State of Idaho) County of Madison( Be City of Rexburg) Present were: Mayor: Nile L Boyle Councilmembers: Kay Beck Farrell Young Glen Pond Bruce Sutherland Nyle Fullmer Excused: Marsha Bjornn City Clerk: Rose Bagley Finance Officer: Richard Horner Assistant Engineer: Val Christensen Pledge to the flag. A motion was made by Glen Pond and seconded by Farrell Young to approve the minutes. All Aye RE: CART BUS TOPIC: (21,51,,, CART BUS,BUDGET) Mr Thorp, representing Cart Bus, was at the council meeting to request some funding. The system that operates out of Rexburg, operates in Rexburg, Madison County, the lower half of Fremont County, and St Anthony. They are asking help with their budget with approximately $10,000. They are $30,000 short in the budget coming up starting October 1. They are asking for this area to help with $10,000. The rest will come from the Teton County and the Lemhi County area. The reason is they have received reductions in their federal grants. The reduction originally was $100,000 and they have been successful in making up all but $30,000. If they don't get this additional funding they will have to take one vehicle out of each area and that will probably be the backup vehicle. He told the council that Rexburg has 57% of the boardings. The council told him to get some paper work to Richard prior to the city working on the budget in July. RE: ROAD ABANDONMENT BY THE LIVE STOCK AUCTION APPROVED TOPIC: (21,51,,, ROAD ABANDONMENT,LIVE STOCK AUCTION,VETERINARIAN CLINIC) Discussion on setting a hearing for the closure of the road by the Stockyards. It was discussed with County Commissioner, Brooke Passey, if there should be two hearings one for the county and one for the city or have one hearing combined. It was decided to have separate hearings. The hearing was set for the meeting which will be held June 3 at 7:00 A.M. RE: WILCOX FRESH PACK TOPIC: (21,51,,, WILCOX*LYNN,POTATO FRESH PACK,PUBLIC HEARING) A Public Hearing for the Wilcox Potato Fresh Pack will be set for June 21 at 7:30 P. M. RE: REPAIRS TO 3RD EAST & HARVARD TOPIC: (21,51,,, 3RD EAST,HARVARD,STREET PROJECT) The council had previously talked about doing the streets on 3rd East and Harvard, which are in bad shape. We need to do curb and gutter and redo the streets. We wasn't sure we would have enough money in the budget to do both of them because of the amount of money spent on the streets. They have now reviewed the six month budget and it looks like the city can squeeze the money to do both of them this year. It will take the rest of the street budget to do those two projects. Beth Reese Skelton was at the meeting and stated it really needed to be done on Harvard.Don Sparhawk was also at the meeting and asked if they were talking about widening the street. The mayor told him they would not widen the street but would put in new curb, gutter and sidewalk. They are doing water and sewer projects on those streets so a new street will be put in. Val gave a handout to the council for an L.I.D on this project and explained. (on file) Beth asked about enforcing the parking on one side of the street on Harvard and if the parking could be changed so you park coming down the hill? Discussion on taking out landscaping. It would only be taken out if needed. A motion was made by Glen Pond that we proceed and schedule a Public Hearing for June 18. Seconded by Nyle Fullmer. We will pass a resolution at the next meeting. RE: BIKE PATH GRANT TOPIC: (21,52,,, BIKE PATH,SIDEWALKS,LANDSCAPING) The mayor told the council that Dave Payne had applied for a Grant for a Bike Path for $127,000, which we were granted. It will run from the Nature Park over and down 5th West, out West Main, around the road to the Stake Center, down 7th South, and tie into the Ricks College arboretum. The way he has it worked, is the the county and city will donate gravel and work, to match the grant. Parts in town will be impacted, especially past the mayor's house, with widening of the sidewalks to ten feet. The sidewalk that is there now is a five foot wide sidewalk on Main Street. There will be a lot of sprinkling systems and landscaping that will have to be moved. We will need to send out a legal hearing and get some input. He asked the council to think about it. (discussion) We need to start on the project by July 1 and finish by June 30, 1998. We will need to move rapidly to complete it in one year. Glen Pond asked when the sidewalk is widened, will the property owners be responsible to