A motion was made by Bruce Sutherland and seconded by Glen Pond to
approve the minutes.
RE: PAM SMITH ON A DELINQUENT WATER BILL
TOPIC: (21,91,,, SMITH*PAM,WATER BILL)
Pam Smith attended the meeting. The mayor explained, her water is
about to be turned off and she stated that three or four months ago
she had come in and put $35 in cash in the drop box but the records
don't show that she paid. Pam told the council she had all of her five
kids with her and she put her money in cash sealed and addressed to the
City of Rexburg and she tapped on the window because it was cash and
Valeea turned around and waved at her and Pam told her through the
window "Cash" and showed her the envelope and Valeea said okay and now
there is no record. Valeea says she does not take the money out of the
drop box but she remembers Pam tapping on the window. She had never
tapped on the window to say high to Valeea before and had always paid
her bill before. She is just $35 delinquent. Kay reminded her that is
not a good practice to put cash in the drop box. A motion was made by
Kay Beck that the city go ahead and forgive the amount of the $35 and
write it off. Seconded by Bruce Sutherland. All Aye
RE: APROVED VARIANCE FOR THE BASEMENT AT WILCOX FRESH PACK

The mayor referred to a letter from the Uniform Building Code Appeals
Board which had been put in all the councilman's folder. One part of
the building out at Wilcox's new project would have to qualify as a
basement because it is 8 foot below the other ground floor even though
it isn't a basement. If it is a basement you have to have all the
accesses out of the basement and you have to have a sprinkling system.
Joe took it to the Appeals Board and their recommendation is because of
the trucks going into a basement and the moisture that we grant a
variance and call it just another floor. (copy of letter on file) A
motion was made by Glen Pond to take the Appeals Board's recommendation
and grant the variance. Seconded by Kay Beck, All Aye.
RE: L.I.D. 30
TOPIC: (21,91,,,TREES,SEWER,SIDEWALKS,LANDSCAPING)
L.I.D. 30- Val Christenson explained that at the last meeting we had
questions that come up about trees and he handed out some options (on
file). Option 83 is moving the sewer line into the street which would
be an additional cost of about $83,000. Another option putting it
under the sidewalk would be an additional cost of about $54,000. There
is another option from H 5 K Contractors that they have the ability to
do pipe bursting. They are doing their first project down to Idaho
Falls this Friday and don't want to give any price until after they do
that project because they are not sure how much it will cost to do it.
Val has estimated it at about $10,000 which might be high. He
explained the process. They go inside the pipe and mechanically expand
and break it and put a new pipe inside. You can do it in place.
(discussion) The mayor stated he had several calls and two letters from
(1) Eileen G. Peck and (2) Steve Grover who feel the trees need to be
saved. (copies on file) A motion was made by Bruce Sutherland that we
go with the Pipe Bursting option number if the cost is $10,000 or
less. Seconded by Farrell Young. All Aye
The mayor told the council that he had three letters this week
commending the police department for their good work. One from the St
Anthony Police Department for help our department had given them, one
from Anneta and Janeal Brower for helping find their daughter on July
4, and one from Kathy Sakollette for the help given by Officer. Allen
and Officer Larson for the support and help at the Dog Show. (on file)
The council agreed that they were doing a good job.
RE: APPROVED ORDINANCE 796 L.I.D. 30

