'r•,TIREAS, the city council of Rexburg, Idaho, deems it for the best interests of the city
to construct and install certain sanitary sewer laterals vrithin the corporate limits of said
city, hereinafter particularly described; and to create Local Lateral Sevrerage Improvement
District No. 4 for the City of Re..burg, Idaho, for the purpose of ,sting said improvements, and
',HEREA5, the estimated total cost of said district and of said improvements is

the costs and expenses of all intersections shall be borne,,by, apportioned to and assessed against the
property vrithin said district in proportion to the benefits derived from such improvement, and

said improvements by special assessments levied upon and against the lots and land abhtting,

Sectionl. The City of Rexburg, Idaho, does hereby declare its intention to construct and
install certain sanitary sewer laterals within the corporate limits of-said city, and for
that purpose to create and establish a Local Lateral Sewerage Lmprovement District therein
to be known as Local Lateral Sevrerage Improvement District IQo. 4, for the City of Rexburg,
Idaho, consisting of property vrithin the following described boundaries:
Beginning at a point in the south boundary of Bloclt 53 in the City of Rexburg, Liadison
County, Idaho, which point is ~i.di°ray betvreen 1st t'Test Street and Center Street; thence northerly,
parallel to 1st ;`test Street to the center of said Block 53; thence easterly, parallel to 2nd

to a point which is midway between Center Street and!lst Y1est Street; thence southerly
parallel to.Genter Street to the north line of 1st ..North Street; thence easterly along the
north line of 1st North Street to the point of beginning.
Said sanitary sevrer laterals to be constructed on "the follovli.ng streets betvreen the follow-
ing points:
lst 'v'lest Street from 3d South Street to 2d South Street
2nd South Street from Center Street to 2d t"lest Street
2d Test Street from 2d South Street to lst South Street
Center Street from 1st North Street to 2d Tdorth Street
2d North Street from Center Street to 2d East Street
Section 2. The kind and character of said improvements is the construction and installation
of sanitary sevrer laterals,. complete with manholes, v°ryes and all other necessary appurtenances,
and the restoration of street surfaces vrherever necessitated by reason of the construction and
installation of said sanitary sevrer laterals.
Section 3. The said improvements are original.

Section 4. The estimated total cost and expenses of said district and of said improvements

Section 5. The cost and expenses of said district and of said improvements vrhich is to-,
be paid by special assessment is to be assessed against the abutting, adjoining, contiguous
and adjaceht lots and lands and upon lots and lands benefited and included in the improve-
ment district formed, each lot and parcel of land being separately assessed for the debt
thereof in proportion to the number of square feet of such lands and lots abutting, ad-
joining, contiguous and adjacent thereto or included in the improvement district to the
distacice back Eton: such street, if platted ili blocks to the center of the block, if platted
in lots to .the center of the lots, and if not platted to the distance of one hundred tvrenty-
five feet, and in pro_r-onion to the benefits derived to such property by said improvements,
sufficient to cover the total cost and expense of the vrorl: to the center of the street,
^lhe costs and expenses of all intersections shall be borne by, apportioned to and assessed
against the property within said district in proportion to the benefits derived from such
improvement.
Section 6. That 1'Iednesday, the 14th day of September, 1949, at 8 o'clock P, Li, of
said day, and the chambers of the City Council in the City Hall in the City of Rexburg,
Idaho, be and the same hereby are designated as the time and place vrhen protests against
the creation of said district and the malting of said improvements vrill be heard and
considered by the city council and protests against said improvements or the creation
of such district may be filed 717 the office of the City Clerk on or before the day of
such meeting to, but not later than, the hour of S o'clock P. hi. of said day, The City
Clerk is hereby ordered and directed to give notice of the passage of this resolution,
the time :~ritlu.n vrhich protests against said proposed improvements or the creation of said
district may be filed, and the date when said protests drill be heard and considered by the
council in the tiiatuier provided by lavr,

RE: Request for hangar space.
Davis reported D, G, Taylor and Lyman Real Estate had reo_uested hangar space at the airport.
Davis moved vre grant permission to above named parties to construct private hangars at airport;

RE: Request for plumber's license,
In the absence of Building Inspector Christensen, Floyd Hathavray applied to the City Council
for a plumber's license. His application i°aas granted.
RE: Claims.
Claims in the emount of X2,226,47 vrere presented by Nelson vrho moved they be granted. Second
