Kay W. Beck moved to approve the minutes. Farrell Young seconded the
motion. All aye, except Nyle Fullmer who abstained because he had not
read them yet.
RE: DISCUSSION OF MOVIE AT MADISON HIGH SCHOOL FOOTBALL FIELD
TOPIC: (23,22,,,MADISON HIGH SCHOOL,NOISE,BALL DIAMONDS,HALL FIELDS)
Andrea Clements, 7 E. 2nd N. was present to ask if there was an
ordinance that would prevent them from showing~a movie on the football
field after the Homecoming game. It would be over by midnight.
Stephen said there is a disturbing the peace ordinance that is likely
to kick in due to the fact that every time there is a ball game that
goes beyond 11:00 p.m. we take calls from that neighborhood. They
insist that there was an agreement entered into at some point that
indicated that no events would take place at that location after 11:00
p.m. Stephen asked if they had considered using the back stop with the
sheets on for their screen and moving it over to the ball diamond just
to distance yourself. That would give you a buffer between you and the
neighborhood and it would also give you the ability to project your
sound out towards the Medical Center. Nyle Fullmer moved to give it
the Councils blessing with the recommendation that they move it to the
ball diamond with the condition that if they had any complaints they
would have to deal with them. Kay W. Beck seconded the motion. All

RE: DISCUSSION OF FALL CLEAN UP

The Mayor said the next item on the agenda was the Fall Clean Up. Kay
said the Street Department is short on help right now and have a lot of
projects they are working on. John felt if we moved it to mid October
we would be okay. Nyle Fullmer moved that we set the Fall Clean-Up for
October 15th thru November 15th. Farrell Young seconded the motion.

Agenda item repealing Ordinance 593 on Electrical Code was tabled until
the next meeting.

RE: NAMING OF SKATE BOARD PARK
TOPIC: (23,23,,,SKATEBOARD PARK, BOYLE*CLAIR,SKATE PARK)
Mayor Sutherland said that they would like to name the skateboard park
at the grand opening Saturday, September 18th. It has been recommended
that we name it the Clair Boyle Skate Park. Marsha Bjornn moved that
we name it the Clair Boyle Skate Park. Glen Pond seconded the motion.

RE: DISCUSSION OF EAGLE SCOUT PROJECT AT NATURE PARK
TOPIC: (23,23,,,EAGLE PROJECT,NATURE PARK, WASTEWATER TREATMENT PLANS,
SERVICE PROJECTS)
Tyler Moore gave a report on his Eagle Project regarding the plan for
the campground North East of the Wastewater Treatment Plant. They have
it all staked out. He explained his plan showing the fire pit and
restrooms location. There is room for two more camp sites. The mayor
told Tyler that Paul Pugmire was interested in helping get donations to
help with it. The access would be along Dave Walters fence. The mayor
explained where the parking lot would be and where the walking path
would be. John stated there are some old picnic tables that we can
cycle down there. Tyler said they need to clear off large dead trees.
It was suggested that a service club might help with that. (discussion
on the work on the parking area) Tyler asked about the water line. The
mayor told him that would have to wait until spring. Sohn stated it is
all city owned property and they could put the water to one central
spot. Tyler discussed what to name the campground area? The mayor told
him to think about it and to make a suggestion. Kay Beck suggested that
the camp site that Tyler did for his project should be named after him
and as each camp site is developed it could be named after the scout
doing the eagle project. It was felt that to use the facility it would
have to be reserved through the City Hall and when they made the
reservation they could pick up the key through the city hallso the
facility could be locked. The council directed him to work with John
Millar on the project.
RE: REPORT ON SKATE PARK
TOPIC: (23,23,,,SKATEBOARD PARK, SKATE PARK, CHC FOUNDATION,
CAL RANCH, KIWANIS,RICKS COLLEGE,EAGLE PROJECTS)
Paul Pugmire reported on the Skate Park. The Slcate Parlc is done. They
have expanded the Skate Parlc already. They needed to add an extra pit
on the north and west end of it. This added $10,000 to the actual coat
of the Skate Parlc. We also had to hire a firm to haul gravel from the
County Gravel Pit. Right now they are $20,000 over budget. John Watson
with J.R.W. has agreed to carry that amount themselves and pay off the
contractors to give the city time to raise the money. The total cost of
the project with the assigning values including the donated land, the
fill that the County donated, donated engineering and Architectural
services and things like that, the total cost comes in at about
$200,000. About 1/2 is cash and about 1/2 is donated items. The major
part of that was a Grant from C.H.C., Cal Ranch donated $SODO, Rexburg
Kiwanis has donated $2500 plus a day of labor. He plans on asking them
to come and help when they cut the sod at the Waste Water Treatment
Plant to put at the Skate Park. In addition to that Riclcs College is
donating $2000 from the ticket sales from a concert that was held last
week. The Grand Opening will be Saturday at 11:00 A.M. to 6:00 P. M..
The one problem they need to solve is if they will allow bikes with
axle pegs? The skaters will pick up all the garbage. They will put up
signs for parking. The skate park opening is free but they will set
out jars asking for donations. The hours will be the same as the other
parks as allowed by Ordinance. They are putting up a sign with the
rules of the park that the skaters are drawing up. Brooke Passey will
make the sign. We also need to consider a sign offering a reward to
prosecute people putting graffiti on anything in a park. The mayor
congratulated Paul for all the work he had done on the park. There will
be a sign with Clair Boyle's name on it.
Paul explained there will be three Eagle projects associated with the
Skate Parlc. One of them will be a work bench that will have tools on it
so you can do work to adjust or fix your skate board and brooms and
snow shovels and we will make a nice sign with the names of the

