property situated in the City of Rexburg, County of Madison, State of Idaho, described as follows: Lot 5 Block 6 in the Sorenson Addition to the City of Rexburg, Madison County, per the recorded plat thereof. together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title, interest, possession and claim, as well in law as in equity, of the said City of Rexburg, and all owners or claiments of any interest therein to the appurtenances thereunto belonging. TO HAVE AND TO HOLD, all and singular the above last mentioned and described property, together with the appurtenances thereof, unto the said party of the second part and its successors, heirs and assigns forever. In case the said assessments are not paid within two years from the date of this certificate, the owner of this certificate, upon full compliance with the provisions of iaw relating to the service of notice of expiration of the period of redemption upon the persons entitled thereto not less than one month and not more than three months prior to the expiration of such period, and in the case of an assignee having paid all subsequent installments and assessments which are delinquent or due, shall be entitiled to receive from the City Treasurer of the City of Rexburg, Idaho, a Deed to the premises herein described.
