Purrington reported he was getting complaints from people whose neighbors were leaving their garbage cans out on the street which was unsightly and attracted flies. The Council discussed the matter and decided to have stickers printed to be placed on such garbage cans with the complaints checked. RE: Complaint on Ditch near Fair Grounds: G. Alton Anderson stated Ross Covington had complained about the ditch near the Fair Grounds which had been moved stating it was too narrow - too deep - too crooked and the head gate not set in deep enough. iulr. Anderson said he had investigated and felt there was no cause for complaint. RE: Pigs ldot to be Allowed lJithin City Limits: G. Alton Anderson said word had come to him that Glen Davis was bringing in some , pigs to put on his property at 2nd South and 3rd West. A check of the zoning map disclosed •~ that corner to be in residential "B" area. The Mayor asked John Porter to have Chief of Police, 14arvin May contact P'Ir. Davis and inform him pigs would not be allowed in the city. RE: New City Park be Named J. Fred Smith Park; A motion was made by Tom Webster, seconded by John Porter and passed unanimously tiZat the new City Park be named J. Fred Smith park. He stated the park was developed during the administration of the late Mayor J. Fred Smith and it was through his efforts and initiative that the park was planted and landscaped. RE: Doyle Pearson's office building does not conform to Fire District Code; Fire Chief Clements brought up the problem of Doyle Pearson's location and the type o£ office he is using for his place of business at 2nd West and Main. The location is in the fire district which requires Masonry walls on buildings and his presnet building doesn't conform. John Porter moved the City notify, Mr. Pearson he must comply with the fire district code within 30 days and that Fire Chief Clements notify him of the decision of the Council. The motion was seconded by G. Alton Anderson and passed unanimou3y. RE: Fire Chief Clements Granted Permission to Purchase Hose Expander: Fire Chief Clements requested permission to purchase a hose expander. R. W. Pur- rington moved Fire Chief Clements be allowed to purchase the hose expander and also that he purchase a cable to put on the bell at the City Ha11. The motion was seconded by John Porter and passed unanimously. RE: Ricks College Fees Waived for set up of Trailers: The Mayor read a letter from );ldon Hart business i°ianager of Ricks College in which he stated the College plans to move'the trailers now on the campus to a site South of 3rd South on first East Street and expand the area to accomadate more trailers. He requested all fees be waived. G. Alton Anderson moved fees be waived but that water andsewer lines and con- nections be put in :under City supervision. R. W. Purrington seconded the motion which passed unanimously. RE: Report on New Armory Building: City Attorney Mary Smtih stated Representative Hamer Budge had reported bids should be let for the New Armory building within thirty days and if not to let him know, RE: .Council Rescind Permission to Plant Trees in Front of Post Office: The Council discussed the permission they had given Grover Hemming to plant some trees in front of the Post Office Building. After giving the matter more careful con- sideration the Mayor said he would inform Mr. Hemming not to plant the trees until the Council considers it further. NOW THERsFORE, HE IT RESOLVED BY THE i4AY0R !LND COUNCIL OF THE CITY OF REXBURG, IDAHO, AS FOLLOWS; Section 1. The City of Rexburg, Idaho, does hereby declare its intention to construct and install certain sanitary sewer laterals within the corporate limits of said City and for that purpose to create and establish a Local Improvement District therein to be known as Local Improvement District No. t for construction and installation of sewage laterals in Rexburg, Idaho, comprising of property within the following described boundaries: Commencing at the Southeast corner of Lot 1, Hlock 28, of the Rexburg Townsite, and running thence West 64 rods to the West line of the Rexburg Townsite; thence North 92 rods to a point, thence East 44 rods; thence South 26 rods; thence East 20 rods to the Northeast corner of Lotl, Block 2'] of said Tovm site; thence South 66 rods to the point of begin- ning. Commencing at the Northeast corner of Lot 3, Hlock 41 of the Rexburg Townsite and running thence South 158 rods to the Southeast corner of Lot 5, Block 9 of the Parker Addition to the City of Rexburg; thence West 136 rods to the West line of the City boundary; thence North 153 rods; thence East 136 rods to the point of beginning. Said sanitary sewer laterals to be constructed on the following streets between the following points: South Third I^dest between First and Fourth South Streets South Fifth West between Main Street and Fourth South North Fifth West between ifain Street and Second North. Section 2. The kind and character of said improvements is the construction and instal- lation of sanitary sewer laterals and the restoration o£ street surfaces wherever neces- sitated by reason of the construction and installation bf said sanitary sewer laterals. Section 3. The said improvements are original. Section 4. The estimated^total cost and expenses of said district and of said improve- ments are Section 5. The cost and expenses of said district and of said improvements which is to be paid by special assessment is to be assessed against the abutting, adjoining, Con- tiguous and adjacent lots and lands and upon lots and lands benefited and included in the improvement district formed, each lot and parcel of land being separately assessed for the debt thereof in proportion to the number of square feet of such lands and lots abutting, adjoining, contiguous and ajacent thereto or included in the improvement district to the distance back from such street, if paltted in blocks to the center of the block, if platted ih lots to the center of the lot, and if not platted to the distance of one hundred twenty five feet; and in proportion to the benefits derived to such property by said improvements, sufficient to cover the total cost and expense of the work to the canter of the street. the costs and expenses of all intersections shall be borne, apportioned to and assessed against the property within said district in proportion to the benefits derived from such improve- ment. Section 6. That 44ednesday, the 3rd day of September, 1958, at 8 o'clock p.m. of said day, and the chambers of the City Council in the City Hall in the City of Rexburg, Idaho, be and the same are hereby designated as the time and place when protests against the creation of said district and the making of said improvements will be heard and considered by the City Council, and protests against said improvements or the creation of such dis- trict may be Filed in the office of the City Clerk on or before the day of such meeting, to, but not later than the hour of 8 o'clock p.m, of said day. The City Clerk is hereby ordered and directed to give notice of the passage of this resolution, and the time within which protests against said proposed improvements or the creation of said district may be filed, and the date when said protests will be heard and considered by the Council in the manner provided by law.
