Janet Williamson was present to take minutes. Pledge to the flag. Bruce Sutherland moved to approve the minutes of 9/6/95. Glen Pond seconded the motion. All aye. RE: SOROPTIMIST CLUB - NO PUMPKIN WALK; JULY 4TH CARNIVAL INSTEAD TOPIC: (20,41,,, SOROPTIMIST CLUB,PUMPKIN WALK,CAROUSEL,PARKS, PLAYGROUND EQUIPMENT) Dorothy Bowen - Pres. of Soroptimist: For several years they have worked in conjunction with the Carousel Committee to sponsor the --- Pumpkin Walk. They have chosen to discontinue that activity this year but they know that the revenue source for both Soroptimist and the Carousel Committee needs to be replaced. They are proposing to hold a summer carnival in the park on the 4th of July. They would like the City's formal support of that so they can go ahead and advertise and let the public know what they plan to accomplish. Soroptimist has already donated, to the City, $1,000 for playground equipment. Their intent is to still raise funding towards the completion of that project. They already have another $1,000 they are about ready to present to the City. They feel the entire project could cost between 5 - 10 thousand dollars. What she is really after tonight, is the Council's formal approval or acceptance of the project so they can go into the planning stages. The Council felt they should give them all their support. They suggested she reserve the park now and coordinate activities with the Lions Club and the Chamber of Commerce. RE: AMERICANAS AS AMBASSADORS FOR THE CITY TOPIC: (20,41,,, AMERICANAS,AMBASSADORS,PROCLAMATIONS,DECLARATIONS) Linda Edstrom - Americanas: She has been to several civic groups that have said they would like to have good will ambassadors to go out and '.. talk about and represent Idaho and Rexburg. The Americanas are a group of black horses that Mel Griffith is in charge of. Most of the riders stand and carry a flag and then there are Roman riders that go down the center. They are very professional and have won awards in Cheyenne, Salt Lake, and Sun Valley. She thought this might be a way to introduce Rexburg with posters, newspaper articles, etc. She would like to suggest that the town adopt The Americanas. The Mayor said that anything short of spending tax money they would support them. Linda said they were going to ask for grants and the Mayor said they could support them on that. yp" Farrell asked just what they could do to show their support. Steve Zollinger suggested the city give them a Proclamation of some sort. The Council felt they were an outstanding group and the Mayor and Linda will get together and work up a Proclamation or Declaration. RE: NEIGHBORS MAKE A DIFFERENCE DAY TOPIC: (20,42,,, KEY BANK) Today was "Neighbors Make A Difference" day for the employees of Key Bank. They closed the bank early and the employees did a service project. RE: ILLEGAL GARBAGE - JIM BARRETT, VILLAGE APARTMENTS TOPIC: (20,42,,,GARBAGE*ILLEGAL,BARRETT*JIM,DUMPSTERS,GARBAGE) Jim Barrett - Village Apartments. About every week Nancy calls him and tells him he has illegal garbage in his dumpsters at Village Apartments. Today they tore some carpet out of some apartments and to get it all moved he had to hire a couple of men, put $10 of gas in his truck, and pay them $25 to haul the carpet and some mattresses, etc., out to the land fill. He doesn't want to be in the garbage hauling business. That is why he pays what ever the City asks to haul the garbage. But now you have illegal garbage - garbage that they will not haul; so, whether he wants to or not, he is in the garbage hauling business. He feels the people in Washington have missed a step. They put in a garbage transfer and they have the land fill but they need to add another group of people to pick up the illegal garbage. You may have cut the pay roll but the service is lacking. Kay said it seems that he has two problems: 1. That people are putting illegal garbage in his dumpsters. There is an ordinance that covers this. There is a fine for doing that but you have to find out who it is that is doing it. 2. There are items that he has that are garbage that need to be hauled off such as boards and carpets and couches, etc. that the trucks cannot pick up. The City does have a service to pick up these items. He needs to call City Hall and be put on a work order and they will give him an estimate as to what it would cost to haul it off and they will do it for him if he wants to pay the City for it. RE: "VEHICLE PER PATROLMAN" POLICY FOR POLICE DEPARTMENT TOPIC: (20,42,,, POLICE DEPARTMENT,VEHICLES) Nyle Fullmer reported on a new policy the Police Department is working on that would allow each city officer who lives within the city limits, the option of being assigned a personal marked patrol vehicle or having the vehicle assigned to the officer but remain at the police station. It has been proven statistically in other areas (ex. Salt Lake City) that have gone to a "vehicle per patrolman" policy, that it creates more pride within the department, they take a little bit more pride and respect in their own police unit, it reduces the maintenance generally because the officers do some of the minor maintenance and up keep more often, and it should reduce the mileage so we can keep them longer. one of the big advantages is that it has been proven that the crime rate in those areas where police cars are parked is reduced. A criteria has been set for private use (copy of handout on file). They will always be on call whenever they are in the vehicle. This year they bought 2 used vehicles for the price of one. They found a company in Spokane that put the cars together new and lease them to a department then bring them back and completely restore what needs to be restored, they completely go through the engines, the radios, so when we buy them they are already set up with radios, light bars, kick screens, etc. The ones they have picked up so far have had mileage in the area of 65,000 - 75,000 miles (generally put on in the space of 18 months). Glen mentioned the concern of when a patrolman has a family member with him and has to respond to a call - what is the liability of the city in this case. Steve said that was addressed in the handout: IV. e. "Should an officer drive upon a possible dangerous crime scene, civilian passengers will be immediately dropped off at the nearest intersection before reacting." This is the way they handled it in Salt Lake. Steve also said that in Salt Lake the officer took upon himself that liability if he did not respond accordingly. They must follow the protocol which is to immediately stop and place the passenger out, or, make the decision (and then document) I could not pursue the criminal or dangerous activity because it would have endangered a civilian. He is an off duty officer so even if he could not respond we have not given up anything that the city has right now. But, it has been proven that we will catch officers that have no one in the car, that are fully armed, ready to respond, where they will be of assistance, where they wouldn't be if they didn't have private use of a patrol car. Bruce said that they would need to publicize it so people will understand. They need 2 - 3 weeks to publicize it. Farrell asked how many more cars we would need to get. Nyle said just one more. The officers living outside the city limits would not be issued a car. Bruce moved that they allow the committee to proceed and come back to the council for final approval. Kay seconded the motion. All aye. RE: L.I.D. 28 DISCUSSED AND PASSED TOPIC: (20,43,,, L.I.D. 28,GRANTS,7TH SOUTH,YELLOWSTONE HIGHWAY) Mayor Boyle asked the council if they wanted to proceed with L.I.D. 28 as discussed at the last meeting. Glen Pond moved that they proceed to get the grant and take care of 7th South and drop off Yellowstone Highway. Bruce Sutherland seconded the motion. All Aye. Farrell asked what the possibility was of doing an L.I.D. for the whole City to help pay for the work needed on Yellowstone. Joe felt you would have a hard time doing an L.I.D. For an L.I.D. you have to show some benefits. You might have to go to some type of a bond election to cover all the streets. L.I.D.'s are more site specific. (Discussion on benefits, state tax,etc.) RE: DISCUSSION OF S.I.D.'S TOPIC: (20,43,,, S.I.D.'S) Steve said some states have an S.I.D. which is a Special Improvement District where you selectively pick those curb and gutters that have deteriorated at a faster rate then others and force those people and allow them to have them replaced even if the people are not ready to have them replaced. The Mayor asked Steve to check and see if that would be legal for sidewalks in Idaho. RE: SIDEWALKS WHERE RECONSTRUCTION IS BEING DONE TOPIC: (20,43,,, SIDEWALKS,STREET REPAIRS,OVERLAYS,RESOLUTIONS) Kay Beck asked if the letters had gone out to all the people involved with sidewalks where we are doing major reconstruction and overlays. The Mayor said we decided that none of them were major reconstructions. He brought that up in council and there was no one that wanted to make a motion to say which streets. He went through every street we were going to do. Kay read from the resolution: "...Furthermore, whenever there is major street reconstruction (which includes, but is not necessarily limited to, replacement of curb, gutter, or asphalt overlay) then the adjoining lot owners shall be required to install sidewalks, if such are not already in existence." So, we finally pass a resolution and now we are not going to enforce it? The Mayor said that night no one was willing to say these were major reconstructions. Bruce said, as he recalls, there wasn't any complete overlays on any of those streets. Joe said there was a complete overlay but not a complete reconstruction on all of them. They are asphalt overlays. Kay wondered why we need a determination every time we do something. It is in the resolution we passed. Glen felt it was open to interpretation. The word "major" needs to be interpreted. Kay re -read the resolution: "...which includes, but is not necessarily limited to". He felt the the cost of overlay definitely makes it "major". Jim said the resolution defines "major". It says "which includes..." and spells it out. Nyle said he had no problem with going back and saying they need to put in sidewalks. Steve said you would have to do something similar to an S.I.D. in order to enforce the resolution. Under the status, you have to give homeowners proper notice that they are about to be hit. Basically you have to fund the sidewalks and bill homeowners the way you do on the L.I.D.'s. He said to enforce the resolution it would have to be in conjunction with some sort of S.I.D. You will have to send out notices that you are about to be rolled into a project and as part of the project you are going to be expected to pay this amount over a certain period of time. The golf board will be meeting with the airport board and the county commissioners on the 3rd Tuesday of October. Council is welcome to attend. RE: HANDICAPPED CHAIR LIFT DONATED TO TABERNACLE TOPIC: (20,44,,,TABERNACLE,A.D.A.,HANDICAPPED,RICKS COLLEGE) Steve said Ricks College will be donating one of their handicapped chair lifts to the city to be used in the Tabernacle. Nyle Fullmer made a motion to pay the bills. Glen Pond seconded the motion. All aye. RE: COMPOST TOPIC: (20,44,,, COMPOST,MADISON COUNTY) In follow up on the possibility of composting, Brooke Passey checked with Wendall at the Solid Waste Site, (the ponds out there). Next year they are thinking of putting in a drainage pipe so they are not draining their water from the basement into the ponds which will keep those ponds dry and you could use one of those lagoons. If it is cost you are worried about, Wendall said he only charges $1.00 a load per composting material at the transfer station. Brooke brought them up to date on the Juvenile Justice System.
