A motion was made by Farrell Young and seconded by Kay Heck to approve

RE: APPROVAL OF HEER LICENSES
TOPIC: (22,86,,,MAVERICK,TETON LAKES,HEER LICENSES)
Mayor Sutherland read the Seer Licenses Applications for Teton Lanes
and Maverick Country Store #169 12 South 2nd West. A motion was made
by Nyle Fullmer and seconded by Kay Beck to approve the license. All

Discussion with a citizen about procedures of council meetings and
voting on issues. The citizen was told to call and get on the agenda
for the next meeting.
RE: RESOLUTION FOR COMMERCIAL DEPOSITORY SERVICE
TOPIC: (22,86, RES,98.09,DEPOSZT)
Mayor Sutherland read Resolution 98.09 "A Resolution indicating the
authority regarding Commercial Depository Services." A motion was made
by Glen Pond and seconded by Nyle Fullmer to approve Resolution 98.09.

RE: ANNEXING DON BLUNIC PROPERTY APPROVED
TOPIC: (22,86,ORD,814,BLUNK*DON, NORTH HILL RD,ANNEXATION)
Mayor Sutherland read Ordinance 814 Annexing the Don Blunclc property.
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXHURG, IDAHO,
DESCRIBING SAID LANDS AND DECLARING THE SAME A PART OF THE CITY OF
REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING MAP OF THE. CITY OF
REXBURG, IDAHO, AND THE CITY OF REXHURG 2010 TO SHOW SUCH ANNEXATION
AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE
CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
Glen stated that we need to make up a punch list before we annex
property such as city services, police, fire, streets, water and
sewer. We need a work meeting with the planning & Zoning.

A motion was made by councilman Glen Pond and seconded by Kay Beck that
the rules requiring an ordinance of a general and permanent nature to
be read on three occasions be dispensed with and that said ordinance be
1--- numbered 814.

Ordinance 814 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Glen Pond and seconded by Marsha Bjornn that
ordinance 814 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the City Council had
voted for the passage of said Ordinance was duly and regularly passed.
Mayor Sutherland declared the motion carried.
RE: STREET LIGHTS NEED IN SUBDIVISIONS
TOPIC: (22,87,,,STREETS,STREET LIGHTS,RICKS PALMER SUBDIVISION)
Street Lights- Glen reported he took the list from the last meeting and
contacted the utility and they are getting together some cost figures
and that will take about one month. There is about eight or nine
locations they wanted lookedat.
The mayor reported Dean Ricks came in and he has already paid for the
additional street lights in the Riclcs Palmer Subdivision. He and the
mayor came to a compromise agreement for the easement.
RE: NEW PI CIC-UP FOR THE FIRE DEPARTMENT
TOPIC: (22,87,,, FIRE DEPT.,EQUIPMENT)
Bids for a Crew Cab Pickup for the Fire Department. Chief Spence Larson
explained the bids. The had put $28,000 in the budget to replace the
,,. Ramcharger which is 15 years old. We can seat six fireman in the
pickup. Madison Ford was the low bid at $26,247. They would still have
enough for a hitch and a small shell to put fire equipment in. A

RE: L.I.D. 30 PUBLIC HEARING
TOPIC: (22,87,,,L.I.D.30,TREES,WATER HILL,PUBLIC HEARING)
Richard explained L.I.D. 30. We started with the L.I.D. one year ago.
In the spring we met with residents. Some of the estimated costs came
up from the original estimate because of concrete removal and other
things. Some of the residents wanted to save the trees and we tried to
do that and there was additional cost for that. You will have thirty
days from tonight to pay all or part of the amount without interest and
then it will be set up on a 10 year payment at 5.5% interest. If you
choose we could add the option to add 1/12 of that next annual payment
to their water bill so it is a little easier to pay. We will send out a
notice for that option with the legal notice.
Mayor Sutherland opened the Public Hearing.
Glen Pond stated he had a comment from Brent Barker that he was told he
would get an adjustment on the trees for $150 which would be taken off
his assessment.
The mayor explained the the trees that have been removed will be
replace in the spring.
Beth Skeleton- 258 Harvard- She had Joe and Richard remeasure her
property because her measurements were not the same. She had a question
on the engineering that was not mentioned in the estimates that they
were given. She thought that was why people were concerned that their
assessment was different than the estimates. Her estimate was $3485.80
and ended up being $5324.60 which seems like quite a bit of difference.
She asked if the engineering is always charged to the home owner? She
could understand that it takes a lot of engineering on the road they
had to do and the sewer line they did but she did not think there was

