A motion was made by Glen Pond and seconded by Paul Pugmire to approve the bills. All Aye Introduction to scouts. RE: MICHAEL ANTHONY REGARDING CIVIL RIGHTS TOPIC: (22, 90,,,CIVIL RIGHTS,POLICE DEPT.,CITY ATTORNEY) Michael Anthony 30 College Ave Apt 310- Regarding Civil Rights- He stated he believed his Civil Rights have been violated by the City Police who represent this council. He believed his constitutional right to Freedom of Speech had been violated. The City Police confiscated his American Flag. He committed no crime and his constitution right have been violated by the city. He wants justice brought to Rexburg. Discussing his rights and read the Oath of Office and talked about the responsibility of those that take the Oath. He called for the resignation of the City Attorney and all the Police Officers who were involved with conspiracy to deprive him of his rights. He stated he wants his rights, justice, and accountability. He said he deserves not to be treated as a second class citizen. The mayor asked if there were any comments from the council. The council had no comments. RE: RESOLUTION 98.10 AGAINST DRUG DRIVING TOPIC: (22,90,RE5,98.10,DRUGS,DRUNK DRIVING, POLICE) Resolution 98.10 Against Drug Driving (Copy on file) Lieutenant Bart Smith of the Rexburg Police Department discussed the resolution. He has worked for the police department for 18 years. This resolution is to take a stand against Drunk Driving. In the 18 years in law enforcement in the last couple of years he has seen a great increase of our alcohol consumption by the youth including the use of some prescription drugs. Especially this time of year with the holiday season we look beyond the fact that the youth is our future and kids are dying every day from the use. The state and federal government have put this together "Mothers Against Drunk Driving" to take a stand in the month of December to make the 18th the day of lights on all city vehicles to turn them on to support those that have passed before us as victims of drunk driving. The police department would like the city to allow them to make a night during this period of time where they could have Saturation Patrol. They would like it on December 31 and January 1. They would put more patrolman out on those nights. He introduced his officers present at the meeting and explained their jobs as they are involved with drugs and alcohol. The mayor stated he would like to endorse this resolution and told the officers how he appreciated the concern of the police department and many members of our community have with this problem. (discussion) Hart li ~ told the council the youth are drinking beer, wine coolers, and Robitussen cough medicine. They also mix the drugs right in the cough medicine. He also described the Saturation Patrol. A motion was made by Glen Pond to approve Resolution 98-10 with the program they have proposed for the end of the month. Seconded by Paul Pugmire. All Aye The mayor suggested that where we are doing spot checks on New Years Eve if there could be something we could give them or a thank you note that they are alcohol and drug free. RE: MARFC MPS2TIN AMENDED PLAT APPROVED TOPIC: (22,91,,,MARTIN*MARIC, 2ND W,STH S,APARTMENTS,SHELHOURNE APT.) Marc Martin Amended Plat- A representative from Harper Leavitt Engineering in Idaho Falls was at the meeting to present the amended plat to the City Council. This property is on 2nd West and 5th South. A motion was made by Glen Pond to approve the amended plat as proposed and approved by Planning & Zoning. Seconded by Paul Pugmire. All Aye The mayor stated that regarding this and by way of information. Because of the reconstruction of 2nd West Street and because it is a minor arterial the city will need to be participating in the construction of the street. We felt it would be advantageous to form an L.I.D. for this project and do as much of the street as we can curb, gutter, sidewalk, sewer and water. He, Richard, Joe, and Stephen felt it would work well. RE: BEER LICENSE APPROVAL TOPIC: (22,91,,,BEER LICENSE,RITE AID,ALBERTSONS,MAVERICK,BROULIMS) Beer Licenses: Oasis when they get their County License. A motion was made by ICay Beclc and seconded by Glen Pond to approve this license contingent upon them getting the county license. All Aye Rite Aid, Albertson, Maverick 195, Short Stop #2. A motion was made by Kay Beck and seconded by Paul Pugmire to approve these beer licenses. All Aye Broulims when they get their County License. A motion was made by ICay Beck and seconded by Marsha Bjornn to approve this license contingent upon them getting the county license. All Aye A member of the audience asked what action we were going to take on Michael Anthony? The council told him no action was necessary. RE: PLANNING & ZONING ANNEXATION CHANGES TOPIC: (22,91,,,PLANNING & ZONING,ANNEXATIONS,DEPARTMENT HEAD) The mayor told the council Planning & Zoning are willing to meet and discuss a punch list for annexation anytime that would work for the council. It was suggested by the council that we wait until Sohn Millar comes to work and those in that department can come up with a list and we can meet in February and add anything to the list we think necessary. RE: PLOWING & SAND IIQG ON 7TH SOUTH SANDING VS CINDERS TOPIC: (22,91,,,7TH S.,RICKS COLLEGE,BTREETS,SANDING) The mayor told the council we need to discuss the plowing and sanding on 7th South. We have an agreement with college that says they will plow and sand their interior streets, however 7th South is an interior street. In talking to with Chuclc Frost about it, he maintains they did not make any arrangements to plow or sand it because they .felt it was a city street, the city built it and the city owns it and the city pays the power on the lights. (discussion) It was decided to arrange a meeting with them. A Motion was made by Glen Pond and seconded by Nyle Fullmer that Hruce, ICay and Stephen would meet with them and come to a decision- All Aye Discussion on sand vs cinders. All the council have had calls. The police said they thought the cinders did the best job. Stephen said there is a method you can use to determine which works the hest. There is a devise you can use. RE: RECREATION COMMITTEE TOPIC: (22, 92,,,PLANNING & ZONING,RECREATION, RECREATION COMMITTEE, B IICE PATH,NATURE PARK) Paul made a report on the Planning & Zoning meeting. He felt we need to get serious about forming a Recreation Committee. The mayor said Roger Hampton with the school called and wants to get together with John Watson and Joe and find out how to get a plan ready to present to the Planning & Zoning. They had a meeting with the Trails of Madison County. The problem they are having is they are almost out of trails with the money to develop and we still have the area between the Nature Park and 2nd East along the river that we can ati11 actively pursue under some grants and use some of the Tax Increment Financing on the area on 2nd East which has the provision to develop some jogging paths along by the river. They talked about that we need a close assessment of everything for recreation. We taltced about Lagoon B used possiblyfor a Soccer or Haseball Field. It was discussed about the use for the Louisiana Pacific Property if we can get that and we discussed the Garner property. They discussed everything to do with recreation. We need a Super Committee for Recreation and for it's needs. The mayor taltced to Charles Grant about Chairing that Committee and he has agreed and is excited about it. He will be happy to start right after the first of the year. A motion was made by Nyle Fullmer and seconded by Kay Beck to pay the bills. All Aye Meeting adjourned.
