A motion was made by Bruce Sutherland and seconded by Farrell Young to

RE: BLOCK GRANT FOR WATER PROJECT AND 7TH SOUTH
TOPIC: (21,34,,, 7TH SOUTH,WATER PROJECT,BLOCK GRANTS,EASEMENTS,
7TH SOUTH)
Ted Hendricks, E.C.I.P.D.A. was at the meeting to discuss the Public
Facility Grant application which is in right now and the full
application is due March 7. He had been working with the mayor and
Stephen about legal issues as far as submitting the application and so
forth. One of the issues the council needs to discuss and decide upon
is the creation of the L.I.D. on 7th South. With the understanding
from the state the Block Grant proceeds would go to pay off the
assessments of the the low to modern income households. There are
probably about three and there wouldn't be a tremendous amount of
benefit. The L.I.D. may be in question whether we will even proceed
with it. If we proceed with it and there is a protest like there was
last year and it stops then that would jeopardize our application with
the state for the other portion of the project which is the water.
Given the circumstances the council needs to consider either going to
those seven households that are affected by the L.I.D. or the seven
property owners to determine if they will support it or not. I£ they
will not support it there is no sense proceeding ahead with the Block
Grant portion of that proposed project. We would be better taking the
street project out before the application is due. The mayor indicated
that he would be willing to go talk to those individual property
owners, possibly with Stephen. If they find out the majority of those
property owners would be opposed to it, then there would probably be no
reason to proceed with the L.I.D. unless the council feel so strong
about it that they would do it anyway and even if the opposition came
in, the worst that could happen is it would require the council to
postpone 180 days and the council could still enact the L.I.D. even
with opposition, if not we need to take it out of the application and
just go with the water project. We would just keep in the $350,000 for
the water.
Stephen stated there are ten total parcel owners on that road, there are
those whom are exempt from the L.I.D., the county, school district,
city, and the armory. If four of five of them object, we would have to
go for the 180 days and based on last year, five of the seven
objected.
Bruce Sutherland stated that he was not willing to push for it, in the
light that most of our money is going to build the road through Ricks
College for Ricks College and making the people on the end go with an
L.I.D. to pay for it.
Stephen reported that he had met with the property owners north of the
city who control the majority of the property where we need an easement
for the water line and they are prepared to give an easement if the
city will agrees to give, during the installation of the water line,
put in some "Tees" that would service their properties for two
individuals and then the family. All of them see the wisdom of having a
water line through their property and would grant us that easement at
no cost. The hookups were not brought up. There would be
approximately six tees they have requested. Joe felt it would be a
good idea. Ted stated that the water project is a good project and
will stand alone without the street. Water & Sewer projects just rate
higher. Glen stressed that we have really got low water pressure in
the N.E. side of the city. Ted told them we specified in the
application $350,000 for the water and $150,000 for the street.
Ted told the council the city does have to procure for professional
services. He would like permission to go ahead and help the city
prepare those documents to procure for professional services. The
council told him to go ahead.
RE: DUMPSTER PROBLEMS

Glen discussed a problem with dumpster in the alley adjacent to the
City Hall. People are filling them with old mattresses and
unacceptable items and they can't get the dumpsters emptied. He
finally had to take out a mattress to get the U.P.L. dumpster emptied.
(discussion) Glen said they could not find any evidence of who had
dumped in the dumpsters. Stephen asked if they were reporting it to
the police? It was felt that the council would have Nyle Fullmer talk
to the police about it.
RE: MONEY IN STATE RECREATION FUND FOR BIKE PATHS
TOPIC: (21,35,,, RECREATION,BIKE PATHS)
Marsha told the council, Bob Lee had been trying to get in touch with
her or the mayor because there is money in the State Recreation Fund
for biking and jogging paths.
Glen told the council there will be a meeting on February 28 at 10:00
A.M. to talk to the buyer of the Washington Building.
RE: SWIMMING POOL AND RECREATION DISTRICT

Marsha asked about the Swimming Pool and how is it going. Stephen told
the group that they submitted the petitions for the Recreations
District. They are now canvassing the petitions and of the first 80
pages of petitions there was at least 80% of registered voters who had
signed the petitions. We will possibly come out okay. If we are short
we can resubmit. If we get the Recreation District we can probably get
some advance of those funds to open the pool for the summer. If it
does not pass we can't open the pool.
Bruce suggested that the council and the county commissioners get
together and talk about concerns and proposals.
Marsha had some questions on the bills.
Stephen told the council that we need to go into an executive session
to discuss possible litigation.
After the council reconvened a motion was made by Bruce Sutherland and
seconded by Farrell Young to pay the bills. All Aye
