RE: AWARDING BIDS FOR IST WEST AND IST NORTH
TOPIC: (21,85,,, BROULIMS,IST NORTH,IST WEST,BIDS,EDSTROM CONST,
URBAN RENEWAL AGENCY,SEWER,STORM DRAINAGE)
Award bids for 1st West and 1st North. Joe handed out sheets
explaining thy, bids. (copy on file) He explained the bids. Edstrom
Construction was the low bidder. This project is shown to be completed
by October 15 of this year. Special provisions 4 through 11 are things
we need to decide if want them of which we have 30 days to make up our
minds whether we want them or not. They had a meeting this afternoon
with the developer and the Urban Renewal Agency to try to resolve the
amount of do:lars available. They would like the contract approved
with the stiyulation that special provision items 4 through 11 not be
approved unt::.l we can finalize the funding sometime within 30 days. A
motion was m....de by Glen Pond that we accept the low bid Edstrom
Construction with the items 4 through 11 be contingent upon future cost

RE: MERRILL RUDD'S TREES
TOPIC: (21,85,,, RUDD*MERRILL,U.S. WEST PEDESTAL,SIDEWALK)
Stephen exlained he had talked to the family and they were going to
trim Merri:_1 Rudd's trees. He has four trees over the sidewalk and
into the e;.reet. The mayor stated that just east of the trees there is
a U.S. WeEZ pedestal right in the sidewalk. He wondered about getting
them to move it. (discussion)

RE: CREME MC CULLOCH QUESTIONS ABOUT LID 30
TOPIC: 121,85 ... MC CULLOCH*ORENE,LID 30,3RD EAST,FLOODING,

Orene Mc Culloch was at the meeting with some questions about L.I.D.
30. She i.:sked how much they were going to take off the sides of the
street? She would like to see that she doesn't get flooded anymoreand
that the road is graded so she didn't get all the water from the east
side doei!n't run into their yard. The mayor explained when there is a
bad rain storm the water does run down 3rd East and run across to the
other si,:e of the road and into Orene's basement. Val explained the
grade an, curb height being higher on one side than the other and what

they were planning on doing with the street. (discussion on drainage
and flooding)
Val explained to Mrs Morton the assessment. (on file) He explained
that the residents would be out of their driveways a few days while
they put the concrete in, but they will do it as fast as they can.
RE: SEWER LINE ON 3RD EAST AND HARVARD
TOPIC: (21,86,,, SEWER,3RD EAST,TREES,CURB AND GUTTER,
Joe explained we are replacing the sewer line all the way through on
both 3rd East and Harvard. The televising of it shows that it is the
old clay type pipe and is very badly shattered. Val explained'. the
location of the existing sewer line.
The mayor explained on 3rd East we have some beautiful, valuable trees
according to Jim Long. Those trees are right over the sewer line. He
suggested that we put the sewer line under the curb and gutter and
abandon the old line and replace about 7 feet to each property under
the curb and gutter. In order to get the forms in they will have to
take up a small area along the edge of the street. There would be extra
cost on the extra service line connection probably $50 to $100 per
property. Discussion on type of pipe. Joe stated that one problem of
putting it under the curb and gutter is the manhole lids. We may have
to do some swinging in and out so the manhole lids don't end up in the
gutter line where storm drainage gets into the sanitary sewer', system.
There would be a little bit of a problem there but we might be able to
off set it enough that we can keep the lids of the sewer back': behind
the curb. The mayor stated to save five or six trees, it might cost
$100,000 more if you have to tear up the street. If there is a cost
effective way to save the trees the mayor was in favor of it.'. It would
not be a problem to have trees over the new lines. Val stated that one
thing about putting the cone along the curb, we will still have to out
a substantial part of the roots along the one edge. The way we had
planned was to locate the line in the same location and that would
necessitate the trees being taken out. Val stated that you need to
either be o., one side or the other of the curb because of the manhole.
The manholea are $2000 each.
A motion wail made by Glen Pond and seconded by Farrell Young to pay the

