Porter, at 7:30 P. M. on March 17, 1976. Mayor Councilman Councilwoman: Also Present: ;E: MINUTES APPROVED John C. Porter George Catmull Warren Porter Barton Jensen Nile Boyle Morgan Garner Darlene Blackburn City Attorney, Mary Smith City Clerk, Afton Anderson Minutes of the previous'cmeeting were read and discussed. Councilman Barton Jensen moved the minutes be approved as corrected. Councilman George Catmull seconded. All Aye ;E: NEW AGREEMENT FOR THE NEW PARK BY THE HIGHSCHOOL Mayor Porter reported that we have the agreement for the new park by the highschool. Councilman Morgan Garner moved the Mayor sign the project agreement. Councilman Nile Boyle seconded. All Aye ;E: BIDS ON REPAIRS OF SWIMMING POOL Mayor Porter reported that bids had been received on the swimming pool. The lowest bid was by Acquatech Pools for 215,648. The City crew would be able to do all the digging to disclose the pipes and drains so that j there would be quite a savings for the City. Councilman Warren Porter -- moved that we accept the lower bid. Councilman Nile Boyle seconded. All Aye. The budget allowed for only $10,000 to fix the pool. The budget may have to be reopened at a later date to finance the repairs. IE: RECREATIONAL FACILITIES AND AREA BY FAIR GROUNDS DISCUSSED Members of the Cutter Association, Fair Board, Posse, and concerned groups attended the meeting to discuss plans for the cutter track and fair grounds. The track accross 5th West must be temporary closure to allow them to have a regulation track. An alternate route for the road which now goes to the fair grounds, city shop, dog pound, and lagoons. Walters is willing to trade the city a piece of ground for another piece which would enable the road to be changed to alleviate so many turns. The Fair Board is planning to build horse stalls at the fair grounds and a picnic area. They want to build a bridal path to run down along the river and a park. Councilman Barton Jensen proposed that the groups get aerial photos from Clayter Forsgren. Ask each group what their plans would be; then form, a committee to make a final study for recreational facilities in that area. Then lets see what you come up with so the county, city,and any interested clubs can participate. All agreed this would be a good plan. The council agreed that the Cutter Association would be able to continue --, closing the road on 5th west for their races for the 1976 season. E: ANNEXATION OF PROPERTY OWNED BY SIEPERT DISCUSSED ~ ' The annexation of some property owned by Siepert was discussed. There should be no problem. E: RESOLUTION FOR TAX ANTICIPATION NOTE Councilman George Catmull introduced a resolution for a $50,000 tax anticipa- tion note payable in 60 days. BE IT P,ESOLVED by the City Council of the City of Rexburg, Madison County, State of Idaho, a municipal corporation organized and existing under and. by virtue of the laws of the State of Idaho, and a taxing district within the meaning of Section 53-3101, Idaho Code, in regular meeting assembled: I. That the City of Rexburg borrow money in the sum of $50,000.00 c~5,f and issue as evidence of such debt, a tax anticipation note, bearing interest at the rate of five (5) per cent per annum from the date thereof until paid, which said note shall mature June I, 1976; that said sum be borrowed from, and said note be issued to the First Security Bank of Idaho, a National Banking Corporation, Rexburg, Idaho, with its office and place of business in Rexburg, Idaho; such money to be used for general expenses of the City in anticipation of the taxes levied for the year 1976 for general purposes. ', ', 2. That the tax levy for the current 1976 fiscal year has not been '.completed; that the amount of taxes to be collected for general purposes ';exclusive of taxes levied for outstanding bonded indebtedness and 't...ispecial purposes during 1976 is $82,070.00 that the assessed valuation for the year 1975 was $8,908,439.00. That this proposed tax anticipation note does not exceed seventy-five per cent of the taxes levied by said taxing district in the year 1975; that the 1976 taxes have not yet been collected and paid to the City of Rexburg by Madison County. 