RE: PUBLIC HEARING FOR ORD. 778 - CHANGES TO ZONING ORDINANCE
TOPIC: (20,64,,, PUBLIC HEARING,ZONING ORDINANCE)
Mayor Boyle opened the Public Hearing stating that the Public Hearing
was regarding certain proposed amendments to the Rexburg City Zoning
Ordinance No. 725 (Planning and Zoning Ordinance).
(1) that the categories: "automobile repair services; electrical repair
services be permitted uses in an industrial (I) zone. That finance,
real estate and insurance services be listed as permitted uses in a
Professional Overlay (PO) Zone.
(2) that a new paragraph be added dealing with the heights, locations
and placement of fences for schools, churches, universities, colleges,
hospitals, nursing homes, city and county.
(3) that a paragraph be added defining heights and placement of fences
in HBD, CBD, NCD and I zones.
(4) that "separate" parking lots be listed as conditional uses in
various zones.
(5) that a new section be added setting forth the provisions regarding
single-family attached dwellings.
The mayor asked if there was anyone that wanted to testify.
John Bowen suggested with a 110" lot line with one home on that lot with
a petition in the center, why can't that be changed that you can reduce
it to 6000 or 7000 square feet based on twin town houses. It doesn't
need to affect single family dwellings.
The mayor stated he felt if the people were here that have bought lots
next to this development would object to reducing the required square
footage. He said if he bought one he would want a first class, one
where you would still have plenty of room. He also felt if the
property were changed to LDR2, the people would really be mad. There
is a need for these type of homes but they need to be done right.
Richard stated many times when you have a minimum lot size, because of
the side and rear yard requirements, the size of the home is reduced
down. You can have large attached units and do away with the side
yards and rear yards and he sees some real potential for problems if it
is not addressed properly. This would really regulates the size of the
house on the lot with the rear and side yard.
John Millar stated the advantage is it makes it so those lots average
right at 8000 square feet, where the other lots they sold were at
12,000 to 13,000.
A motion was made by Glen Pond to approve the recommendation that was
made by the Planning & Zoning to make the changes in the zoning
ordinance as drafted in ordinance 778. Seconded by Kay Beck. All Aye.
We do need to work on provisions in our ordinance for PUD development.
