Porter reported that he and the Mayor & Tom [~Jebster had met vrith the State High- t5~ay Department committee in regards to traffic lights at the intersection of Main and 2nd West, Streets. The cost to the City for installation will be tip1,300.00 - this includes the ~hralk~~ and 'wait" sir;nals For pedestrians. After a brief discussion NIr. Porter moved the City participate with .the State Hightivay Department in the installation of traffice lights at the intersection bf Maih and 2nd ti'lest Streets. 'The motion was seconded by G. The motion was seconded by Tom Webster and passed unanimously. RE: NI. D. Morrell Authorized to call for bids on the Citv Audit for next year: A motion was made by G. Alton Anderson, seconded by John Porter and unanimously passed that Dr. P4. D. t4orre1l be authorized to call for bids on the City audit for next year. Re: Scouts to run the City on Saturday, February 7th.: The Nlayor stated Boy Scout week will be observed February 7th -14th. The Mayor sug- gested, if possible, Councilmen be on hand to meet the Scouts at 9 A.;+I. RE: Resolution concerning Sewer Uistrict -Notice of Protest Meeting February 11th, 1959: NOTICE OF RESOLUTION OF INTr-piTI~I TO ESTABLISH LOCAL IMPR.OVEMiSVT UISTRICT N0. 5 FOR CONSTRUCTION AND IN- STALLATION OF S.rSWLR LATERALS IN REXBURG, IDAFIO, ARID HEARING YRQTESTS AGAINST SAID PROPOSED IMPROVL'Mll~IT OR THE CREATION OF SUCH DISTRICT. NOTICE IS HB'RENY GIVL'N that at a retnrlar meeting of the City Council of the City of Rexburg, Idaho, held on the 21st day of January, 1959, the City Council passed and the Mayor of said City approved Amended Resolution No, 1, being a Resolution of Intention of the ~~Iayor and City Council to make certain improvements, the general character of said improvements being described as follows: Construction and installation of sanitary sewer laterals, complete with manholes and all other necessary appurtenances and the resiroation of street surface wherever. necessitated by reason of the construction and installation of said sanitary sewer laterals. The costs and expenses of such improvements shall be assessed upon the abutting, ad- joining, contiguous and adjacent lots and lands and upon lots and lands benefited and included in the improvemait district formed, each lot and parcel of land beinP separately assessed for the debt thereof in proportion to the number of square feet of such lands and lots abutting,<adjoining, contiguous and adjacent thereto or included in the improve- ment district to the distance back from such street if platted in blocks to the center of the block, if plattedin lots to the center of the lots, and if not platted to the distance of one hundred tr~enty-five feet, and in proportion to the benefits derived to such pro- perty by said improvements, sufficient to cover the total cost and expense of the work to the meter o1' the street. The costs and expenses of all intersections shall be borne by, apportioned to and assessed against the-property within said districtin proportion to the benefits derived from such improvemeit. That said Amended Resolution No. 1 is now on file in the office of the City Clerk of the City whereany interested party may inspect the same:ahd to which Amended Resolu- tion No. 1 reference is hereby made for further informatiori`an regard thereto. The estimated total cast oi' the proposed improvement is jfi87,000:D0. That said proposed improvement district shall consist of the property within the fol- lowing described boundaries: Commencing at a point 100 feet South of the Northeast corner of Lot 2, of Block 41 oi' the Original Rexburg Toti•msite, in the City of Rexburg, as per the recorded plat thereof, and running thence South 2837 feet to the Southeast corner, Lot 6, of Block 9 of the Parker Addition to the City of Rexburg; thence West 2,227.5 feet to a point 330 feet West of the East Line of Section 25, Tormship 6 North, Range 39 E.B.M., which point is on the West boundary line of Rexburg Townsite; thence North 3003 feet; to the Center of I9est Nfain Street; thence East 379.5 feet, thence South 166 feet; thence East 1,443 feet to the point of beginning. Also commencing at a point_100 feet North of the Southeast corner of Lot 4 of Block 2.3 of the aforesaid Original Rexburg 'Pownsite; thence running North 1319 feet; to the Northeast corner of Block 27 oi' said Tot~rnsite, thence ldest 330 £eet; thence North 429 £eet; thence tdest 709.5 feet, to the west boundary line of said Tot~rnsite as above des- cribed; thence South 1914 feet; to the Center of West Alain Street; thence East 379.5 feet; thence North 166 feet; thence East 660 feet to the point of beginning. Said sanitary sewer laterals to be constructed on the following Streets betweem the following pionts: South Third Ldest between First and Fourth South Streets. South Fifth West between Nlain Street and fourth South. Morrell moved the next City Council meeting be held February 11th instead of the regular meeting on February 4th unless the i4ayor finds it necessary to hold one before the 11th. The motion was seconded by A. L. Klingler and passed unanimously. RE: City to Authorize Payment to N. J. Sommer the amount of 9G335.!~0 for 1.63 acres of land: A motion was made by M. D. Morrell, seconded by Tom Webster and passed unanimously that the Council authorize tYte payment to N. J. Sommer by City warrant of $335.00 for the 1.63 acres of land adjoining the Airpflrt for the Golf Association discussed in previous Council meetings. (The City warrant to be made out to Farm Home Administration - Maxine Miller- Nicholas J. Sommer.) RE: City Donated to the Idarch of Dimes ~p55.25: The Mayor reported the collection from the Parking 14eters for one day which they City donated to the March of Dimes, was `55.25. Claims in the amount of X6,309.19 were presented by M. D. Morrell who moved same be granted and paid. The motion was seconded by G. Alton Anderson and passed unani- mously. Porter was also absent and excusedo RE: The Proposed New Sewer District: The Mayor stated the purpose of the meeting was to discuss the proposed sewer dis- trict and to hear protests if there were any. Donna Cherry Mrs. Vyette Parkinson Ralph Peterson, representing the Gem Aircraft, Inc, presented himself at the meeting to discuss problems pertaining to the company. After presenting the problems and discussing them:with_.the Council, a motion was made by R. 4J. Purrington, seconded by M. D. Morrell, and unanimously carried, that Gem Aircraft, Inc. Have the right of regress and egress over the present road at the Municipal Airport, to their property at the Northwest of the Airport; that such right extend to any permanent road constructed at the airport; that said com- pany also have the right to construct and use a taxi strip of reasonable area from its property to the air strip; that said company have the right to use the airport strips for