SEWER)
ORDINANCE 796 LOCAL IMPROVEMENT DISTRICT NO. 30 AN ORDINANCE
ESTABLISHING THAT CERTAIN SIDEWALKS, CURBS, GUTTERS, STREETS, SANITARY
SEWERS AND OTHER PUBLIC UTILITY WORKS WITHIN THE CORPORATE LIMITS OF
SAID CITY SHALL BE REMOVED, RE -GRADED, PREPARED, CONSTRUCTED AND
RE -CONSTRUCTED, AND OTHER WORK INCIDENTAL TO ALL OF THE FOREGOING
IMPROVEMENTS IN THE DESIGNATED AREAS SHALL BE ACCOMPLISHED; CREATING
LOCAL IMPROVEMENT DISTRICT NO. 30 FOR THE PURPOSE OF MAKING SAID
IMPROVEMENTS TO DEFRAY THE COST AND EXPENSES OF SAID DISTRICT AND THE
COST AND EXPENSE OF SAID IMPROVEMENTS BY THE LEVY OF AN ASSESSMENT
AGAINST THE ABUTTING, ADJOINING AND ADJACENT LOTS AND LANDS ALONG OR
UPON WHICH SUCH IMPROVEMENTS ARE TO BE MADE AND UPON LOTS AND LANDS
BENEFITTED BY SUCH IMPROVEMENTS AND INCLUDED IN THE DISTRICT TO BE
CREATED ACCORDING TO A FRONT FOOT METHOD OR IN PROPORTION TO THE
BENEFITS DERIDED TO SUCH PROPERTY BY SAID IMPROVEMENTS, OR A
COMBINATION TiEREOF, SUBJECT TO ANY VARIATIONS THEREFROM TO BE
DETERMINED BY THE COUNCIL, EXCEPT THAT THE COST AND EXPENSES OF ALL
SUCH IMPROVEt.ENTS WITHIN STREET INTERSECTIONS AND ALLEY INTERSECTIONS
SHALL BE PAID FROM THE GENERAL FUNDS OR GRANTS OF THE CITY; GIVING THE
KIND AND CHArACTER OF SAID IMPROVEMENTS AND THE ESTIMATED TOTAL COST
THEREOF; AND PROVIDING FOR GIVING OF NOTICE THEREOF.
A motion was made by councilman Glen Pond and seconded by Bruce
Sutherland that the rules requiring and ordinance of a general and
permanent nature to be read on three occasions be dispensed with and
that said ordinance be numbered 796.

Ordinance 796 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Glen Pond and seconded by Farrell Young that
ordinance 796 be passed.

The roll s(iowed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the City Council had
voted for k.he passage of said ordinance was duly and regularly passed.

RE: APPROVED ORDINANCE 795 FOR ANNEXATION OF WILCOX FRESH PACK
TOPIC: (21,93,ORD,795,WILCOX FRESH PACK,ANNEXATION)
ORDINANCE NO. 795 Annexing the Wilcox Property next to the South
Interchange on the south side of the road.
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO;
DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG,
IDAHO: AND AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG,
IDAHO, AND THE MADISON COUNTY-REXBURG COMPREHENSIVE PLAN 2000 TO SHOW
ANNEXATION AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING
ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE. Parcel 1: would be zoned Highway
Business District (HBD). PARCEL 2: INDUSTRIAL District (I).
A motion was made by councilman Bruce Sutherland an seconded by Kay
Beck that the rules requiring an ordinance of a general and permanent
nature to be read on three occasions be dispensed with and that said
ordinance be number 795.

Ordinance 795 was then placed before the council. The mayor then

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the city council had
voted for the passage of said ordinance was duly and regularly passed.
Mayor Boyle declared the motion carried.
The mayor told the council that Kip Orme of the Water Department has
passed his Certified Operator Class 2 on Distribution for the Water
Department. He wanted to congratulate Kip on improving to do his job
better and this will qualify him for a 4% raise in his salary.
The mayor reminded the council that we will have a budget work meeting
next Tuesday night.
A motion was made by Bruce Sutherland and seconded by Kay Beck to pay
the bills. All Aye
After iiscussion on the council meeting time. A motion was made by
Glen Pond that we change the council meeting time from 7:00 P. M. back
to 7:70 P. M. Seconded by Bruce Sutherland all voting aye.
A mot Lon was made by Glen Pond to go into an executive session for a
legal issue. Seconded by Bruce Sutherland. All Aye
Meet:,ng reconvened after executive session and a motion was made by
Glen. Pond and seconded by Bruce Sutherland to adjourn. All Aye
