R, t~), Purrington pi esented the following resolution 'to the Cit~l Council and moved its
adoption. The motion was seconded by G. P_1'ton Anderson a.nd on roll call the follo.rina members
of tlae City Cowzcil voted "Aye": R. Zd. Purrington, G. Alton Anderson, Alma K1inyler, John C.
Porter, and Charlas 7,o11inger. There were no "Na•y~~ votes, and Mayor Gilbert Lassen declared
said resolution unanimously carried.

amount of .°,.~1,r315,00 assuring the performance o£ their obligation to compete said
paving on Hirch Avenue and Oalc Avenue.

Bond in the amount of 51,815.00 assuring the performance o2: the obligation ox
Edward L. Powell and Don Fowell to complete the paving of Birch Avenue and Oak
Avenue as soon as weather conditions permit in the spring or summer of 1900, and
that in the event the said Ldti-card L. Fo~.•rell and Don Powell fail to do so 'tl~!e City
o£ Re~cburg will compl.eta such paving and look to the Surety Company for reimburse-
ment because o£ any such failure on 'the part of Edward L. Potaell and Don Powell
to complete said paving. Thai such Ixxving will be completed without cost to-the
purchasers of the ~a.bu'tting properties or assessments asainst such properties, the
City of Rexburg to rely on said ner.frn-mance bond in the event the City has to
complete such improve=nents as aforesaid.

Oa1c Avenue as aforesaid, the see be accepted by the L'ity of Rexburg a.s a portion
o£ its street system to be maintained as part of said street system.
