Bruce Sutherland Marsha Bjornn Farrell Young Kay Heck Glen Pond -arriving at 8:40 P.M. Rose Bagley Stephen Zollinger John Millar Richard Horner -arriving at 8:40 P.M. Introduction of scouts. The mayor explained that until one more member of the council arrives to constitute a quorum we will not be able to make any official motions or decisions. Glen Pond has been detained and will arrive later. RE: DISCUSSION ON SCHOOL CROSSWALKS TOPIC: (23,17,,,CROSSWALKS,SCHOOLS,WEED5,2ND SOUTH,COUNTY, RICKS COLLEGE,SCHOOL DISTRICT,LINCOLN SCHOOL,SAFETY COMMITTEE) Gerald Larson- 75 South 3rd East -was at the meeting to discuss Crosswalks at school crossings. The new fluorescent school crossing signs show that someone is thinking and also doing. Another thing that _. shows thinking and doing is the donation for video cameras on the county sheriff vehicles by a local family. Could a similar donation be used to install video cameras on the city patrol vehicles for surveillance of the cross walks? He showed some pictures in the vicinity of the Lincoln School. He discussed the stripping for the crosswalks and how they vary. Some are different than others and some are faded. He complained that across from the Lincoln School there was an undeveloped lot with slot of weeds on it and it does not have a sidewalk in. The children can't see the traffic around the weeds and they obstruct the walkway for children. Going East on Second South there is a new fluorescent sign and right down below it is a commercial sign for insurance and he felt that commercial sign distracted from the fluorescent sign. The council told him that is illegal and not allowed. There is also a problem with cars going around school buses that are stopped with signs out. The mayor explained that at a recent meeting with A.I.C. they showed some new crosswalk lights that are embedded directly into the asphalt at a crossing. When someone wants to cross they push a button and the lights are bright amber. The lights are flush with ground so they can be plowed over and when they flash they really show up. we are looking into that. We are looking at contacting Ricks College and the School District and have this company come up and give a demonstration of that kind of crosswalk. Another fellow explained the cross walks are really faded by Lincoln School and also he felt that speed is the big problem going by the schools. Kay told them the Safety Committee have discussed making a proposal to double the fines for speeding in school zones. Discussion on the weed patch and area without a sidewalk across from Lincoln School. When Silvertree bought that property they should have put the sidewalk in, but they sold the property and the sidewalk still has not been put in. The weeds also need to be cleaned off. John stated he had talked to him a couple of times but they still have not taken io care of it. He would make sure it gets done this time. John told the council he would call on the Insurance Signs. The residents at the mee Ling suggested they have a police car parked by every school. They also discussed the city taking out the 4 way stop at 2nd East and 2nd South. John told them we are doing traffic and pedestrian count at 2nd East and 2nd South right now. RE: CAROUSEL REPAIRS TOPIC: (23,18,,,CAROUSEL) John gave an update on the Carousel Repair - They have been looking at what needs to be done to repair the Carousel. They have found they will have to do some disassembling to aee what needs to be done. We will have to tear it apart enough to see what is wrong. This should take a `--- few hours. Kay suggested that when we get the man power we need to go forward and tear it apart and find out what needs to be done. John said he would put it on hie agenda. RE: WASTEWATER TREATMENT PLANT TOPIC: (23,18,,,WASTEWATER TREATMENT PLANT) Report on the Wastewater Plant Addition- They have advertised for bids on that project and have obtained approval from The Department of Commerce and D.E.Q. We will be calling for bids on September 22. We will get started this fall and be in a position to start as soon as we can in the spring on the Clarifier. There is a lot of interest from contractors. He has set up for 275 days so it takes it into next summer for completion. RE: REPORT ON 2ND WEST PROJECT TOPIC: (23,18,,,2ND WEST,REXBURG CANAL COMPANY) On the 2nd West project the contractor