"Rt~SOLVED, THA'i' "~iL~=~f~AS the Fanners and %erchants Bank of Rexburg, Idaho, suspended nayrtent and closed it's doors vn the 14th day oi' January, 1925, and is now insolvent, and, ~'~KEREAS, at the date of such suspension the said Bank had on deposit of rile funds of the City of Rexburg, the sum of ;115,271.31, and 'sJHEREAS, prior to such suspension the said Bank furnished to the City of Rexburg a Depository Bond as required by law for the safe keeping and due payr,ent of such funds, which said Bond eras duly and regularly approved and filed, and at the date of such sus- pension was in full force and effect, and is the only security field by the City of Re~cburg for the payr.ent of said deposit, and, 'fi~rli'!;Ri;AS, the following named persons are the sureties upon said bond,, to-wit; D?athan Riclcs, Alfred Ricks, J, `,F/. ';°/ebster, J, 5. 'YNebstor, A. I,-i. Carter, H. rte. Poole, L, S. 1Vebster and F, S, Parkinson; and, '~iE;R AS, there is now due to the City of Rexburg from said farmers and Lierchants Banlc, the sum of vv15,271,31 besides interest thereon at 3jo per annum from January 3rd, 1925, id01N '1'H:EREs'ORE IT IS ORDERED by the l;;ayor and City Council '(;hat demand be and the same is hereby made upon said sureties for the immediate .payment to the City of Rexburg of the aforesaid sum of y~15,271.31 besides interest thereon at 3ia pcsr annum fra?n January 3rd 1925, The City Cleric is hereby directed to serve a Copy of thisresolution upon each of said sureties by registered mail. Passes and approved this 22nd day of January, 1925." Thereupon Councilman R. H. Smith moved that .the.resolution be adopted and passed by the City Council. The motion vras seconded by D. ~:`J.