RE: PUBLIC HEARING TO AMEND THE COMPREHENSIVE PLAN
TOPIC: (21,86,,, H.B.D.,WILCOX FRESH PACK,CITY ENTRANCES,EASEMENT,
ANNEXATION AGREEMENT,TRAFFIC,COMPREHENSIVE PLAN,ZONE CHANGE)
Public Hea>:ing to amend the Comprehensive Plan pertaining Parcel 1 and
Parcel 2 aid described in Notice of Public Hearing. (on file) :The
amendment is proposing to change Parcel 2 to Industrial Use and Parcel
1 to reflect Highway Business District. This would also be to decide if
the property for the Wilcox Processing Business be annexed to the city
as amended on the Comprehensive Plan.
Jim Long- ','here is a meeting tonight for a group of people that want to
beautify t,!ie entrances to the city. If there is any way possible to
tie in the annexation agreement and change the zoning to a marriage of
the off ra,.lp that belongs to the state and to this piece of property,
he would 1-ke the Planning & Zoning to correlate that.
The mayor iatated that we had some letters requesting a wider easement
through there and somethings that could be done with the traffic. We
could proh.libly tie in something like Jim is talking about with the
others. '"(Zis could be done in an annexation agreement the same as they
have diecuNsed with a buffer to shield the highway traffic. Stephen
stated the Wilcox are aware that the annexation will be subject to
either an iinnexation agreement or a development agreement. They have
discussed most of the conditions raised by the Planning & Zoning. His
recommendation would be that the annexation be conditioned upon a