is moving rocks from that job and has taken some of that rock out to the Rexburg Canal diversion. They will be hauling gravel on that project nextweek and should have curb and gutter in two weeks. It should take shape quickly after that. RE: REPORT ON SOUTH HIGHWAY PROJECT TOPIC: (23,18,,,SOUTH HIGHWAY,7TH SOUTH,RAILROAD CROSSINGS) On the South Highway project we have acquired the right-a-way that we have needed on that project on the comer triangle. That has been settled. The light on 7th South has been bid to Wheeler Electric and they have ordered the parts. The Railroad have started on their signals on 7th South. RE: NATIONAL ELECTRIC CODE TOPIC: (23,18,„ ELECTRIC CODE,ELISON*DR,1ST NORTH) Sohn explained to the council in 1978 the city adopted the National Electric Code for the city and since then have been operating under that code. The council at that time added a couple of items beyond that code. (1) "Requires in any buildings open to the public., such as churches, schools, hospitals, hotels, motels, stores, theaters, commercial buildings, storage garages, industrial and manufacturing buildings or warehouses, and any building containing multiple dwelling occupancies of four or more units located any place within the City of Rexburg. Number 12 AWG wire shall be the minimum size conductor used in these installations." The National Electrical Code does not require that. This ordinance also requires Number 12 AWG wire shall be the minimum wire size used in Residential Home Construction." The National Electric Code does not require that." The National Code allows 14 gauge. A few years ago the council updated this code to use the most current copy of the National Electric Code but let stand these two items. What has brought it to our attention is the new Orthodontist Office south of Adams School this requirement of the city somehow did not get relayed to the contractor that it had to be in conduit. The building has been wired and when the State Electrical Inspector was called in to inspect this building, he brought it to the contractor's attention that it was wired in accordance of the N.H.C. but not in accordance with the city ordinance. The contractor asked if there was a possibility the council will change this or does this regulation still stand. He is looking at between $4000 and $5000 to rewire the building. John stated he felt the National Electrical Code is adequate and does not need to be more stringent than that. Discussion. Stephen told the council we would need to grant a variance in anticipation to amending the ordinance. You can do that as long as it is anticipated and if the vote fails to rescind the ordinance his variance would be rescinded. That would take a vote RE: REPORT ON SKATE PARK TOPIC: (23,19,,,SKATE PARK) The mayor gave the council an update on the Skate Park. Kay told the council they are having trouble with kids getting on the concrete even though there is a sign up. He suggested the police put up some police ~.-....... tape to discourage that. Officer Larson said they had a tape that could be put up. RE: DISCUSSION ON NEW PARKING TICKETS TOPIC: (23,19,,,PARKING TICKETS) ParkingTickets - Stephen discussed the existing Parking Tickets. The police need to print new parking tickets and they have been working with a form they are comfortable with and they want to change it from a Criminal to a Civil violation if the council does not object. It would put them in a position tc treat it differently at the end but treating it exactly the same at the front. He had a copy of a ticket from another area that they preferred. He handed a copy out and discussed the amount of the tickets for various offenses. We will put this on the agenda for the next council meeting. Discussion on Sand and Cinders and snow removal. Glen Pond and Richard Horner arrived at 8:40 P. M. A motion was made by Glen Pond and seconded by Farrell Young to approve the minutes. All Aye RE: ELECTION RESOLUTION TOPIC: (23, 19, RES,99.07,ELECTIONS) Mayor Sutherland read Resolution No. 99.07 A RESOLUTION PROCLAIMING A GENERAL CITY ELECTION TO HE HELD ON NOVEMBER 2, 1999, DESIGNATING THE POLLING PLACES, DESIGNATING. THE REGISTRAR AND DEPUTY REGISTRARS, AND ORDERING THE CITY CLERIC TO GIVE NOTICE OF SUCH ELECTION. A motion was made by Kay Beck and seconded by Farrell Young to pass Resolution No. 99.07. All Aye RE: SAND VS