A11 aye. RE: FIREWORK PERMITS FOR 1998 APPROVED TOPIC: (22,30,,,FIRE DEPT.,FIREWORKS) The mayor read the firework permits to be approved. The name of the company is Pyrodyne American Corp from Murry Utah. The location of the stand will be at Payless/Rite Aid, 125 Valley Drive, Albertson's, 490 N 2nd E, Wal-mart 530 N 2nd E and Broulims Market, 124 W Main. Nyle Moved to approve the firework permits for 1998 Bruce seconded. All aye The date for the Comprehensive Plan Public Hearing was set for June 3, 1998. RE: AIC CONFERENCE 1998 TOPIC: (22,30,,,COUNCIL MEMBERS) Registration for the AIC Conference, The mayor asked if everyone is planning to attend the AIC Conference it will be held in Idaho Falls this year, June 17, 18, & 19. We also need to change the meeting time for the City Council meeting on June 17, 1998, it will be changed to June 17, 1998 7:00 a.m. RE: SENIOR CITIZENS REQUEST FOR PARKING PAVED TOPIC: (22,30,,,SENIOR CITIZENS,BUDGET,COUNTY,PARKING) Request for the Senior Citizen to have the parking lot on the south side of their building paved. The proposal includes having the County pay half. We can put it in to next years budget. The city's portion will be approximately $3,000.00. RE: MERRILL RUDDS TREES TOPIC: (22,30,,,RUDD*MERRILL,TREES,SIDEWALKS) Merrill Rudds trees -Mr. Rudd has returned from his mission and his trees are still a problem, they need to be moved or trimmed back. The Mayor spoke to him last week and Mr. Rudd said that he would come to this City Council meeting to discuss this issue with them. We have made everyone else in the city take care of their trees and the Rudd's should take care of theirs also. U.S. West said that they would move the phone box, at U.S. West expense, as soon as the city requests it. fi~ RE: HOMES SOLD THAT NEED SIDEWALKS TOPIC: (22,31,,,SIDEWALKS,L.I.D.) Bruce mentioned that he had noticed that Carl Smith's home at 18 Ash had been sold, and they have not put in sidewalks. The mayor said that he would talk to Val about the recent houses that have been sold that need to have sidewalks and have him look into it. Bruce moved to pay the bills and Marsha seconded the motion. All aye. RE: TANKS AT THE AIRPORT TOPIC: (22,31,,,AIRPORT,TANKS,AIRPORT BOARD) Farrell Young reported on the Airport meeting. The old oil tanks are still in the ground and they need to be removed by the end of this year. We need to find out who is responsible to have the tanks removed. RE: STREET REPAIRS TOPIC: (22,31,,,BUDGET,STREET DEPT.,7TH S.,TRAFFIC SIGNALS) The mayor read a list (on file) of street that need to be repaired, there is money in the budget for this. Part of the money will need to go for a crossing light at the intersection of 7th south and hwy 191 the estimated cost is $110,000. We will still have enough money in the budget to do some chip sealing, the total to do the listed streets will be approximately $167,000. Bruce thought that it would be a good idea to put the traffic light at 7th south in at the same time they put the traffic light in at 1500 south, to try to save money. RE: LAW TO INCREASE MILL LEVY PASSED TOPIC: (22,31,,,TAXES,SWIMMING POOL) -- The mayor mentioned that the law was passed, that would increase the mill levy up to .0006. The city is 92nd lowest in the state for our '' mill levy and this would give us a chance to raise it. If we pursue ''°-- this, he beliefs that the first $30,000 should go towards opening the swimming pool. Marsha asked about putting a skate board park into the budget. RE: REZONE PUBLIC HEARING FOR TED AND EDNA GARNER APPROVED TOPIC: (22,31,,,REZONE,PUBLIC HEARING,BARNEY DAIRY RD,ZONING, GARNER*TED) 7:45 Public Hearing for the Rezone of the Ted and Edna Garner Property located south of Barney Dairy road, the location is a portion of Lot 4 of Block 18 and a portion of Lot 2 of Block 18 of the Rexburg original townsite. Garner would like to have their property rezoned from LDR1 to MDR. Ted Garner showed a map of the area that he would like to have rezoned. (discussion) The size of the lot is approximately 3 acres, there is 3 parcels. The area was originally zoned R3 and when the present zoning ordinance was developed it was rezoned to LDR1. The Garner are upset that the city would rezone their property and not notify them.(discussion) They would like to have the land rezoned so that it will be more desirable to a buyer, and if they can't sell it, they have thought about developing it themselves. Mrs. Garner felt that they had donated so much to the city and schools, this is a small request. (letters from opposition on file) Brent Orr- 246 N 3rd E (Brent read letter on file) Brent bought his house when it was zoned LDR1. His property is surrounded on the north and the east by the Garners property. John Zirker - 415 E 1st N, John indicated that to his knowledge, this is the fourth time that the property in question has been requested to be rezoned in the last twenty years. The surrounding neighbors want the property to stay residential. At the present time ~`L there is a lot of traffic in that area with the doctors office and school. The Mayor closed the public hearing to public comment. Nyle asked for clarification- John Millar indicated the reason that the Planning and Zoning approved the property to be rezoned is that orginally the property was zoned R3 which is high density, when the last zoning ordinance was done it was rezoned to LDR1, and they would like to be rezoned to MDR. It could serve as a buffer between the sports complex and LDR1. The frontage on 3rd east is 106 feet, which does not allow for development. There is a possiblity that you could enter on Barney Dairy road. It could be made into 2 lots to be sold. The area is low and it would require back fill to bring out of flood plain, and there is a possiblity that the sewer would be a problem. If it was to be zoned MDR it would be zoned for more feasible uses. Glen read the MDR table from the zoning ordinance to inform the Council of the allowed uses. (discussion) The Planning and Zoning felt that the best use for the land is MDR, due to the surrounding properties. Nyle moved that the zone change be allowed, Bruce seconded. All aye, except Glen Nay, Marsha Nay. Motion passed Budget meeting for will be set for May 28, 1998 at 6:00 p.m. Hruce moved that we adjourn, Nyle seconded.