successful annexation agreement be reached between the city and
Wilcox. Kay Beck declared a conflict of interest.
A motion was made by Nyle Fullmer to amend the Comprehensive Plan to
reflect the changes to H.B.D. and Industrial as set forth in the
Notice. Seconded by Marsha Bjornn. Kay Beck abstained. All others
voting aye.
A motion was made by Marsha that we accept annexation of the property
as proposed by Wilcox and Sons. Seconded by Nyle Fullmer. Kay, Beck
abstained. All others voting aye. '..
RE: REXBURG LID 30
TOPIC: (21,87 ... LID 30,SIDEWALK,CURBS AND GUTTERS,STREETS,SEWERS,
3RD EAST,HARVARD,5TH SOUTH,TREE COMMISSION,STORM DRAINS,PARKING)
Public Hearing to establish Rexburg L.I.D. No. 30 to cause certain
sidewalks, curbs, gutters, streets, sanitary sewers and other public
utility works within the corporate limits of the city be removed,
re -graded, prepared, constructed and re -constructed, and other work
incidental to all of the foregoing improvements in the designated areas
on 3rd East, Harvard, and 5th South to be accomplished.
Val handed out a spread sheet on costs of the L.I.D. (on file), He
explained the hand out. He explained if the contractor does any damage
to the property, it will be his responsibility to repair it. It could
be on a 15 year loan through the city L.I.D. and the costs are
estimated at 6%. He explained that there are also sewer stubs and
water stubs because if we are going to put a new street in we would
like to have these services already run to the property so we don't
have to come back in and dig up the street when someone is ready to
hook up.
Lorin Widdison- The sewer line that is in there now connecting onto the
city's main sewer line was put in last fall and he wondered if that had
to be put in again. Val explained service lines going to the new main
line would have a new service connect and the large portion of the
charge is just the new connect.
Val explained the street reconstruction.
Brent Barker- Q,aestions on the spread sheet charge on driveways, those
that don't have driveways still have the $220 charge? Val explained.
Another question if there is a 4 foot sidewalk now which would mean it
would shorten the parking strip if you go to a 5 foot sidewalk. Val
told him if you have a 4 foot sidewalk they will replace it with a 4
foot sidewalk. He said some of the sidewalks don't need to be
replaced. Val ;paid we would negotiate on the degree of sidewalk.
Alan Miller- What is the target day for completion? Val told him
probably one month. The way they are going to write the contract, in
order to get gi;od bids, is to give them until spring to complete it but
yet have a timidly completion on anything they start. He would like to
get everything he can get done in the fall but yet give time that they
can finish up an it into next May.
Steve Grover- lie has a couple of nice trees in front and would like to
save them. Vat explained we have been looking into alternatives.
Right now the •:osts on the spread sheet are for replacing the sewer
line right whe.Fe it is now. The main problems we are looking at is not
tearing up the street so it would be quite a bit extra cost to take out
the street. §;here we are looking at taking out the curb and gutter we
thought we could possibly put it there. His concern is the trees are
not that far from the curb and gutter and you would still be cutting
all the roots iiLong that side and that is the way the wind blows and
you would weaker the support of the tree and you might loose them
anyway. You would also have manhole lids in the curb. It would be a
greater cost and it would be up to the council if they want to incur
that cost. It would cost about $5000 to do one jog in and out for a
tree, explaining.
The mayor felt to save the trees it needs to be cost effective.
Discussion on what was done on 2nd East.
Jim Long -Discussed replacing a large tree with a small tree. They have
tried to get a tree commission organized. Mayor Boyle has finally got
the tree commission organized and he is on the commission. For a few
years there has been a tree commission in Rexburg. Some of the things
they have been asked to do are to make an inventory of all the trees in
the city and they did that and made some recommendations. They
recommended that the historical trees should stay forever. One of the
reasons was we were applying for grants. With those grant the council
committed to carry out the recommendations. If we do away with the
trees without really doing some studies, we are in violation of our
moral commitment. He explained that he is on Forest Planning for
Targhee National Forest and he explained what they do with
alternatives. He discussed the issue.
Kay stated that we do care about the trees. The money we are spending
on this is the city portion of the project and that is what the council
is concerned about because that money does belong to the tax payers.
Don Sparhawk- He is concerned about the trees. They have two large
ones in the front of their home. Someone years ago had the foresight
to plant those trees. He agreed with Jim our trees belong to the
community. It would benefit the city to really study this closely and
put the sewer line so they could save the trees. This would encourage
planting of more trees along the street. Is there anyway to put the
pipe through without moving the trees. Val explained.
Clyde Luke- He had spoke to Joe and Val representing the home owners on
the 300 block of Harvard. He had given the council a petition with a
cover letter. They are requesting that the sidewalk be a four foot
sidewalk at the curb rather than back in the yard. That is their
concern but they are in support of the project. Val stated that is the
way he did the designed it because all the people along that street
wanted it that way. There is a lot of mature landscaping on that block
and it would be easier to blend it in if the sidewalk is along the curb.
Jim Lofthouse- His concern is the block above them between 4th and 5th
South has teen recently done and it is like a freeway. There is a lot
of traffic down that street going 40, 50, 60 miles per hour and all of
a sudden ii; narrows into a narrow street by the apartments. There will
be a fatality. Could some consideration be made to put somekind of
speed control dip or something along there to hold it down to a
reasonable speed. The speed is worse when students are here. The
mayor told him we have purchased a traffic counter that tells how many
cars and how fast they are going. We will put it up there and monitor
the traffic.
Steve Grover- He felt they should look a little closer when deciding
what to do about the old road that is built up too high if they are
considering jacking up one side. Val told him they have a complete
survey anti he explained the problem. Some people are concerned about
flooding iso they will have to address that.
Alan Millsr- He understood that 3rd East was going to be widened is
that correct? The mayor told him they had never contemplated widening
3rd East. Val told them we are going to try to straighten Harvard out.
Beth Reese Skelton- She questioned the figures on the sidewalk and the
width and asked if it will be changed? She also asked about the city
participai:ion? Val explained. He also told her these costs are the
engineering estimate. Beth also questioned the construction time? Val
told her they will only start what they can finish, but the way we are
doing it will get us a better price. They will finish the street they
start but possible will not be able to start another block. They will
not tear tip a street unless they can finish it. She again requested
that the one way parking be on the street going down hill instead of
the other side.
Peggy Day- The trees are not only beautiful but they purify the air.
They have two big maple trees. If they take out those trees it will

