M. Nile Boyle Kay Beck Farrell Young Glen Pond Marsha Bjbrnn Bruce Sutherland Nyle Fullmer Rose Bagley Stephen Zollinger Richard Horner Joe Laird County Commissioner Brooke Passey and Golden Lindford, Legislator, were also in attendance at the meeting. Pledge to the flag. Introduction of scouts. A motion was made by Kay Beck to approve the minutes. Marsha Bjornn asked questions about some issues that were discussed at the previous meeting. (1) The Meikle sidewalk, the mayor said he had talked to her husband. The council felt they should comply with the ordinance. He had signed a letter saying he would put sidewalks in. Steve Meikle would like to put money in a trust to be used for a sidewalk when the rest of the neighbors put in a sidewalk. (2) The triangle on Shoshone, Joe went over it with those people and the only thing the city could do is provide water if they would keep it up. (discussion). Motion was seconded by Farrell Young to approve the minutes. A11 Aye RE: COMPLAINT ABOUT NOISE AND TRAFFIC ON MAIN STREET TOPIC: (20,151,,,NOISE,TRAFFIC,DRAGGING MAIN,MAIN STREET) The mayor read a letter from a tourist that stayed at the Super 8 Motel. He complained about the kids driving up and down Main Street with their noisy Boom Stereos. RE: TRUCK WEIGHT DAMAGING CITY STREETS TOPIC: (20,151,,,TRUCKS,STREET DAMAGE,STREETS,STATE HIGHWAY DEPARTMENT) The maycrtold the council he had a call from a citizen. He complained that some trucks that have been coming out of the school property were very grossly over weight. He told the mayor those trucks driving over our roads and going down 2nd North will do more damage than twenty thousand cars. The fellow that called works for the State and runs the weigh stations. He said he could look at a truck and tell you when it ie over weight. If those trucks were on the state highway they would have a big fine. If we request the state to come into Rexburg and do spot checks, they will do it. (discussion Stephen stated that the State Statute governs the load limits) A motion was made by Glen Pond to proceed and have Stephen write a letter to the state asking them to spot check trucks in the city. Seconded by Bruce Sutherland. All Aye RE: CURFEW ORDINANCE - 1ST READING TOPIC: (2D,151,,,CURFEW) Stephen Zollinger handed out a copy of the Curfew Ordinance and reviewed it with the council for the first Reading of the Ordinance. (discussion) He told the council Chief Archibald was in favor of the ordinance. Stephen had called other cities and they all said it would be an excellent way of curbing the vandalism and late night crimes. Last week they had the chief of police meeting in Rexburg for South East Idaho. Pocatello and Idaho Falls said they would fight hard if l ~"~~ they tried to take the curfew away £rom them. (discussion) The second reading will be at the next council meeting. RE: JOINT POWER AGREEMENT TOPIC: (20,152,,,JOINT POWER AGREEMENT) Stephen handed out to the council and reviewed a Joint Power of Agreement draft. This had not yet been reviewed by the County Attorney. The mayor pointed out we need to get this passed quickly because we need to hire a greens keeper for the golf course as soon as possible. This will be tabled to the next meeting.(discussion) --- The mayor told the council that we are proceeding with the annexation north of the city. Lot Watering agreement will be tabled until the next meeting because Nyle Fullmer needs to be here when we go over the agreement. Glen Pond gave an up date on the engineering position. Farrell Young told the council he felt we should send a letter of appreciation to the Civic Club for the work they have done at the new Pioneer Park. Discussion on trees blocking stop signs. A motion was made by Bruce Sutherland and seconded by Kay Beck to approve the bills. All Aye Two weeks from tonight we will discuss rather or not to open North 5th West and set it for Public Hearings. Legislator, Golden Lindford told the council to give him any suggestions for the Legislature. RE: ORD. 787 FOR BUDGET FOR 1996-1997 PASSED TOPIC: (20,152,ORD,787,BUDGET,PUBLIC HEARINGS) 8:30 P.M. Public Hearing for the Budget for 1996-1997. Richard gave handouts to the City Council of the budget and explained the budget. The mayor asked if there was anyone that had any questions? No one in the audience had any questions on the budget. Mayor Boyle read Ordinance No. 787 to pass the budget. AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1996, TO SEPTEMBER 30, 1997, AN APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1997; AND PROVIDING FOR THE EFFECTIVE DATE OF ORDINANCE. A motion was made by councilman Bruce Sutherland and seconded by Kay Beck that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 787. Those voting aye: Bruce Sutherland Marsha Bjornn Glen Pond Farrell Young Kay Beck Those voting nay: None Ordinance 787 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Kay Beck and seconded by Glen Pond that ordinance 787 be passed, Those voting aye: Bruce Sutherland l~.? Marsha Bjornn Glen Pond Farrell Young Kay Beck Those voting nay: none The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said ordinance was duly and regularly passed. Mayor Boyle declared the motion carried. RE: ORD. 788 AMENDING 1995-96 BUDGET PASSED TOPIC: (20,153,ORD,788,BUDGET,PUBLIC HEARINGS) 9:00 P. M. Public Hearing to open the budget for 1995 - 1996 to amend the budget to allow for additional money that have been received to be used. Ordinance No. 788 AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, AMENDING ORDINANCE NO. 776, THE APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1995 AND ENDING September 30, 1996: APPROPRIATING ADDITIONAL MONIES THAT ARE TO BE RECEIVED BY THE CITY OF REXBURG, IDAHO, IN THE SUM OF $956,700 AND PROVIDING AN EFFECTIVE DATE. The motion was made by councilman Glen Pond and seconded by Bruce Sutherland that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 788. Those voting aye: Those voting nay: Bruce Sutherland Marsha Bjornn Glen Pond Farrell Young Kay Beck none Ordinance 788 was then placed before the council.
