State of Idaho) county of Madison( as City of Rexburg) Present were: Mayor: Nile Boyle Councilman: Kay Beck Farrell Young Bruce Sutherland Excused: Jim Flamm Glen Pond Nyle Fullmer City Clerk: Rose Bagley Attorney: J. D. Hancock Engineer: Joe Laird Pledge to the flag. The mayor stated that this would be an unofficial meeting because we will not have a quorum and will not be able to take any action. Jim, Glen and Nyle are out of town. There will be not voting, it will be like a work session. RE: TRAFFIC SAFETY ON SOUTH 5TH WEST TOPIC: (19,117,,, STH WEST,TRAFFIC,SIGNS,SAFETY COMMITTEE,STOP SIGNS) Kay Beck asked that the safety issue on South 5th West be discussed first. There was a petition and request to put a stop sign at 7th South and 5th West. Gordon Steiner who resides at about 1000 South 5th West was at the meeting to discuss the issue. He was not aware of the issue of a stop sign until about three days ago and he questions the stop sign. The speed limit out there is 35 mph and as it gets in the city limits it drops down to 25 mph. He questioned the validity of a stop sign. The mayor told them from the Uniform Traffic Control, there are certain guidelines that have to be met before a stop sign is justified in an area. It is all spelled out by the Idaho Transportation Department with a certain amount of traffic going both ways. From preliminary figures that does not have enough traffic going East and West to justify a stop sign on 5th West. John Dunckley stated before and after his son was hit, if everyone coming from South to North from the county line road would stop to see what was ahead of them it would help. Kay Beck read the recommendation from the Traffic Safety Committee. (on file) In the minutes the petition requested a possible sign stating "WATCH FOR CHILDREN". (reading from the petition) Mr Dunckley argued that they meant they wanted a four-way stop and he would have the petition re -written if he needed to. The Safety Committee recommend not to put a four-way stop at that location, but to keep the speed limit the same and put advisory signs up. There is a sign post just outside the city limits that has a seat belt sign on and a sign could be put on the same post saying reduced speed zone ahead. That is what they are recommending and not a four-way stop. Mr Dunckley claimed that the city was only concerned about east to west not north to south traffic. The mayor stated that everyone in town wants a stop sign in front of their house to slow down traffic and the city can't do that. We have adopted the national and state codes. This says if you put a four-way stop everywhere you are making it more unsafe. Bruce explained that recently when he was in Utah, there are signs that say "Reduced Speed When Lights Are Flashing" and it goes down to 20 mph. They have enforced it with a $1000 fine. Mr Dunckley told the council there isn't even signs for "School Zone". Bruce stated he felt there should be some signage on that street. Kay suggested that they would put up a sign saying "Reduced Speed Ahead" and one saying "Children Crossing or School Zone". (discussion) Mr Dunckley asked if it would make a difference if one of the council's children got hit? J. D. responded that his daughter did get hit with a car in the crosswalk with a flashing yellow light by Washington School. You can't protect people from other people who are not paying attention. The council told him they sympathized with him. The mayor told him we would look into more signage on that road. Introduction of scouts. RE: MUTUAL AID AGREEMENT DISCUSSED TOPIC: (19,118,,, I.N.E.L.,AGREEMENTS,FIRE DEPARTMENT) Spence Larson, Fire Chief- Gave a copy of the Mutual Aid Agreement to the council and explained, Rex had worked on this with the I.N.E.L., Blackfoot, Pocatello and other surrounding larger departments to establish a Reciprocal Fire Fighting Assistance Agreement. What it would mean to Rexburg is if we had a natural disaster, we could call on some of these larger departments to come to our aid and in return we would also obligate our equipment to them. We feel fortunate that we can buy into this agreement. It will allow us to pull in some aerial equipment if we needed to. As far as cost, when other departments come into our area, there is a provision to reimburse them for the fuel and oil and some of the minor things. As far as the equipment and manpower, there is no charge. This will be brought up at the next meeting. The mayor told the council, if we had a fire in a three or four story building, we don't have any ladder trucks, so with this we could use a truck with a ladder from another city. The ones that have been asked to participate in this are Rexburg, Arco, Idaho Falls, Chubbuck, Blackfoot, Jefferson Central and I.N.E.L. RE: DISCUSSION OF DIRECT ACCESS RESTRICTED ROADS TOPIC: (19,118,,, ARTERIALS,IMPACT ZONE,D.A.R.R.) Bruce Sutherland read the recommendation from the Planning & Zoning for the following roads to be designated as