businesses that donated materials for that. Discussion on parking up
behind the berm.
RE: UPDATE ON NATURE PARK ROAD
TOPIC: (23,24,,,NATURE PARK,PAVING,MADISON COUNTY, ROADS)
John Millar gave an update on the projects. The county has authorized
Dusty from Madison County to work with us on the road by the Nature
Park. Dusty told ue for the city to just do it and send the county a
bill and they would pay for the pavement of the road, so it is moving
ahead and plans are to get it done by this fall. The paving will just
go as far as Farrell's shop. The mayor pointed out there is a portion
of the jogging path that has not been completed that needs to be done.
There will be no curb and gutters put in there.
RE: UPDATE ON SOUTH HIGHWAY PROJECT

They have completed the Curb & Gutter on the South and West separated
side. That gives us some definition on what we are looking at, the rest
will come together quickly now. John anticipated they will be paving
within two weeks on the eastern half. They will start on the northern
half as soon at the pavement ie finished on the half they are doing
now. (discussion)
RE: UPDATE ON 2ND WEST PROJECT
TOPIC: (23,24,,,2ND WES T, L.I.D)
The 2nd West project is coming together finally. They have been hauling
a lot of rock out of there. There were no utilities in that area so we
had to put in water, sewer, storm drainage, and gas. Moat of that is be
picked up through the L.I.D. by the apartments. They are hauling most
of the rock down in our storage area by the street shop. We have a
responsibility of the check out on the river by the Rexburg Canal. We
agreed with the contractor the city would pay to haul it out to the
canal rather than to the storage so we would have the necessary rock to
repair the canal. We could haul it out there at a fraction of the cost
as to pay someone to load it and haul it. Sohn anticipated that by the
end of next week they would be ready to curb and gutter that.
RE: UPDATE ON WASTEWATER TREATMENT PLANT

The project at the Wastewater Treatment Plant ie out to bid right now.
We have called for bids for that for a week from Thursday. Most of the
contractors who are interested are from out of the area.
RE: UPDATE ON TRAFFIC SIGNAL AT MAIN STREET AND 1ST WEST
TOPIC: (23,24,,,TRAFFIC SIGNALS,MAIN STREET, IST WEST)
The design is complete on the traffic signal on Main and 1st West and
has been sent to the State. Because we are pushing time with it we have
gone ahead and bid the poles and will get them started. It will be a
new signal controlled by cameras instead of loops in the asphalt.
RE: UPDATE ON TRAFFIC SIGNAL AT 7TH SOUTH

The contractors are constructing that signal now. They are anticipating
about 45 days for completion.
The Railroad has part of theirs in. The flashing lights and cross walks
are in but the stop arms have not been installed.
RE: DISCUSSION OF SEWER LINE ON 5TH WEST AND 7TH SOUTH
TOPIC: (23,24,,,STH WEST,7TH SOUTH,SEWER, SEWER HOOK UP)
The area at South 5th West and 7th South have had a couple of things
come up that have made us look seriously at getting the sewer line in
that area. The land that serves that area was put in about the early
'70's and is only about 3 feet deep. As a result of that some of the
homes south of 7th South are not on the sewer. There is one individual

