Introduction of College Class. B:00 P.M. The mayor introduced our new Assistant Engineer, Val Christenson. A motion was made by Glen Pond and seconded by Nyle Fullmer to approve the minutes with one correction. All Aye RE: FALL CLEAN UP TOPIC: (21, 5,,,FALL CLEAN UP,YARD WASTE) We have had several calls for the city to pick up leaves. It is better for the city crews if they can pick them up in bags rather than if the people leave them in the gutter. The council felt we should have a clean up in the fall and it would be good to have them do it for a couple of weeks. It was decided that they would pick up garden waste and small limbs cut in six foot lengths and nothing bigger that 1 1/2". RE: HIGHWAY BEAUTIFICATION - HIGHWAY 33 INTERCHANGE TOPIC: (21,5,,,HIGHWAY BEAUTIFICATION,HIGHWAY 33) A lady called and asked if she got some groups to volunteer to help, if we could do something with the interchange on Highway 33 by planting plants and shrubs. Joe said there is water to the entrance to the motel. The expense would be to get the water to the interchange. Joe said there is possibly Highway funds earmarked for beautification. The mayor and Joe will check it out. RE: ANNEXATION OF PROPERTY NORTH OF GREASE MONKEY SET FOR PUBLIC HEARING TOPIC: (21,5,,,ANNEXATIONS,GREASE MONKEY,SILVERTREE BUILDERS) Stephen explained the Annexation for some property, 1 7/8 acres, it is north of the Grease Monkey which Farrell Davidson use to own. There are two pieces of property in between which will annex when it is ', developed. They want it zoned H.B.D. for retail space. A motion was '._.. made by Nyle Fullmer to schedule it for Public Hearing for annexation. seconded by Bruce Sutherland. A11 Aye. RE: REQUEST FOR ZONE CHANGE BY STAN COLBORN - 248 SOUTH 2ND WEST TOPIC: (21,S,,,ZONE CHANGE,COLBORN*STAN,2ND WEST) There is a request by Stan Colburn for a Zone Change at 248 South 2nd West. He would like it zoned H.B.D. It is presently zoned H.D.R even thought there is a business there. A motion was made by Bruce Sutherland and seconded by N}~le Fullmer to set it for public hearing. A11 Aye. ~~,; RE: PUBLIC HEARING FOR ANNEXATION OF PROPERTY NORTH OF REXBURG TOPIC: (21,6,,,PUBLIC HEARINGS,ANNEXATIONS,BASIC AMERICAN FOODS, MENDOZA TRAILER COURT,LIVESTOCK AUCTION,VETERINARIAN CLINIC) RE: PUBLIC HEARING FOR ANNEXATION OF PROPERTY NORTH OF REXBURG TOPIC: (21,6,,,AMERICAN WEST,GRACE BIRD ESTATE,UNITED PLUMBING, RICKS COLLEGE) Public Hearing 7:45 P.M. pertaining to the annexation to the city. °'. Tract 1. Mendoza trailer court. Tract 2 is a parcel of land that is a '. wedge that encompass approximately 150 feet of Basic American's property just west of the Salem Highway, goes across and takes in the Livestock Auction, the Veterinarian Clinic, and Western Wear. Tract 3 is 160 acre of Ricks College property which would fill in just south of Rexburg between Cresthaven and straight south of the armory. It is all of the property that the college purchased from De Loy Ward a few years back. The college are in favor of being annexed. They request however that they not be annexed as open space but rather as university zoning which both zones are applicable with in the city limits. We are at the point of signing an agreement with Basic American with respect to their parcel of land. The Mendozas have indicated that they want to come in. Grace Bird estate are in favor of being annexed. He planned to meet with United Plumbing. The Stock Yards just changed hands a week or so before the hearing with P&Z and Stephen intended to meet with them and the Veterinarian owners, and Erickson who own the Western Wear sometime in the next few days. Stephen recommended that the council listen to everyone that is here tonight but take no action until he has been able to meet with those property owners and discuss their positions on it. Mayor Boyle read a letter frcm American West and Ricks College. (copy on file) Larry Larson- Box 51219, Idaho Falls. He is representing Basic American Inc. which is one of the property owners to be annexed. He is here primarily to answer questions, if the council has questions. They ' appreciate the consideration the city has given to Basic American in ._...., connection with the proposal to annex the property. The mayor, Stephen Zollinger, and Joe Laird met with him and Steve Bardell, the property manager for Basic American, a couple of weeks ago. They were very accommodating in terms of Basic American's interest. We have reached the term of an agreement. Their general council in San Francisco has reviewed it and approved the changes that he had recommended and Mr Zollinger incorporated those in the agreement. They are prepared to sign that agreement at such point as you would like whether before or after the city does. If Stephen just contacts him he will make sure the officers of Basic American get it signed. They approve of and agree to the annexation based upon that agreement being in place. If there was not an agreement they would have no interest in the property being annexed and would oppose it. They would approve it based upon the agreement being