3. That such tax anticipation note shall be a negotiable instrument, and shall pledge the full faith, credit and resources of the City for the payment of the same, and shall be substantially in the following form: Tax Anticipation Negotiable Note Rexburg, Madison County, Idaho March 17, 1976 For value received, the City ofi Rexburg, Madison County, State of Idaho, promises to pay to the First Security Bank of Idaho, N.A., a National Banking Corporation, with its office and place of business at Rexburg, Idaho, or its order, on the Ist day of June, 1976, the sum of Fifty Thousand $50,000.00) Dollars, lawful money of the United States of America, with interest from the date of this note at the rate of five (5) per cent per annum until Dail. I This note is issued in pursuance of a Resolution duly adopted by the City of Rexburg, Madison County, State of Idaho, on the 17th day of March, 1976. It is hereby certified and recited that each and every act, condition and thing required to be done, to have happened, and to be performed precedent to and in the issuance hereof has been performed in full and strict compliance with the Constitution of the State of Idaho and the provisions of Chapter 31, Title 63, Idaho Code, and amendments thereof; that the tax levy for 1976 has not yet been completed and the proceeds therefrom have not yet been collected and paid to the City of Rexburg by Madison County; that the assessed valuation and the tax levy is based on the (975 assessed valuation and the 1975 tax levy; that the amount of this note is not in excess of 75 per cent of the taxes levied by said taxing district in 1975; that the full faith, credit and resources of the said City are hereby pledged for the payment of this note, according to its terms; that there remain to be collected, all of the taxes levied for 1976; that there are no outstanding warrants heretofore drawn upon such levy, and there are no other tax anticipation notes outstanding to be paid from the uncollected portion of the taxes levied for the 1976 fiscal year. i-°-~In Witness Whereof, the said City of Rexburg has caused this note to Ibe signed by its Mayor and attested and the seal of such City affixed by the Clerk this 17th day of March 1976. °'-'~4. That such tax anticipation note be sold at private sale to the First Security Bank of Idaho, N. A., Rexburg, Idaho, aforesaid, by the Mayor ofi the City forthwith, and that he be hereby authorized to make such sale and to receivec;the proceeds therefrom and deposit them to the credit of said City. 5. To provide for the payment of said tax anticipation note at maturity, a special fund is hereby created to be Known as Tax Anticipation Bond or Note REdemption Fund, and it is hereby provided that all taxes ~~ RE E hereafter collected or received from the general tax levy for the year 1976 shall be placed immediately in such fund until such time as the funds accumulated therein shall be sufficient to pay the herein- above mentioned tax anticipation note, together with interest thereon at maturity, and the funds so accumulated in the said fund are hereby appropriated and set apart for such purpose only and shall be used for no other purpose; providing, however, that this shall not limit the payment of said note to the said taxes collected, but shall be the direct and general obligation of the City of Rexburg. It was moved by Barton Jensen and seconded by Nile Boyle that such Resolution be adopted, and the proper officers directed to proceed accordingly, and that the Resolution be spread on the minutes Upon call for question, the vote was taken as For 6. Against 0. tVhereupon proper- papers be executed and that the Mayor Proceed to negotiate the Loan, as authorized in-it Resolution and directed the Clerk to spread the Resolution upon the minutes of the Council. ORDINANCE NO 569 AN ORDINANCE EIJTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR 1976, AND APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR 1976. Thereupon it was moved by Councilman Nile Boyle and seconded by Darlene Blackburn, Coulcilwoman, that the rule requiring ordinances of a general and permanent nature to be read fully and distinctly on three differ-ent days be dispensed with and that said ordinance be numbered 569 and be passed and adopted as read: Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon said motion was as follows: Those Voting Aye George Catmull Warren Porter Barton Jensen Nile Boyle Morgan Garner Darlene Blackburn Those voting Nay: None Absent None The Mayor thereupon declared that the motion, having been passed by not less than three-fourths of the Council, had been duly carried, and the Ordinance No. 569 was duly passed and adopted. The City Clerl< was directed to publish said Ordinance No. 569 in at least one issue:-of the Rexburg Standard or Journal, a Newspaper published in the City of Rexburg, Idaho. AGREEMENT TO BE MADE UP OIJ JOINT LAW ENFORCEMENT FACILITY Mayor Porter announced that there must be an agreement drawn up between _ the County Commissioners and the City Council on the joint law '' enforcement facility at the courthouse. Mary Smith will have the meeting set up. GARBAGE PROBLEM AT VERN ANDERSON APARTMENTS Discussion on the garbage problem with the Vern Anderson apartments. They have no bins for their garbage and it is all over. Mayor asked Mary Smith to check into the matter and see what we can force them to do.