much. engineering that went into the sidewalk and curb and gutter. She
felt that was a little excessive. It is really more than 10.5 0 of the
final estimate and that was a concern. She asked about the financing?
In the notice it said the city could increase it up to 20~.that would
be excessive. The mayor told her these figures that have been mailed
out are final. Richard explained that is the language we have to put in
the notice are required by the state and not necessarily our language.
Susan Larson- 75 South 3rd East- She had a concern about the
engineering costs. The cost to her was $1700 difference from the
''i°` estimate, which she thought was quite a bit. She also asked about the
city being able to add another 20~? The mayor told her we have never
done that before and don't plan to. She asked if her property could be
';. _._ measured again? She objected because it had been forced on her and
there are sidewalks in Rexburg that need to be replaced and have not
been done. She felt bad that some of her good sidewalk had to be torn
out. They also took out her sprinkler system and replaced it with one
that was not as good. She said they didn't even put a lot of dirt under
the grass, so they will have dead grass. The mayor told her we would
address those and any concerns anyone has. The council told them we
would work with them and make it right. The mayor told them the
project was much more costly than they had anticipated. xay told her to
come in and go over it with Richard and Val.
Chris Huskinson- 55 South 3rd East- He read a statement about his
concerns. (on file) He had pictures of his sidewalk that was in good
shape and it was taken out and he had to replace it. He was unhappy
about having his trees cut down. Joe said originally Val had marked the
sidewalk that needed to be replaced because of cracks or defects. There
was sections they had to take out because they had to take the service
line through. For a portion of it they thought they were going to take
the sewer line along the sidewalk area. The mayor stated that in order
to save the trees we possibly removed some sidewalk we may not have
needed to. Chris showed pictures of his old sidewalk. He said on the
west side of the street they just took out sections of sidewalk and
some it that was left is in worse condition than his was. Chris asked
why the property owners should have to pay for sidewalk that was taken
out that was in good shape? The mayor told him the city put a lot of
money into that street. The only block we tools the sidewalk out like
that was the first block and anyone living on that block with questions
needs to come in and talk to us and see what we can do. Just trying
to save the trees cost an extra $10,000 to the city. Susan Lewis stated
they did not have trees and they took out sidewalk that was in good
condition.
Richard stated that the reason some of the sidewalk was taken out is
some of the sewer lines was not in the spot they thought it was.
Gail Taylor- 217 Harvard- Ask about paying. Say Ricks 259 South 3rd
East also asked about paying the assessment. Richard explained.
The mayor closed the hearing and turned it over to the council.
Marsha had some questions and the mayor gave some history. Nyle asked
about the $100 connection fee. Joe told him that was the cost of the
fitting connection.
RE: ASSESSMENT ROLL FOR L.I.D. 30

Mayor Sutherland read Ordinance 813 Confirming the assessment roll for
L.I.D. 30. AN ORDINANCE CONFIRMING THE ASSESSMENT ROLL FOR LOCAL
IMPROVEMENT DISTRICT NO. 30 IN REXBURG, IDAHO, FOR THE PURPOSE OF
INSTALLING CERTAIN STREETS, CURBS, GUTTERS, SIDEWALKS AND PARTS THEREOF
WITHIN THE CORPORATE LIMITS OF SAID CITY, TO GRADED, RE-GRADED,
GRAVELED PAVED REPAVED AND OTHERWISE IMPROVE THE HEREINAFTER DESCRIBED
STREETS WITHIN THE DISTRICT AND TO CONSTRUCT P.ND RECONSTRUCT SIDEWALKS,
CURBS, GUTTERS, DRIVEWAYS, DRAINAGE FACILITIES, OFF SITE STORM EWER AND
OTHER WORK INCIDENTAL TO ALL OF THE FOREGOING IMPROVEMENTS; ORDERING
ASSESSMENTS TO BE MADE IN ACCORDANCE WITH THE ASSESSMENT ROLL AND
PRESCRIBING DETAILS CONCERNING SAID ASSESSMENTS; AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