that would really like to be on the sewer because their septic tank has
failed. They are even upgrading their septic tank before we get sewer
in the area. That would be sort of a down payment but it is a first
step in getting that area down past Greg Moffats where you tum and go
up the hill. They are not in the city limits right now. He showed the
area on the map. The homeowners have mixed feelings about getting
annexed and there are same who don't want to hook on the sewer right
now. Don Rydalch stated he was promised 25 years ago to be put on the
sewer. What we looked at is when the Middle School was built there was
a pump station installed for the Middle School by the School District.
That has since been turned over to the city. In looking at it, the pump
is adequate but the problem is it was put in by the school for the
school and was not put in deep enough. In order to get it deep enough
to serve that entire area it would need to go deeper by about ten feet.
This would involve pulling out the pump station, resetting it and
putting in some intermediate man hole sections. Where some of the
existing homes are already on city sewer, he did not believe we could
charge them for city sewer since they are already on sewer. It would
get the sewer so it would serve all of that area which would eventually
come into the city. There is also some talk of the properties east of
5th West being subdivided in the foreseeable future. He and the mayor
looked it over and it would require an expenditure of about $78,000 to
put that sewer line in to serve that area and to do the work on the
pump station. Those funds are available in the sewer budget. If we are
going to do it this fall, we would have to move. on it immediately and
possibly declare an emergency if that is possible, where we can get
around the time frame of the bidding requirements.
Stephen stated he would need to look at the statute regarding declaring
an emergency. Based on John's recommendation as the Facility
Coordinator the council could declare an emergency because of the
immediate need. Sohn explained what would need to be done. A motion was
made by Glen Pond to allow the Mayor to make the decision based on
Stephen and John's determination if an emergency exists so we don't
have to wait two more weeks fora decision. Seconded by Nyle Fullmer.

RE: DISCUSSION ON TRAFFIC SIGNAL AT 2ND NORTH AND 2ND EAST
TOPIC: (23,25,,,2ND NORTH,2ND EAST, TRAFFIC SIGNALS,
IDAHO TRANSPORTATION DEPT.)
Discussion on the Traffic Signal for 2nd North and 2nd East. John told
the board that signal has been approved. Originally it was set to go in
at ?th North. It has now been officially set to go in at 2nd North. It
is set to be designed and done by the Highway Department. It is
scheduled to go in next year.
Glen gave a Legislative Report from the A.I.C. Legislature Committee
Meeting.
RE: DISCUSSION OF RECREATION PROGRAM
TOPIC: (23,25,,,RECREATION FEES, CITY WATER,SCHOOLS,MADISON COUNTY,
RECREATION,MADISON SCHOOL DISTRICT)
Jack Howman concerning Recreation Fees - The council has agreed to have
the County residents pay $5 more than the City residents for recreation
fees. His question is does that apply to activities that are not held
on City property for example, all the winter programs are held in the
schools and we are not using city facilities. There is no money in
exchange with the school. There have been complaints and he has heard
both sides. Discussion. Nyle explained there is an exchange with the
school they provide the facility and we provide water for the facility.
The county does not .participate to off set any of those costs. Stephen
explained because we give them free water it is an exchange for the use
of the facilities. It is the city tax payers that are subsidizing the
rent of those facilities.
Jack stated he had added twelve new programs to his winter recreation
programs. Two are adult programs. We charge per team and he asked if we
just charge $5 extra per out of city teams? We pay all the instructors
for the adult teams a percentage, 80% of the fee that comes in and the
city takes 20% after all the bills. Discussion. Jack explained the

advanced tumbling class that Shelly Liljenquist will teach. The
students have to try out for it. They will be selected for the class
according to their skill. It will go all year long and Shelly will ]seep
the books. It will be held at Adams School.
A motion was made by Marsha Bjornn that for our recreational sports we
charge more for our individual sports when people live outside of the
city limits but we charge a flat fee if the sign up is team sports as
designated. Seconded by Paul Pugmire. All Aye
Jack stated he is putting together a Recreational Flyer. In the flyer
there will be an explanation as to why county residents pay more for
recreation sign ups.
Marsha asked if the council could ride in the Homecoming Parade on the
fire truck this year? The mayor felt they could but would ask the fire
chief. Marsha commented that the parks and golf courses really look
good this year.
Marsha also felt we need to get the Hispanics involved in the community
more. The mayor stated that on the different recreation committees they
have included at least one Hispanic.
A motion was made by Nyle Fullmer and seconded by Farrell Young to
approve the bills. All Aye
A motion was made by Kay Beck and seconded by Nyle Fullmer to go into
executive session to discuss a personnel matter and possible property
acquisition.
