A motion was made by Nyle Fullmer and seconded by Kay Beck to approve

RE: SCHEDULE A PUBLIC HEARING TO VACATE VIKING DR
TOPIC: (22,10,,,VIKING DR,PUBLIC HEARNG,RICKS COLLEGE)
Glen told the council we need to set a Public Hearing to vacate Viking
Drive. A motion was made by Kay Beck and seconded by Farrell Young to
set a Public Hearing on April 1 to vacate Viking Drive. Discussion.

RE: JED STODDARD INQUIRING ABOUT ANNEXATION AND ZONING CHANGE FOR
SUBDIVISION

Rod Jones was at the meeting representing Jed and DeVerl Stoddard.
They have been looking for a small piece of ground to do a small
subdivision as well as adjacent property for a small trailer court.
They have met with Joe regarding different pieces of property. The
piece of property they are looking at right now is on 1500 West and
just before you get to the subdivision at the end of 1500 West, there
is a piece of land just north of the subdivision. It is approximately
26 acres and runs along the freeway. Their question is what would it
take to have it annexed and have the zoning changed so they can go
ahead and proceed with it. They are looking at having the lot sizes
at 6000 square foot which is the minimum lot size. The south end of
that would be a small subdivision for homes ranging from $60,000 to
$100,000 price range. The other phase would be for a trailer park for
1994 or newer trailers. He thought it would have to be rezoned to
LDR2.
Another question he had is city water and sewer is down by the Stake
Center and if Stoddards were to tie onto that and run it over to the
subdivision and run it through the subdivision would that be allowed
without being annexed. They were also wondering if when people hook on
if Stoddards could be reimbursed for part of those fees?
Farrell Young pointed out that the property is not contiguous with the
city limits, so how could it be annexed? Kay said the mayor was going
to call the property owners along there to see if they would be
interested in annexing. Joe said the mayor did call several people and
they had no problem with LDR1 Zone going in but were opposed to a
mobile home park and they were not much in favor of being annexed.
They have their own water system and septic system.
Joe showed on the map where the water and sewer lines and the city
limits are. Joe said we could annex that property over their objection
because they are all small owners. He pointed out it would be fairly
easy for them to hook onto city water and sewer. It would be possible
with an annexation agreement that when the property owners wanted to
hook on all or part of the hook on fees could be reimbursed to the
Stoddards.
Glen stated that Richard had suggested that we should have a meeting to
review what we want to do with that kind of a request. Some of the
concerns you get a red flag on when you do that is we can be regulated
by the Idaho Public Utilities Commission. He was not sure we wanted to
get involved with that. Normally we have charged 1 1/2 times for the
services but when you do that outside the city limits then you become a
,....... provider and come under their regulation and complaints can be issued
to the Public Utilities Commission. They become the mediator between us
and whoever has a complaint. They can also review what our fees are
and it becomes a problem for a city to do that. Nyle Fullmer pointed
out it has been our policy not to allow anyone to hook onto our city
services unless they were in the city limits. Farrell Young suggested
to him that annexation would be the best way if we could find a way to
do it. (discussion)
The council suggested to him that he come in the city and get a current
map of the city limits and meet with the property owners and get their
feeling. After he has done that he would need to meet with the
Planning & Zoning and let them review it and give the council a
recommendation.
RE: CHANGES TO SIGN ORDINANCE 775
TOPIC: (22,11,,,SIGN)
Changes to Sign Ordinance 775 - Stephen explained the changes and
recommendations made by the Planning & Zoning. (copies on file) Right
now Stephen and Joe are reworking the complete sign ordinance. These
new changes are guidelines for the size of a sign. The Planning Board
have also recommended to do away with Off Premises Signs.
A motion was made by Nyle Fullmer and seconded by Kay Beck to pay the
bills. All Aye
