A motion was made by Farrell Young and seconded by Nyle Fullmer to approve the minutes with one change. All Aye RE: NORTH POINT PROPERTY DEVELOPMENT TOPIC: (21,98,,, ROADS,R.D.A.,TAX INCREMENT) _. The mayor commented on the Planning & Zoning Minutes. He stated that the County Commissioners did not commit to a Tax Increment Financing for the new development by North Point Property. They did say they --- would think about it. Down to the R.D.A. there were mayors and county commissioners and they were unanimous that it would not meet the qualifications for structure of roads through that agency. They thought it should be paid for by the developer. RE: BIDDING FOR 7TH SOUTH TOPIC: (21,98,,, RICKS C0LLEGE,7TH SOUTH,VIKING DR.) The Department of Transportation has been slow in bidding 7th South and it is set by September 23. He had a call from Helen Klinger saying that there are several people that think we should temporarily close Viking Drive during the day for certain hours. Captain Randy Lewis was at the meeting and the mayor asked if they had been watching that at all. Randy stated he had been up there a few times today but did not see a problem yet. The mayor asked if they would watch that. Glen stated that he did not think we should close it until 7th South is done. Kay suggested that the construction is too far out on the road. Bruce suggested that they eliminate the parking. RE: PLAYGROUND EQUIPMENT FOR SMITH PARK & NATURE PARK TOPIC: (21,98,,, HANDICAPPED,SOROPTIMIST CLUB,SMITH PARK,NATURE PARK, PLAYGROUND EQUIPMENT,RECREATION) The mayor gave the council pictures and information on the Playground Equipment that had been bid. The Soroptimist is donating money for the playground equipment for Smith Park and it is handicapped accessible. We need to approve that bid. We also need to buy one for the Nature Park. It is in the budget. The mayor had Clair call and see what price we could get if we bought two and there is a savings of $975 on each unit making the purchase price $15,275 per unit if we buy two of them. There will be installation costs. The man that installs it lives in Ashton. Richard stated we will lease to purchase the equipment except for the equipment for the Nature Park and we have the money for that. A motion was made by Marsha Bjornn and seconded by Nyle Fullmer to buy two sets of playground equipment as bid one set for Smith Park and one set for the Nature Park. All Aye RE: PROCLAIMATION FOR GENERAL CITY ELECTION TOPIC: (21,99,RES,97.07,CITY ELECTION) Mayor Boyle read Resolution 97.7 A RESOLUTION PROCLAIMING A GENERAL CITY ELECTION TO BE HELD ON NOVEMBER 4, 1997, DESIGNATING THE POLLING PLACES DESIGNATING THE REGISTRAR AND DEPUTY REGISTRARS, AND ORDERING THE CITY CLERK TO GIVE NOTICE OF SUCH ELECTION. A motion was made by Nyle Fullmer and seconded by Bruce Sutherland to pass Resolution 97.7. All Aye Rose reported that the county will not charge us to use their ballot counter, but we will have to buy a chip for the machine and special ballots for the machine. We will have to have their employees run the machine. We will have two separate ballots. RE: GRIEVANCE PROCEDURE TOPIC: (21,99,RES,97.08,GRIEVANCE PROCEDURES,DISABILITIES) The mayor read 97.8 Grievance Procedure of the City of Rexburg. THIS GRIEVANCE PROCEDURE IS ESTABLISHED TO MEET THE REQUIREMENTS OF SECTION 504 OF THE REHABILITATION ACT AS AMENDED AND THE AMERICAN WITH DISABILITIES ACT OF 1990 (ADA). A motion was made by Bruce Sutherland and seconded by Kay Beck to pass Resolution 97.8 for Grievance Procedure. All Aye RE: POLICY REGARDING NON-DISCRIMINATION TOPIC:(21,99,RES,97.09,DISCRIMINATION) Resolution 97.9 POLICY REGARDING NON-DISCRIMINATION ON THE BASIS OF DISABILITY. A RESOLUTION OF THE CITY OF REXBURG, IDAHO, ADOPTING A POLICY OF NON-DISCRIMINATION THE BASIS OF DISABILITY. A motion was made by Kay Beck and seconded by Glen Pond to pass Resolution 97.9 regarding Non -Discrimination. All Aye RE: FALL CLEAN UP FOR 1997 TOPIC: (21,99,,, BURNING,D.E.Q.,TREES) The mayor stated that every year we have had a Spring Cleanup and a Fall Cleanup. Last year we got in trouble burning down at the city shop. Spence Larson stated that he had a call from D.E.Q. and she said she was on her way up to investigate and said we would be fined. The fire department told her they would go down and put it right out which she agreed to. Some people in that area had complained. Spence said it is legal to burn tree limbs and that type of thing but the fact that it did smoke the houses up was the problem. Kay suggested that maybe we need to be more selective on what we dump in and burn. Nyle suggested that we rent a big shredder/chipper. The College or Zundel Tree Service might rent one to us for a day or two. Kay said he would talk to Farrell. A motion