RE: REPORT ON THE ADVISORY PANEL MEETING FOR THE FAMILY RENEWAL CENTER
TOPIC: (20,136,,,ADVISORY PANEL,FAMILY RENEWAL CENTER)
Glen Pond reported on the Advisory Panel meeting for the Family Renewal
Center. They had their first meeting. Members of that panel are Karen
billing, Mike Black and Sheila Kellogg, employees at the Center, Dave
Ogden, ECIPDA,. Phil Nye, local resident next to the facility, Clair
Boyle, Officer Larson, Roger Clark and Glen. They spent most of their
time finding out what was going on in the center. Roger would like to
be on the agenda for the next council meeting and he will report on the
audit that we asked for. From the report everything seems to be okay.
The police have been informed and have a good working relationship with
the police department in case of any problems over there. They have 16
residents and are going to remodel to bring that to 24 residents. They
anticipate that the revenue will be enough to take care of their
expenses. This group will probably meet on quarterly bases.
RE: LITTLE PEOPLE ACADEMY - PROBLEM WITH HOOK UP & PLUMBING FEES

Little People Academy- Mr Jergens, Dynamics Inc. they are doing the
plumbing and mechanical at Little People Academy. He was at the
meeting to get some relief for some fees which he has been unjustly
levied as a result of errors on someone's part. On the day of the bid
he called the City of Rexburg and asked to talk to the utility
department and talked to a gentleman and he told him that the project
that he was bidding on was outside the city limits therefore there
would be no fees levied by the City of Rexburg. He then completed his
bid and it turned out he was the low bidder. The general contractor
told him to go to Rexburg and pick up a plumbing permit as he could not
obtain a city building permit until he had got the plumbing permit.
The city informed him that it was outside the city limits and there was
no plumbing permit required by the city. When he came to the city hall
he talked with Mrs Bagley, City Clerk, and she informed him there was a
fee of $3900 for water connection fee and $650 for a sewer connection
fee. The plumbing inspector was there and he informed him there was a
fee for a water meter for $1200. He was upset when he found out the
fees at this point and wished he would have found it out when he first
called the city before he did the bid. He did not want to delay the
project and paid the fees. He felt someone had made a mistake and he
felt the situation would be resolved. He talked to Dave Ogden about it
and said he would speak with the mayor and see if he would refund the
fees he had paid. He did speak to the mayor and the mayor was not
receptive to that, he then spoke to the mayor himself and he told him
to come to the city council.

The project required a 2" tap to the city water line. There was a tap
to the property prior to bid opening so he assumed that was a 2" tap
for an industrial park. A 3/4" tap ie not enough to serve more than a
single residence and as a result they have to do a hot tap to the city
water line to increase the size from 3/4" to a minimum of 1 1/2". The
owners issued a change order for him to do the hot tap. He included in
his change order the fees he had to pay thinking the owner would pay
them. The owner rejected the change notice saying he did not feel he
was responsible for the fees. He is requesting that the city council
provide relief for this expense because he feels he was mislead.
Apparently the city put the system in and are recovering these fees.
He has been victimized with misinformation and has been forced to pay
this amount and feel it is unjust. He asked the city to provide relief
on those fees.
The mayor stated that he could see that DeLynn told him there would be
no inspection fees because it ie out of the city and the et ate does the
inspections. The hookup fee for out of the city is 1 1/2 times the
hookup fee of the city so it would cost more, but because of the
situation we did agree to charge the same fee as we charge in the city
for the hookup, instead of the water hookup fee of $5750. He felt that
he just misunderstood when he was told there was no plumbing permit to
pay to the city only the state. No one working for the city would tell
him there is not a hookup fee, because everyone knows that it is 1 1/2
times the fee for out of the city. The meter is charged by what we
have to pay for it. The mayor was in agreement with the 2" tap. He
could not believe that the engineers tapped out everyone of those lots
with a 3/4" tap. (discussion) Mr Jergens felt the city should pick up
the additional cost. The mayor told him, the mayor, Stephen and Joe
would go out and talk tc Dave Ogden of E.C.I.P.D.A.and get back with
him.
RE: CHEVRON GAS NEW CAR WASH REQUEST TO USE SYSTEM AS IS GRANTED

FIRE DEPARTMENT)
Steve Oakey, Chevron Gas- They are in the process of construction of a
self service car wash. They had to move the propane tank and called
the Fire department. They came out and told them where it should be
moved and that they needed to put it on a concrete pad and how he
should do it, which they did. Blair Manwaring came out and told him he
had to move it 2 1/2 feet back because it was too near the
right-a-way. He had to spend several hundred dollars to put a sidewalk
in and for a green belt. He asked if he could get the 2 1/2 feet from
the city right-a-way. He needs to be back from the right-a-way 13
feet. He said by the fire department he is legal. He was told that is
a state highway and a et ate right-a-way and would need to get
permission from the State.
Mr Oakey also explained that he is adding a self service car wash to
the Chevron Station. There is a drain problem with the way the drain
is being put in for inspection purposes. He said he has a master sump
in the front and both this and the other car wash will flow into it.
He asked why couldn't it all be checked at that manhole? The drainage
all filters into the master sump £rom the two chambers and then to the
sewer. Both are separate tanks. The mayor told him there has to be a
place they can take a teat. Mr Oakey asked why it couldn't be tested
at the manhole. Dave Thibault told him we can make a test but there is
more tribulance and there will be a higher teat. Mr Oakey asked if he
pays for the higher test is it okay? Dave told him the more often that
the sump is cleaned the better the test. Mr Oakey told the council
that to change everything now would be an extra cost and he requested
to go with the system as it exists. Dave told him he would need one
hole 1/2 diameter in the lid on the east, so we can use a hook in the
hole to open it. A motion was made by Nyle Fullmer to accept Mr.
Oakey's request to use the system as it exists. Seconded by Farrell
Young. A11 Aye.
RE: STREET RECONSTRUCTION/OVERLAY 1996 HID TO H & K CONSTRUCTION

