A motion was made by Farrell and seconded by Glen to approve the
minutes. All Aye
Introduction of the Boy Scouts.
RE: REQUEST FOR SEWER TO BE PUT TO THE LOT AT 436 W. 2ND N.
TOPIC: (21,94,,, 0SSMAN*ILA GENE,SEWER,2ND N.,TWIN PINES,REXBURG FLORAL)
Ila Gene Ossman of 46897 N. 9100 E. of Rigby. Requesting that the City
of Rexburg put sewer to her mothers lot which is located at 436 West
2nd North located behind Rexburg Floral. After the flood her mother
had made an agreement with the Mayor that if she was to fill the
ditches, septic tank and well, they would put the sewer to the
property. There is no record of this deal that was made between Mrs.
Ossmens mother and the mayor. Mrs. Ossman is in the process of trying
to sell the property. But is unable to because of the expense to put
the sewer services to the property at the cost of $8000 dollars. Has
looked into putting a septic tank in at the cost of approximately
$1500. (discussion) It may be possible that Twin Pines has a 6" line
that they could hook into. Kay mentioned that he could get the plans
for Twin Pines to review that possiblity. Kay suggested that Joe call
Jim Hall at Special Sevices to find out exactly what the situation
would be. The Mayor said that they would check into it and let her know.
RE: APPROVAL OF FINAL PHASE PLOT PLAN AT THE RICKS PALMER SUB -DIVISION
TOPIC: (21,94,,, RICKS*DEAN,RICKS PALMER SUBDIVISION,SUBDIVISION,
FINAL PLOT PLAN)
Dean Ricks brought in the final phase plat for the Ricks Palmer
Subdivision for approval and signatures. (Discussion) Glen moved and
Nyle Seconded to accept the plat as it is. All Aye.
RE: APPROVAL OF THE WILCOX FRESH PACK PLOT PLAN
TOPIC: (21,94,,, WILCOX FRESH PACK,RAILROAD,YELLOWSTONE HWY,
FINAL PLOT PLAN)
John Millar representing Floyd Wilcox and Sone, showed the plot plan
for the Fresh Pack Project. (on file) The consideration was the
connecting road over the railroad was not the best way to spend the
money. Wilcox's is considering to put improvments into the existing
intersection with a traffic light, road widening and turn lanes. This
will improve the intersection conjunction at highway 20 and the Old
Yellowstone highway exchange. Planning and Zoning suggested that it be
a right turn only to get on the road coming out of Wilcox's.
(discussion)
Council felt that they should hold an informational hearing to inform
the public of this idea.
Motion was made by Nyle and seconded by Kay to approve the plot plan.

RE: WATER TANK BRICK CHOICE
TOPIC: (21,95,,, WATER TANK,WATER DEPT.)
John Millar reported on the water tank. He said it is moving along as
'.. planned. The pump station is going as planned also. (discussion) They
need to pick the brick for the exterior of the tank, there will be ten
feet of the water tank that is bricked. Glen moved and Nyle seconded
that the Mayor should make the decision on the color of the brick for
the water tank. All Aye.
RE: FLOOD RELIEF
TOPIC: (21,95,,, FLOOD,FLOOD RELIEF)
Wanice Cowles from the Bureau of Disaster Relief. They are concerned
that the public is not getting the word on the public assistance for
the flood relief. They have only recieved 7 applications for the
assistance. They would like some suggestions on the way that they can
make sure that everyone who need the assistance, applies for the
assistance.
RE: TENTATIVE BUDGET APPROVAL FOR 1998
TOPIC: (21,95,,, BUDGET,POLICE DEPARTMENT)
Richard presented the tentative budget and other related items. (on
file) There is an adverised public hearing for 6:00 P.M. on September
3, 1997 on the Budget. There was a concern on the police departments
budget. (discussion) To make the budget balance Richard pulled $10,000
from the so called savings to balance the general fund.
Nyle moved and seconded by Marsha that the tentative budget be approved
to go to public hearing.
RE: ORDINANCE 797 TO INCREASE CITY COUNCIL SALARY DENIED
TOPIC: (21,95,,, CITY COUNCIL,COUNCIL MEMBERS,RAISE,BUDGET)
Mayor read the ordinances concerning the pay increase for the
councilmembers. The members of the council and the mayor have not had
an increase in pay for the last 8 years. Nyle moved Marsha seconded to
discuss the increase. Richard was asked to do some research and look
into the wages in different counties in the state, and in cities
comparable in size to Rexburg, we are the second lowest in the state.
ORDINANCE NO. 797
AN ORDINANCE AMENDING SECTION I OF ORDINANCE 694 INCREASING THE SALARY
OF THE COUNCILMEMBERS OF THE CITY OF REXBURG, TO COMMENCE JANUARY 1,
1998.
A motion was made by Coucilman Nyle Fullmer and seconded Glen Pond that
the rules requiring an ordinance of a general and permanent nature to
be read three occasions be dispensed with and that said ordinance be
numbered 797.

Ordinance 797 was then placed before the council. The mayor then
called for the voting for final passage of the Ordinance, and the
motion was made by Glen Pond and seconded by Kay Beck to not pass the
Ordinance for a pay increase for the City Councilmembers.

The mayor asked, that the ordinance 798 to increase the Mayors salary
not be passed he felt that it was not necessary for him. (discussion)
RE: ORDINANCE 798 PASSING AN INCREASE IN MAYORS SALARY

ORDINANCE NO. 798
AN ORDINANCE AMENDING SECTION I OF ORDINANCE NO 694 INCREASING THE
SALARY OF THE MAYOR OF THE CITY OF REXBURG, TO COMMENCE JANUARY 1, 1998.
A motion was made by Nyle Fullmer and seconded by Glen Pond to suspend
the rules requiring an ordinance of a general and permanent nature to
be read three occasions be dispensed with and that said ordinance be
numbered 798. Nyle moved to suppend the rule Glen seconded the motion.

Ordinance 798 was then place before the council. The mayor then called
for the voting for final passage of the Ordinance, and the motion was
made by Nyle and seconded by Marsha.

The council discussed putting an hour amount on the mayor position they
decided that they wouldn't be able to do that.
RE: CLAIR BOYLE TO HEAD CITIZEN COMMITTEE TO BEAUTIFY CITY ENTRANCES
TOPIC: (21,96,,, CITY ENTRANCES,PLOT PLAN,RICKS COLLEGE)
Marsha informed the council that Clair Boyle had been put on the
citizens committee to help to beautify the city entrances, he took
Glade Merrills place. Mr. Merrill felt that he couldn't do it any more.
Mr. Wiatt at the college has been making the designs. The first thing
that they need to do was to get a plot plan and then put water to the
lot. The council felt that Clair was to busy to donate time to the
committee. (discussion)
Marsha then handed out information about a swimming area in Mose Lake.
Mose Lake has approximately the same population as Rexburg. There are
various studies included.
RE: CART BUS DONATIONS
TOPIC: (21,96,,, CART BUS,BUDGET,COUNTY)
Cart Bus requested money from the city earlier this year. Fremont
County donated to them. Madison County also donated $2300.00 to them.
If Cart comes back and requests money from us then maybe we can donate
some to them.
Glen moved to pay the bills Nyle seconded. All Aye.

RE: HACK FLOW DEVICE INSPECTION CLARIFICATION
TOPIC: (21,97,,, BACK FLOW,LANDSCAPING,WATER DEPT.)
Delynn is not clear on the inspection & testing of the back flow
devices. (discussion) The council decided that the commercial
landscaping back flow devices would not have to be tested yearly.
