Idi1e i'aylor, acting as spokesman for a group of citizens from lst South and 3rd
East Streets, came to the meeting to requESt some action on the dust problem and daR1age
to streets by tractors and other i?envy farm maciv.nery travelling to and from tovm.
After considerable discussion the I_ayor stated he and the council crere arrarE of the

WHEREAS, the City Engineer and Committee on Streets have
heretofore made out and certified to the City Council as provided
by law an assessment roll of`Local Lateral Sewerage Improvement
District No. 4, and
WHEREAS, on the 6th day of September, 1950, the City Council
fixed the time and place when and where ob~~ctions to said Assessment

Roll by the property owners of said District would be heard, to wit:
Wednesday, the 20th day of September, 1950, at eight ofclock P. M. of said
day at the council chambers in the City Building at Rexburg, Idaho, and
WHEREAS, notice was duly and regularly given as provided by law b'y
the Glerk of the time to file objections to said Assessment Roll, and
WHEREAS, the owners `of the following described property now included
in said Assessment Roll situate in the City of Rexburg, Idaho, have re-
quested that the assessment against said-property and the whole thereof, be
-set aside and vacated and that said property and the whole thereof, be elimi=
nated from said Assessment Roll, and
WHEREAS, the City Council`has examined said Assessment Roll and has
heard and considered said objections, 'and
WHEREAS, no other objections of any kind-or nature were filed or made
to said Assessment Roll, and
WHEREAS,-the-City Council-after considering `saidobjections'has de-
termined that said"property described in said objections; and hereinafter
described, and the~'whole'thereof, should be eliminated from said Assessment
Roll, and said assessments t?hereon-set aside-and vacated.
NOW, THEREFORE, BE IT~RESOLVED that said assessments on the property
hereinafter described by'number taken from Local Lateral Improvement
District No. 4 map as revised August, 1950, shall be, and hereby are set
aside and vacated and that otherwise, and as to all other property described
in said Assessment Roll, and each and every item thereof, and the whole
thereof, excepting the property hereinafter described, be and the same
hereby is, in all respects, approved and confirmed. Said property is in-
dicated and described as follows:

approximately the North three-fourths of No. 12
All of Nos. 10 and 11
Approximately 1 rod by 20 rods from the Charles
Zollinger property and the ditch
No. 37 eliminate approximately'165 feet by 126 feet
(keeping in the district the width of the frong

Councilman Smart seconded the adoption of the foregoing rQsolut:on
and same upon being put to a vote was unanimously carried by the affirmative
vote of all councilmen present, the vote being as follows: Ferrell Nelson,
"Aye"; Richard Davis - "Aye"; Edward Covington - TMAyeTt; Henry Shirley -
"Ayet°; and Wayne Smart - ^Aye".