The mayor told the council that the bids were opened for the
reconstruction and overlay on the streets and the low bid was H & K for
$255,333.20. A motion was made by Glen Pond and seconded by Kay to
accept the low bid. A11 Aye.
Kay Beck felt Joe needed to look at the work H & K did last year before
they start this year. They were not careful enough last year.
RE: SEAL COATING FOR 1996 LOW BID TO BECO

The low bid for Seal Coating was Beco for $55040.16. A motion was made
by Nyle Fullmer and seconded by Kay Beck to accept this low bid. All
Aye.
RE: PLAT FOR BOWEN & THOMASON DISCUSSED & ACCEPTED BY CITY COUNCIL

RIGHT OF WAY,2ND WEST,3RD WEST)
Joe showed a plat for Bowen & Thomason. This is located on 3rd West
and 5th South. He showed the aerial photo. There is nothing south of
5th South right now. They were asked to complete a plat on the whole
area and they are asking approval of the plat. He asked the council if
they have to put in the whole street or would a half of a street be
okay. We have allowed a half of a street previously on the street by
Brenchley Apartments. Glen asked Joe if they put only a half of a
street in if it would get broken down eventually? Joe said it would
not be a problem. The council felt if it did not break down there
wouldn't be a problem because we had allowed it on other streets. This
plat will give ue the right-a-way on 6th South over to 2nd West and
there is already right-a-way on over to 4th and 5th. Joe explained the
plat. This street that they want to put a half street would not go
anywhere.
A motion was made by Glen to accept the plat and let them proceed
contingent upon approval by the Planning & Zoning. Seconded by Nyle
Fullmer. All Aye. This plat will give a right-a-way for 6th South.
RE: COMPLAINT ON THE SIDEWALK ON 2ND SOUTH

The mayor stated that he had a complaint on the sidewalk on 2nd South.
The sidewalks are deteriorating and they told the mayor the city should
force people to replace the sidewalks. He also had a letter from a
Sunbird complaining about the sidewalks and stated that some Sunbirds
had fallen and gotten hurt on the sidewalks. They also complained
about the trees, bushes, cars parked on the sidewalk, hoses on the
sidewalks. They made suggestions.
RE: SEWER LINE TO THE NATURE PARK RESTROOM DISCUSSED

The mayor told the council that we are ready to get bids to run a sewer
-- line to the restroom at the Nature Park from Wayne Parkinson's house to
the restroom. Because of the vandalism we have been using Ports
'. Potties at Smith Park. He asked the council if they wanted to go to
'. the expense of building restrooms and running a sewer line or just use
Ports Potties at the Nature Park. (discussion) The mayor told the
council the money for the sewer line is coming from the Nature Park
Grant. Glen suggested that we would save money by having the city
employees put it in. Stephen stated that the city is anticipating
laying the water line. The trenching of the road and laying of the
sewer line, he did not think there was anyone in the city who would
feel comfortable putting that in. He did not think the trenching of a
sewer line would be done efficiently with our little backhoe. The
council felt we should go ahead with the sewer line for the restroom
and possibly see if any of the work could be done by our crews.

RE: CURFEW DISCUSSED

The council discussed a Curfew. Nyle stated that Chief Archibald felt
it would be a good idea. The council instructed Stephen to look at
some curfew ordinances from other cities and report back to the council.
James Hench-He is here from Pocatello going to Rick College. He
suggested that the city needs to do something about problem of kids
dragging Main. He use to live in Phoenix and the police are really
'. strict about the enforcement the curfew. The curfew in that area is
1D:00 P.M. in some areas and 11:OD P.M. in others.
A motion was made by Marsha and seconded by Nyle to approve the bills.

A motion was made by Farrell and seconded by Nyle to approve the
minutes. A11 Aye.
RE: CITY WATERING LOT BY PORTERS ON 2ND EAST DISCUSSED

Nyle told the council that he got a call from Trudy Porter. They own
the lot between their house and the Army Reserve Building and it is a
weed patch. She asked if the city would provide water for the lot if
the Porters would clean it up and plant grass. We have furnished water
to lots in other areas. The council questioned if they would let the
public use the lot3 If it is open to the public there wouldn't be a
problem. Nyle asked Rose to look up in the minutes and see what we
decided about other lots in the city and table it to the next meeting.

RE: DEVELOPMENT AGREEMENT FOR SEWER LINE FOR GREASE MONKEY APPROVED

The mayor told the council that he had an easement for sewer line to go
through the Walker girls property which will be used for the Grease
Monkey. The Grease Monkey needs sewer. The owner of the Grease Monkey
would like to have a development agreement to recover some of the money
when property is sold. Glen suggested that we need to put it into a
long term agreement because no one will remember. They will only be
able to recoup the cost of the line. A motion was made by Kay Heck and
seconded by Marsha Bjornn to approve the agreement. All Aye.
We need to be aware of any agreements the Nyes make, our storm drain
hits their property in a few places. Part of it will overlap the power
line easement.
Richard read the budget schedule.
