Recessed meeting of the City Council of the City of Rexburg, Idaho, held July 11, 1950
at 9 o'clocl~ P. Li. in the City Ha11 at Rexburg, Idaho.
liayor J. IS. Parkinson presided. ^1hc follovring councilmen vrere present: Ferrel Nelson,
Edward Covin;^.ton, ~?ayne :>_^:art, Brent Sutherland and Henry Shirley. Absent: Richard Davis.
In the absence of the City Clerk, v:lto vras e::cused, the i;iayor asked '_Sary Smith, City
Attorney, to take the minutes.
R Pump in canal.
~_Tr. Joiui 3uclu,u.ller, ~. Raymond Erickson and I1. I'ujimoto appeared before the Council
to discuss the installation of a pump anct the cancellation of aL agreements and liability
of the City t0 dCllver vaater to them through the upper canal and its laterals.
After considerable discussion it eras moved, by ~d4°rard Covington, seconded by Ferrel
Dlelson and unanimously carried as follows: ,
That the City enter into a contract 4aith P,ir. Buchnti.llet°, L4r. Ericksom and idr. Fujimoto
vrhicii oro~:l.d provide that the City of Re=_bur-_ transfer to `r. Buchmiller 2 shares of capital
stoc!c in the Rexburg Irrigation Ce., 1 share to 1Sr. I'srickson and 1 share to 7~^. Fujimoto;
that the City purchase and install a Hump; that I.`~r. Erickson, Buchmiller and Fujimoto
maintain the pump and pay all expense ih connection with its operation; that in consideration
of tine purchase and installation of the pump and. the transfer of said vrater stock, all
agreements of every 'iihd and nature betvreen the City and I's. Buchmiller, Erickson, and
Fujimoto and prior ot,ncrs of the property Hoar oerned b;i them, be cancelled and terminated and
the City released from all obligation and liability to deliver v:ater to them and maintain
said upper canal and its laterals from the point vrhere it enters the Fujimoto property;
that :r. Buchmiller, I+'r. Erickson and Ir. Fujimoto, their successors, and heirs, and assigns,
maintain that portion o- the upper canal and its laterals up to its present standard; that
they would have the right to use the vraste vrater but zrould acquire no interest in it and
the City vrould be under no obligation or liabilit to deliver it to them; that the City shall
have the right to use said portion of the canal grid its laterals forever; that in the event
I`r. Buchmiller, Erickson, and Fujimoto fail to ,maintain said canal and its laterals up to
the present standard the City vrould have the right to mass the necessary repairs and
maintene.nce and l,ir. IIuclrerl.ller, Erickson, and Fujimoto vrould reimburse the City for the same.
The City Attorney tiaras instructed to dray the agreement.
RE: Building Inspectorrs salary.
The Zlayor reported that ~y.r. Christensen did not feel that he eras being paid enough for
the time he vras repaired to spend as Building Inspector and that he vrould like r~50 a month
for 8 months and }725 a month for 4 months. The Layor recommended that his salary be
increased to those amounts. It vras moved by 'r'errel Ielson, seconded by 1Ieury Shirley, and
unanimously carried that L^°r. Christensen be paid ~;~50 a month for S months and =25 a month
for 4 months.

The i_ayor reported that he, Dick and ia~ine had attended a Planning Board meeting and that
L's'. Bementrs proposed addition to the City was discussed. The Council then discussed the
matter and it was moved by Ferrel Iltelson, seconded by Covington and unanimously carried,
that the City accept and certify i.s'. Bement's proposed adclition'when he presented the
completed plans to them.
Ft I:ic?;ntirers employment.
The matter of Ray cgntirers employment vras discussed. Tl?e Liayor advised that he had
discussed the matter vrith LIr. LIcF,tttire and advi sed him that his job vras irrigation 12 months
out of tf?e year and when he was not busy he could work in the police department.
RE: '."feed Spraying.
The matter of billing Noxious vreeds leas discussed. Covington reported that Milford
Jensen vras to have a surve~* made and vrouldnrt !utovr until lrJednesday night. Sutherland moved
that Covington arid Pdelson (the irrigation cortisittee) go ahead vrith the spraying program
if tl?ey found it desirable. Seconded by Mayne Smart and unanimously carried.
~: Resolution.
Brent Sutherland introduced the follovring Amended Resolution in vrriting and requested
immediate consideration of said resolution. Said resolution being in ;ords and i'gures as
follows, to-vrit:

and not voti!zg, the layor declared that five members of the Cou-Heil had voted for the passage
of swirl Amended Resolution DIo. 1 and tl?at said motion ::ss carried and said Amended
Resolution ido. 1 :s*as duly and regtLlarly passed.
On motion of Covington, seconded by Shirley, and unan~.monsl;;r carried, the meeting
adjourned.

19th day of July, 1950, at fi P. Ia, at the City Hall 4vith 1layor Joseph bl. Parlti.nson presiding
All Councilmen and City Attorney I`ary Smith :~rere present.
RE: Irrigation ditch..
John Parl.inson, Dr. C,"S. Green, Hal Golightly, and John Adams met vrith the Council
to discuss the problem of the irrigation ditch which goes near their homes, creating a
definite drov~ning hazard to the children in the neighborhood. The gentlemen offered to
buy the pipe ;f the City vrould lay it or they mould lay it themselves if the City would
give their permission. The LTagor informed them that the Pla~utixg Board had secured the
services of engineer David Benton of Idaho Fa11s to matte a survey and study of the City's
irrigation system and he felt no action should be taken until he had made his report and
rec oammendat i ors ,
RE: Agreement - ptwxp in canal,
John Bucltmillcr and Raymond Erickson appeared at the meeting to complete action on a
crater right transfer. In consideration of a release of early vrater rights agreement in the
Rexburg City Canal, City Councilmen recently voted to transfer four :rater shares held by
the City in the Rexburg Irrigation Co. which t=rere acquired vrith purchase of the near airport.
The iiayor instructed the City Attorney to read the agreement ti^rhich she had dral~rn up. Said
agreement is attached to these minutes. fir. Buc1,ttiller agreccl to sign the agreement and to
contact the other parties concerned and get their signatures. The pump estimates ;rere
then turned over to Covington ~aho z=gas instructed to complete the transaction.
RL': Spraying for flies and insects.
Diclt Birch of St. Anthony attended the meeting to explain his business of spraying
alleys, ga_rbagc cans, and other places where flies, mosquitos, and insects are found. As
an c-!;ample of cost he stated spraying of St. Anthony alleys as ,p700.C0 which Frould last a
year. Councilmen a_r_~pea?^ed favorable to such a project but felt it should investigate local
facilities before proceeding. Further discussing the matter it seemed to be the opinion of
the group that spraying is the responsibility of the individual instead of the City.
Covington reported that the City is nozr cooperating with the County in a project to
spray vreeds along the ditch banks of the City.