Direct Access Restricted Roads, -- Arterials within the Impact Zone. (1) Salem Highway, (2) Hibbard Highway, (3) Moody Road -from Salem Highway East, (4) Millhollow road from 1/4 of a mile North of the South Section line of Section 29 (from Richard Smith's South), (5) Barney Dairy Road, (6) Poleline Road, (7) Highway 33 North to Sugar City, (8) Highway 33 West (West Main St. to Mother Hibbard's), (9) Old Highway 191 (U.S. 20) from Poleline Road on the East side, North to the City Limits (to Taylor's Chevrolet). Brook Passey, Commissioner, stated that a couple of the commissioners looked at it and the Millhollow road from Richard Smith South is what they would recommend. Barney Dairy with the development out there, they questioned whether it should be labeled an Arterial? The mayor stated that Barney Dairy out past Bob Lee's home is built on so much he felt it was too late for that road. Brook said it would develops more in the future. Bruce explained these designated roads would not be allowed direct access to the road from driveways, but a frontage road. Joe told the council at P & Z there had been a lot of discussion on the Barney Dairy Road, because of the existing development along the road. Whether declaring it an arterial with any sort of control of access would be beneficial or not. The Planning Commission's main thinking indicating that they would like to see it a controlled access is so the Planning Commission would have some say in the way driveways could come onto it, maybe one driveway instead of multiple driveways and limit the number of driveways. (Tabled until the next meeting) RE: DISCUSSION OF GAS FRANCHISE FEE TOPIC: (19,118,,, FRANCHISE FEES,INTERMOUNTAIN GAS,AGREEMENTS) Gas Franchise fee. The mayor said they had met with the Gas Company and they had changed the agreement a little. He read the changes and all councilman would be given a copy to review for the next meeting. There is some frustrations, the frustration the mayor had was isn't with Intermountain Gas, his frustration is with Legislature allowing the law to come through. The things Intermountain Gas changed was: (1) to a 20 year term instead of 30 years; (2) annual payments to quarterly; (3) continuing the fee at 3%; (4) a change in the wording regarding the repair of streets; (5) the elimination of 48 hours notice due; (6) page 9 that either party can repeal the ordinance; (7) an increase in insurance. (discussion) Kay suggested that we could cancel the whole thing and go to a cutting fee. RE: BIDS FOR SEAL COATING 1995 TOPIC: (19,119,,, SEAL COATING,BIDS,H & K) Joe told the council there was only two bids for Seal Coating, Beco and H & K Contractors. H & K was the low bidder. They were below the engineers estimate and would recommend that the council award them the bid. It was a good bid. (table for next meeting) RE: DISCUSSION OF WATER AND SEWER LINE CHARGES TOPIC: (19,119,,, WATER LINES,SEWER LINES) The mayor discussed with the council that when we did the water line to the motel, the city adopted the ordinance to charge $20 a lineal foot for frontage on lots. The way the ordinance is written it is for all over town and he was not sure what the intent of the council. The early water and sewer lines were done under a G.O. Bond and were paid for by the property owners, so the developers didn't pay for hardly any of them in the city they have been paid for by the G.O. Bonds. He gave some examples. Scott Kidd is building apartments on 3rd South behind the old Golden Living Center and had to pay $820 for the lineal foot charge for sewer and water plus the hookup charge. A church ward is doing a house for a welfare project on South 5th West and their charge will be $2000 for lineal foot for water and sewer plus the hookup fee. He asked the council if their intent was to charge this fee all over the city or just in the new developments? We need to clarify that. The mayor told the council the way the ordinance reads it would be for all vacant lots in the city. There would have been some tax on the vacant lot for the G.O. Bond but not as much as a lot with a house on it. The hookup fee is to cover it. (table to next meeting) RE: CHANGES TO BE MADE AT 2ND E AND 2000 S. (POLELINE RD) INTERSECTION TOPIC: (19,119,,, 2ND EAST,2000 SOUTH,POLELINE ROAD,MADISON COUNTY) Brooke Passey told the council they met with all the utilities up at Erickson Dugway and 2nd East. In two weeks they are going to start tearing up pavement at the bottom of that swell and elevate it at least 10 feet so there is a line of sight coming over the crest of that. They looked at several options with the intersection up there and decided for the benefit of all they need to fill that in. The intersection isn't really the cause of the problem, you get a lot of students on their way to school who go up to Richard Smith's corner and come down the high school and they are going down that road with sun in their eyes in the morning and this will help for better vision.