accepted. The mayor went through the stipulations. Basic American are interested in being hooked onto our water, just in case they ever need it. They would pay the cost of running an 8" line close to Horkley's and put in one or two fire hydrants. They would pay the cost of that and would pay all the water if they did have a catastrophe and the water went down. Besides that we would give them one water and one sewer hook up that would go just to their restrooms and lunch room and take that kind of waste out that now goes to one of those lagoons. They would hook up to water. and sewer just for the culinary use. This is a plus if they were able to hook on the sewer they could do away with that one lagoon. That has been the main reason they have not wanted to run a green belt or bike path along the river. It would be cheaper for them to hook onto our water and use the sewer and do away with that one part of their lagoon. The potato water will not come into the city sewer. We would give them the free hookup but they would pay water and sewer. Stephen stated the only other substantial agreement they gave them was if at some point they elect to reroute their traffic away from 10th North we would have no opposition to accessing the Salem Righway north of the Railroad tracks so their trucks could come and go without having to cross the Railroad tracks. That would be to the city's benefit. , The little piece of property that we are annexing is a buffer between the road and places they do their manufacturing. A motion was made by Bruce Sutherland to table the annexation until November 6, at which time it will be on the agenda. Seconded by Nyle Fullmer. All Aye RE: ROSEWOOD FINAL PLAT TOPIC: (21,7,,,ROSEWOOD SUBDIVISION,SILVERTREE BUILDER5,2ND SOUTH, LINCOLN SCHOOL,BIRCH) Rosewood Final Plat- Brett Hastings was at the meeting representing Silvertree Builders, presented the final plat and improvement drawings for Rosewood Subdivision which will be located just North of Lincoln School. Planning & Zoning have approved the plans. Joe stated that all the departments except tY.e police have approved the plans. He explained the plat which will have 15 lots, three lots will face onto Birch Street, four lots will face 2nd South. Anew road will come off 2nd South. To the north of their property is currently being developed into medical offices. They had told P&Z that they would create a landscaped buffer area along this common area of the street that boarders the two properties which would help separate the two areas. A motion was made by Ny1e Fullmer and seconded by Marsha Bjornn to approve the final plat for the Rosewood Addition. All Aye RE: LAWN SPRINKLER REQUIREMENTS-COMMERCIAL AND NEW RESIDENTIAL TOPIC: (21,7,,,LAWN SPRINKLERS,SPRINKLERS,PLUMBING PERMITS) DeLynn Edstrom was at the meeting to discuss sprinkler requirements. He proposed that when a plumbing permit is taken out that they be required to get a sprinkler permit at the sometime, which would be $18.00. He needs to check to see if they are doing it right. It is important that they put the back flow prevention in so water from the sprinkling system does not come back into the city water system. On the older homes they usually call and ask what they need to do and get a permit. The new homes think they have taken care of all that, because they think they have taken out all the permits. The mayor and council felt it should not be mandatory if they are not going to put it in. Kay Beck suggested that there be something they could sign off on if they are not going to put in a sprinkler system. DeLynn discussed a problem with commercial sprinkler permits. He would like to charge commercial sprinkler permits a minimum of $18.00 which is what we charge on residents. Right now commercial is a percentage and someone came in to get a commercial permit the other day and his percentage was $4.50. This is a lot less than a resident has to pay. The mayor stated he had no problem with trying to get the home owners to get a permit, but they should be able to sign something if they don't want to put in a sprinkler or just not be forced to put one in. We could suggest it to them, but not make it mandatory. The council felt that the commercial should be a minimum of $18.00. RE: TRAFFIC PROBLEM BY LINCOLN SCHOOL DISCUSSED TOPIC: (21,7,,,TRAFFIC,LINCOLN SCHOOL,2ND SOUTH,3RD EAST) Ny1e Fullmer reported on the traffic problem by the Lincoln School. He -- had talked to the police department and talked to Farrell. They have moved some of the speed limit signs to space them out farther to extend ''.. the school zone speed limit. They are going to talk to Brent Orr to see if between the school budget and the police budget they could fund another crossing guard, probably at 2nd South and 3rd Eaet. The police have been up there about every morning during this last two weeks. RE: SIGNS FOR COLLEGE AVENUE PARKING LIMIT TOPIC: (21,7,,,SIGNS,COLLEGE AVENUE,PARKING) The signs for college avenue parking limit will be up tomorrow. A motion was made by Nyle Fullmer and seconded by Marsha Bjornn to approve the bills. A11 Aye.