maintain that large of a sidewalk? Stephen stated that the most you would be able to have them maintain is proportional amount the size of the other sidewalks in the city, for the amount that their property benefits. RE: FENCES TOPIC: (21,52,,, FENCES,SIDEWALKS,WOOD*DAVID) L.I.D. on sidewalks. David Wood has a sidewalk that wasn't finished very good. It has a rough surface. P&Z have recommended that we not accept it and that it be torn out and replaced. There is also a problem with the fence. He built a nice fence. When he bought his lot he also bought the lot behind him so it runs out on to Nez Pierce. His back yard is someone else's front yard, he put a fence up but it could only be three feet tall but his dog jumps over the fence and the neighbors get mad. He then put some wire around it to keep his dog in. It is illegal to have higher than a three feet fence. Rusty Townsend bought two lots and put up a fence that is six feet high, which is in violation of our city ordinance. David says if his fence comes down, Rusty's needs to come down. (discussion) Stephen said the primary purpose of height restrictions on fences is the visibility for traffic. The mayor asked the council to look around and make a decision. Dr Lester Peterson has also put a fence in that is not in compliance and it was put in after the ordinance. The council needs to look at that fence as well. RE: L.I.D. 29 TOPIC: (21,52,,, L.I.D. 29,SIDEWALKS) L.I.D. 29 for Sidewalks. Val discussed it. There have been three protests to the L.I.D. David Wood expressed concern. He had tried to find an alternative to taking out the sidewalk and putting in a new one. He planned on doing that as soon as the weather is good. He discussed costs had gone up. He asked to be given an opportunity to improve the sidewalk, if it does not work he will make the sidewalk right and replace it. Stephen told him the city has adopted new specifications that all sidewalks have to comply with that has caused the price of sidewalks in Rexburg to go up. In order to be built to specifications they will require a better substructure to go under them. David said if he was given a chance to improve his sidewalk he would guarantee it for three or four years. Stephen suggested that when the sidewalk is completed it needs to be acceptable with the engineering department or he would need to replace it to specifications. Stephen said he would strike an agreement with Dave on the sidewalk completion time table.(discussion) A motion was made by Nyle Fullmer to file the L.I.D. assessment roll with the county with the exception of David Wood and give him a chance to improve his sidewalk. Seconded by Kay Beck. All Aye. Stephen told the council, after approving the assessment notice and it is delivered to the clerk we now have to set another Public Hearing to hear any objections to the assessment roll by the property owners. We will set that hearing for June 18. The mayor said he would like a way to encourage people to just put in the sidewalk when a new house goes in or when the property sells. Val explained that the difference in the cost is the bonding and inspection costs. Introduction of the scouts. RE: RECREATION DISTRICT RECOMMENDED NAMES FOR COMMISSIONERS TOPIC: (21,53,,, RECREATION DISTRICT,COMMISSIONERS) Discussion on the Recreation District. Stephen explained that there needs to be a meeting with County and the City to recommend names for appointing three commissioners for the District. RE: BACK FLOW DEVICES TOPIC: (21,53,,, BACK FLOW DEVICES,VACUUM BREAKERS,SPINKLERS, WATER DEPARTMENT) Kay asked about the inspection of the Back Flow device and Vacuum Breaker for sprinklers. He checked the minutes and it did not say there would be an annual inspection. The Water Department had sent out letters. The mayor said he would talk to DeLynn and get it cleared up. Nyle Fullmer told the council that Chief Archibald had now reached his one year probation and he wanted to tell the council he had done a good job. RE: BIKE PATROL TOPIC: (21,53,,, BIKE PATROL,POLICE DEPT.) Glen asked if the bike patrol was up and operating? Stephen reported two officers have returned from training at Boise . Ricks College have loaned the two bikes to train on until Richard appropriates the money to purchase the bikes. Glen stated that we have already approved the money. Nyle told the council that the Police Auction will be Friday at 6:30 P.M. The mayor stated that we need to have a Personnel Committee meeting following this meeting.