was made by Glen Pond that we approve the Fall cleanup from September to October 15. Kay suggested that we limit what we pick up. It would be strictly for yard waste that can be burned. We need to eliminate vegetables and pick up only the vines. Seconded by Nyle Fullmer. All Farrell asked what had happened to the compost pile we were going to have out there? The mayor stated that we need to work on that. Marsha made a report about the Planning & Zoning meeting. She asked about a storm drainage system for the future? The mayor stated that it would take a lot of money. Kay suggested that maybe we could fix some of the areae that are the worst. RE: APPREHENDING THE BANK ROBBER TOPIC: (21,100,,, POLICE DEPARTMENT) Nyle Fullmer wanted the council to know about the involvement of the Rexburg Police Department in apprehending the bank robber. There was a tip given to the Bonneville County and they included us in the arrest. Our police went down to the location where he was suppose to be and when he came out, the F.B.I. put the word out to arrest him and officer Lewis, who was driving the car, put Chief Archibald in a position where he was the first man there. The Chief took the robber down and had the handcuffs on him before anyone else got there. The man was 6' 4" and weighed over 300 pounds. Randy Lewis state that what made Chief Archibald shine was we had the disadvantage of distance and Chief Archibald had him down before anyone else got there. Nyle also stated that we need to thank U.P.L. again for the extra patrol bike that they donated to the Police Department. RE: URBAN RENEWAL MEETING ON THE REDEVELOPMENT OF MAIN STREET TOPIC: (21,100,,, URBAN RENEWAL,J.B.'S,MAIN STREET,CURB & GUTTER, SIDEWALK) Mayor Boyle reported on the Urban Renewal meeting. Under the Redevelopment, they went down to J.B.'s property. J.B.a are now thinking about coming in. Main Street is really flat and does not drain very good. Joe is requiring J.B.s to put in a catch basin and a drain that goes into to storm drain on Main Street. J.B.s also requested that they be included for the curb, gutter and sidewalk. Glen said the city would have to come up with around $6600 to put in the catch basin and hook into the storm drain to drain that property correct. Glen stated that what actually would happen is all but the front part of the parking lot at J.B.'s would drain into the Broulims Parking lot and it does pool there. If J.B.'s do decide to do that we would need to contribute the city's share of the curb, gutter and sidewalk like we do on any L.I.D. and then put in that catch basin but the city would have to put in that catch basin. The Urban Renewal Committee recommended that the city do that. We would need to transfer the money over to the Urban Renewal. A motion was made by Glen Pond and seconded by Nyle Fullmer that we include the J.B. property in the Urban Renewal project of the Washington School project and include the catch basin for the drainage. All Aye. RE: 1997 BUDGET PUBLIC HEARING TOPIC: (21,100,0RD,797,BUDGET) 8:00 P. M. Public Hearing for the budget. Richard gave handouts on the budget and explained it in detail. (copy on file) ORDINANCE 797 AN ORDINANCE ENTITLE THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1997, TO SEPTEMBER 30, 1998, AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1998; AND PROVIDING FOR THE EFFECTIVE DATE OF ORDINANCE. A motion was made by councilman Bruce Sutherland and seconded by Nyle Fullmer that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 797. Those voting aye: Bruce Sutherland Nyle Fullmer Marsha Bjornn Glen Pond Farrell Young Kay Beck Those voting nay: None Ordinance 797 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Kay Beck and seconded by Glen Pond that ordinance 797 be passed. Those voting aye: Those voting nay: Kay Beck Farrell Young Glen Pond Bruce Sutherland Nyle Fullmer Marsha Bjornn None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the city council had voted for the passage of said ordinance was duly and regularly passed. Mayor Boyle declared the motion carried. RE: TABERNACLE BEING RENTED OUT FOR COMMERCIAL USE TOPIC: (21,101,,, TABERNACLE,FEES) Farrell told the council that the Tabernacle Management Committee would like a clarification. They have had a couple requests for commercial usage of the tabernacle where people charge and bring in a large group and they make money and they only pay $35 to use the tabernacle. They wanted some guidance as to whether we wanted to have commercial endeavors in the tabernacle? Nyle suggested if we do that we need to revamp it and take a percentage of the gate. The mayor suggested that Farrell come back to the next meeting with a recommendation. If they are raising money, $35 is too cheap. The council agreed.