CINDERS TOPIC: (23,19,,,SANDING, CINDERS,SNOW REMOVAL) Sand vs Cinders - After discussion a motion was made by Kay Heck and seconded by Glen Pond to approve the use of cinders on the roads, the main reason being economics. Farrell Young asked if there was any other alternatives. Sohn told him there were chemicals but they are very costly. All Aye to the motion. ICay said we need to buy the cinders as soon as we can. RE: INTERNET AND EMAIL POLICY TOPIC: (23,19,,,INTERNET,EMAIL, PERSONNEL POLICY) Internet and EMail Policy - Richard handed out a copy of the policy and explained it. He stated we can amend it as needed. We will hire an Internet Company to screen areas that come in. A motion was made by Kay Heck and seconded by Marsha Bjornn to include this policy in our Personnel Manual. All Aye RE: PUBLIC HEARING ON GARBAGE RATES TOPIC: (23,19,RE5,99.OS,HUDGET, GARBAGE RATES,PUHLIC HEARINGS) Public Hearing far the Budget for the Fiscal year October 1, 1999 to September 30, 2000. At the same time the Public Hearing will include an increase in garbage rates. Richard handed out a Garbage Fee o, -- calculation. Discussion. Mayor Sutherland closed the part of the hearing for the Garbage Rate Increase. A motion wds made by Kay Beck and seconded by Glen Pond to approve Resolution 99-OS adopting a new rate schedule for garbage collection fees. All Aye RE: PUBLIC HEARING ON BUDGET TOPIC: (23,20,ORD,822,BUDGET,ORD 807, PUBLIC HEARINGS) Public Hearing to amend the 1998 - 1999 Hudget. There were no citizens in attendance to comment. Mayor Sutherland closed the hearing. ---""- ORDINANCE NO. 822 AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, AMENDING ORDINANCE NO. 807, THE APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1998 AND ENDING SEPTEMBER 30, 1999: APPROPRIATING ADDITIONAL MONEYS "" THAT ARE TO BE RECEIVED BY THE CITY OF REXHURG, IDAHO, IN THE SUM OF $1,961,800. Richard explained the proposed additional expenditures and estimated additional revenues. A motion was made by councilman Glen Pond and seconded by Kay Beck that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 822. - Those voting aye: Glen Pond Marsha Bjornn Farrell Young Kay Beck Those voting nay: none Ordinance 822 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Glen Pond and seconded by Kay Beck that ordinance 822 be passed. Those voting aye: Glen Pond Marsha Bj ornn Farrell Young Kay Beck Those voting nay: none The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the city council had voted for the passage of said ordinance was duly and regularly passed. Mayor Sutherland declared the motion carried. RE: CITY COUNCIL SALARY INCREASE TOPIC: (23,20,ORD,820,ORD 694,CITY COUNCIL,SALARY RANGE) Mayor Sutherland discussed a salary increase for the City Council. The last time the City Council's salaries were increased was in 1989, this would raise the salaries $100 a month which would be $250 plus travel. Mayor Sutherland read Ordinance 820 AN ORDINANCE AMENDING SECTION I OF ORDINANCE NO 694 INCREASING THE SALARY OF THE COUNCILMAN OF THE CITY OF REXBURG, TO CONMENCE JANUARY 1, 2000, AND AMENDING SECTION I OF ORDINANCE NO. 694 INCREASING THE SALARY OF THE CITY COUNCIL OF THE CITY OF REXHURG, TO COMMENCE JANUARY 1,2000. A motion was made by councilwoman Marsha Bjornn and seconded by Kay Beck that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 820. The roll showed all councilmen present voting with a tie vote, with the mayor breaking the tie vote by voting aye. The said ordinance was duly and regularly passed. Mayor Sutherland declared the motion carried. RE: REVIEW OF BUDGET FOR NEXT FISCAL YEAR TOPIC: (23,21,ORD,821, PUBLIC HEARINGS,BUDGET) Richard then reviewed the Budget for the fiscal year October 1, 1999 to September 30, 2000. There were no citizens present to comment. Discussion from the council The mayor closed the hearing. ORDINANCE NO. S21 AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1999, TO SEPTEMBER 30, 2000, AND APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENC7E DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY HY THE MAYOR AND CITY COUNCIL, TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTENIDER 30, 2000; AND PROVIDING FOR THE EFFECTIVE DATE OF ORDINANCE. A motion was made by councilman Kay Beclc and seconded by Glen Pond that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 821.
