DIINUTES OF REGULAR CITY COUNCIL MEETING OF THE CITY OP REXBURG, IDAHO Minutes of the Regular City Council Meeting held June 18, 1969 at 7:30 P.M. at the City Hall. b4ayor A. H. Brock was present and presiding. The following corm cilmen were present, Henry Shirley, Dell Virgin, John C. Porter, Gordon Smith, Glenn Peters with Barton Jensen absent and excused. City attorney Mary Smith and City Clerk Beulah Johnson were also present. MINUTES Minutes of the Ntay 22, 1969 meeting were read, motioned by Glenn Peterson, seconded by Dell Virgin that minutes stand as read. The motioned carried. PURCHASE OP GROVER IIEAIMING BUILDING- POST OFFICE BUILDING City Attorney Mary Smith read the contract of sale for purchase of the Grover Lemming building known as the Post office building, to serve as the city offices. John C. Porter moved that the papers be signed by the Mayor and Clerk and we purchase the building. Seconded by Gordon Smith. Henry Shirley "Aye" Dell Virgin "Aye" John C. Porter "Aye" Gordon Smith "Ave" Glenn Peterson "Aye" *4ayor A. H. Brock ivas excused from the meeting at this time, with Councilman John C. Porter presiding. SOLUTION: Any property owners desiring to replace side walk in :Front of a private residence occupied only as a home and not for commercial purposes, shall first obtain the consent of the City Council and the sidewalk shall be replaced accoraling to city specification. The city will remove the old sidewalk at the city's convenience, without cost to the home owner and will pay 20¢ per sq.ft. of the cement for such replacement. Moved by Gordon Smith, seconded by John C. Porter. Motion carried. RF.: SIDEIVALKS IN FRONT OF COUNTY HOSPITAL Gordon Smith reported that the city would remove the sidewalks in front of the county Hospital and the county would replace them. RESOLUTION: lVIIEREAS, A. 1V. b7ILLER has been given a permit to construct an apartment house on pro- perty belonging 'to him in the city of Rexburg, Idaho, and which is adjacent to property owned by Frank H. Jacobs, and 1VHEREAS, THERE appears to be some question as to whether or not the apartment house being constructed is less than the :EootaQe requirement between property lines, and IUHEREAS, FRANK [-I. JACOBS, the adjoining property olvner who would be affected in the event said apartment house is less than the five foot distance requirement between buildings and property line, having waived his right to protest thereto, NOlV, TIIEREPORE, be it resolved that the five foot distance between the building being constructed by A. iV. Miller and the adjoining property belonging to Frank I-I. Jacobs, be, and the same is hereby waived and A. iV. Miller is given permission to proceed with the construction of said apartment house as the same is now located on his pro= perty.
