RE: WATER STORAGE TANK ENG. CONTRACT WITH FORSGRENS APPROVED
TOPIC: (20,127,,,WATER TANK NORTH,FORSGREN ASSOCIATES)
We have given an Engineering contract to Forsgren & Associates to
engineer a water storage tank north of the city. Joe and Stephen have
'.. reviewed the contract and think it is satisfactory. We need a motion to
', approve the contract to proceed with the water storage tank. A motion

RE: MAGISTRATE COURT FINES 6 FORFEITURES - MOTION TO PROCEED PASSED
TOPIC: (20,127,,,MAGISTRATE COURT,FINES & FORFEITURES)
A discussion on the Magistrate Court payment for the fines and
forfeitures. A motion was made by Glen Pond to start with the funding
as of November of 1995. Seconded by Nyle Fullmer. Kay Beck voting
Nay. All other council members present voting Aye. Motion carried.
RE: SIDEWALK L.I.D. #29 DISCUSSED

The mayor discussed the sidewalk L.I.D. If we proceed on all of these
pieces of property, each one will have to be checked so we can come up
with a figure before we set the amounts. Is there any time when a house
is sold that the council wants to give a variance? If there are places
like the one on the hill where they will have to take out a retaining
wall and a tree, if after we figure it out and if it will be very
expensive are we going to still make them put the sidewalk in or is
there a better way to do the sidewalk L.I.D after this year? The mayor
felt that if a sidewalk doesn't go anywhere like on the hill, he has a
concern. He still thinks it would be better to pick out one area of
the city at a time and L.I.D. the whole thing. How much resolve does
the council have, are we going to hang tight all the way?
Glen felt the way we have it now, it is difficult to enforce. Who will
enforce it? We could have a home sold twice before we pick up it has
been sold. The mayor explained that we can pick it up when it is sold
because they have to come in and change the water into their name, but
the only way we can enforce it all the way is to form an L.I.D. The
mayor asked if the council was satisfied the way it is and ready to
proceed full speed ahead? Kay stated we need to do something.

Stephen stated that the real question that the council needs to address
is we can proceed with what we have done to this point, but do we want
to create L.I.D's that only deal with new purchases or do we want to
consider next summer's L.I.D. to do the general area rather than hit
and miss houses as this L.I.D. did? Kay did not think this council
would vote for that, unless we could come up with a better way.
(discussion) The mayor stated that we would proceed with this L.I.D.
but there are three or four of those sidewalks that will not go
anywhere and also they are on the hills. Glen stated that the way we
are now we could open it up and at every council meeting we could have
someone come in and complain about doing it because people are not
aware of the ordinance. Ny1e stated if there are extenuating
circumstances we can take them on a case by case bases.
RE: CLOSURE OF MAIN STREET & CENTER FOR DANCE FESTIVAL APPROVED
TOPIC: (20,128,,,MAIN STREET,CENTER STREET,DANCE FESTIVAL)
Stephen stated he was representing the Dance Festival to close Main
Street and Center street the same way we did last year. If there are
going to be any closures the merchants prefer this method. The State
has okayed the closure. It will be on July 27. A motion was made by
Nyle Fullmer and Seconded by Kay Beck to allow the street closure as
presented for the Dance Festival. A11 Aye
Glen left the meeting for another obligation.
RE: DANCES OUTDOORS - 10:00 P.M. MUST BE OVER
TOPIC: (20,128,,,DANCES OUTDOORS)
The mayor told the council that we have had more requests for Outdoor
Dances. He said we need to make a rule for Rose to tell them. It was
decided that all outdoor dances would be limited to be over at 10:00 P.
M. unless they get council approval and the chances of getting council
approval are not very good. If we have any complaints of noise from
the dance or disturbing the peace we will act on it at that time.
RE: BUILDERS ASSOCIATION

The Building Association will be coming to the next council. The mayor
asked the council to think about how we handle plan checks for example
the Jail? If you have a building like that which has been drawn by an
architect and signed by several engineers, how much more plan check do
we need? Joe is following what the council has said. We will discuss
that at the same time. The mayor asked what the council view would be
on an issue for example right now we have a house where the owner wants
to remodel the basement and the windows are not large enough for egress
windows? The mayor had remembered from a previous meeting,if it would
be for a family we left the windows as they are but, if they change the
use and go for a rental then they needed to comply with the regulation
of egress windows as addressed in the U.B.C. We need to discuss that at
the same time. The council felt we need a work meeting with the
builders at 7:00 P. M. prior to the council meeting and then any
decisions to be made could be made at the council meeting. The mayor
asked Rose to notify all the builders and put a notice in the paper.
The meeting will be on July 3.
At the last meeting we voted to put a sign across the highway. The
mayor had contacted the Highway Department and they will send the
application to make it legal.
Nyle Fullmer asked when the bench in front of Arc Electronic would be
moved? The mayor said he would check on it.
Nile Fullmer told the council and press that we needed to go into an
executive session on a personnel problem.

RE: MONEY FOR 911
TOPIC: (20,129,,,911)
Nyle Fullmer told Brooke he was concerned about the article in the
paper about taking $200,000 earmarked for 911 for the jail. It was on
the ballot and should not be spent for anything except the 911. Brooke
told him this would be for the Mechanical to set up 911.
RE: PRISONERS AND FINES & FORFEITURES

Nyle told the council the Sheriff of ADA County wants the cities to
take responsibility for prisoners until they are arraigned. If that is
the case we need to take a good look at that $25,000 that we are
putting back into the system. They are as much a county responsibility
as the city. The mayor told them it would take legislation to change
from the way it is now.