damage their front yard. Who will be responsible of replacing the
damage? The mayor told her it would be done by the contractor as part
of the contract.
Clyde Luke- Will the excavation be larger than the 4' sidewalk and also
will they have to dig up some of the lawn because of the rise going up
a little steep from the curb, so possibly when the sidewalk is put in
there could be 4" to a foot of lawn higher. Will that be up to the
property owner to fill that in and blend it in? This will be in the
contract that they will graduate it back to a slope. If the people talk
to Val so he is aware of it he will write it into the bid.
Jim Long- You have a surface drain on West side of 3rd East and 1st
South. On the east side it goes under ground. When they did the storm
drain, it is so if you go across it you drag bottom with the car. He
asked if that could be corrected? Joe told him they are planning on
fixing up the intersections. Where drains are bad we will be putting
in new ones and then they would take asphalt out for about 10 feet
behind cross drain and feather it back in so it fit the new cross
drain. There will be a hump there but not another hump on the other
side of the drain.
Richard Western- They have begun some excavation on the west side of
his home. He had concern and support on having the sidewalk go all the
way to the curb. Who will be responsible to repair that that has been
done? The city is doing the handicapped access under L.I.D. 29. They
will match up the sidewalk with the curb.
Bob Michels- He does not live in this area but he is chairman of the
tree committee. Since moving to Rexburg he has noticed there isn't
much old growth. Most of it is on the hill. He would like to see the
city use the alternative of putting the sewer line in the curb and
gutter and saving the trees, even if you are going to cut the roots on
one side. If you had a professional come in and check one tree, you
would find you would not be destroying the tree. It would be worth
your time.
Nile said tie city will look at it and get estimates.
Brent Barks..- He sees a big issue is parking. We need to look at a
safer way tD park because of the children in the neighborhood. He asked
if some of :he sewer construction reconnect charge could be barn by
someone else other than the property owners? Val explained that their
cost is jus,: the service line. It is the replacement of a deteriorated
line.
Brent Moss- He asked if he wanted to reconnect to the line clear out if
it could be done at the sametime and put it in on an increased bid.
Stephen toll him it could not be done on the participation bases but it
could be dcie on the L.I.D. loan at the contract rate. You could also
redo your v-iole driveway this way. Contact Val to let him know.
Warren Porter- He is in favor of the sewer line replacement. He has
had sewer k;ackup in his basement. The line is in bad shape.
Sylvan Butler- He would like to see the trees protected, they have
trees on Hirvard too. He would like to see a sketch of where the trees
would be l.icated when Harvard is done. Val stated that there will be
no trees relocated.
Richard Weston- Had a question on sewer service? Val explained it is
to replace sewer service lines back to the right -a -way.
Clyde Luke-- Is there anyway we can see where our service line is
running to see if we want to replace it back to the house? Val told
him at the time they dig you can see if it needs to be replaced and we
will work it out. That would be at your cost with the contractor.
Sylvan Butler- If our sewer line has been replaced in the last few
years do wo have to replace it again? Val told him if there is a line
we have li;;ted now that doesn't need to be replaced, these are not
concrete f:-gures. There will still be a connection cost which is the

main portion of the figures. You won't have to pay for any line that
does not need to be replaced. Sylvan stated new line went from 2nd
South up a few years ago.
Beth Skelton- Are you going to keep the same angle that we have now?
Val told her yes.
Jim Lofthouse- On Harvard between 3rd and 4th South the manholes raise
up in the winter, is there a solution? The road raises, they will try
to control it with putting in a better base.
The mayor closed the hearing.
The council felt that we need to wait until the next meeting to pass
the ordinance to get more figures and estimates. The next meeting will
be on August 6. You can still give more written comments to Val or the
city clerk.
The mayor reported on the refinishing of the benches at the
tabernacle. They have put in a lot of hours and work and done a good
job.
