A motion was made by Nyle Fullmer and seconded by Glen Pond to approve
the minutes.
Introduction of scouts.
RE: SPEED LIMIT ON SOUTH 5TH WEST
TOPIC: (19,113,,, SIGNS,TRAFFIC,STH WEST,POLICE,SAFETY COMMITTEE)
The Mayor told the council that we have a petition requesting that the
speed limit on South 5th West be lowered from 25 miles per hour to 20
miles per hour, or that signs be placed between the areas of West 5th
South to West 7th South, along South 5th West, stating "WATCH FOR
CHILDREN".
There are several elementary -age children catching buses on both sides
of the street each day, as well as playing in this area daily. (copy on

We had an unfortunate accident, John Dunckley's young son was hit by a
car and was killed. The mayor talked to the chief of police. The
signing for 25 m.p.h. is probably more in line. The police chief's
recommendation is not to lower it any. Speed was not the main problem,
possibly other signs might work. We have this same problem in other
areas of the city.
Gale Harding was at the meeting and travels that road every day. He
stated that road is hard because you come down over the hill going
north. He felt the speed limit is okay, possibly more enforcement
would be the answer. Mr Dunckley felt the problem was you have people
coming in going north on a county road going 35 m.p.h. Some of the
people that signed the petition, wondered why the city can't put a 4
way stop at 7th south where the county road comes in the city so every
car will stop. The mayor said everyone would like a stop sign on their
street. Gale Harding wondered if a stop for children sign would help.
The mayor told Mr Dunckley he would turn this over to the Traffic
Safety Committee for their review. We will table the issue to the next
meeting.
RE: SPRING CLEAN UP
TOPIC: (19,113,,, SPRING CLEAN UP)
Discussion on Spring Clean Up. Every year we have done spring cleanup
and hauled free of charge yard waste. Discussion on costs involved and
what they could put out. The mayor suggested that the other
alternative would be to take nothing but yard waste and see if "D" and
"E" lagoons are dry enough and get a shredder. Glen felt we need to do
the Spring Clean up with just yard waste. Kay felt it was a nice
service and a lot of people have no way to haul their yard waste.

Gale Harding stated that last year the city did not have the coat and
people are going to want the city to do it because if they know they
have to pay $5 or $25 a load, they won't want to do it. He said the
worst thing you can do is thatch your lawn and everyone thinks they
have to do that.
A motion was made by Nyule Fullmer to do the Spring Clean up and limit
it to yard waste and look at a compost pile and shredder, with all tree
branches and limbs need to be cut in 5' lengths and tied together. We
need to limit it to one month from April 15 to May 15. Seconded by
Glen Pond. All Aye
- RE: DISCUSSION OF GEOTHERMAL WELL ON GALE HARDINGS PROPERTY

Gale Harding was at the meeting to discuss the geothermal well on his
property. He has been quite concerned about the geothermal well for
the last couple of years. This year we need to do something with that
water right. He had talked to the Department of Water Resources within
the last six weeks because they are trying to transfer some of their
other well permits, that were in his father-in-law's name over to Gales
name and they were talking about the geothermal well. This year they
need to prove that we can do something with it or the water right of
which the city applied for back in the 70's and nothing has ever been
done. The mayor told him we don't have any beneficial use for it.
Gale said he did have beneficial use and since the county gave it to
the city, he would like to lease it from the city for five or ten years
for a $1 so we could show a beneficial use so we don't loose the water
right to the people down south. He has 9.6 acres and he can prove
beneficial use by putting an electric pump in the well and using it to
irrigate. He would take care of the paper work. A motion was made by
Glen Pond that we have a lease drawn up and lease the well to Gale
Harding for $5 a year to be renewed each year. Seconded by Nyle
Fullmer. The mayor asked John Millar if there was any danger putting a
pump in the well? John said it was okay as long as it is not an oil
lube pump it would be okay. All Aye to the motion.
RE: IRRIGATION REPORT; TREE TRIMMING AT PORTER PARK

The mayor gave an Irrigation Report and told the council they are still
working on it. He also reported on the tree trimming at Porter Park.
The tree committee looked at it and Jim and Alan think they should be
trimmed but not to the extent the tree trimmer wanted to trim them. If
we do it that way, we are within the budget.
RE: GAS FRANCHISE
TOPIC: (19,114,,, FRANCHISE TAX)
Gas Franchise- The Mayor reported that he, Kay, Joe and Richard had met
and went over the proposed agreement they sent from Boise and did some
changes on it. The attorney needs to look at it and then we will fax
it over to the Gas Company. They will be here on the morning of the
21st and we will meet with a representative from Intermountain Gas.
That law has passed the legislature and it did have an emergency date
on it so it was effective the date the governor signed it.
Plan Check tabled to next meeting.
RE: RESOLUTION 95.05 APPROVING A PRELIMINARY ENGINEERING AGREEMENT ON
THE SOUTH REXBURG ARTERIAL STAGE 1
TOPIC: (19,114,RES,95.05,AGREEMENTS,ARTERIALS,SOUTH ARTERIAL,
STATE HIGHWAY DEPARTMENT)
Resolution 95-5- We approved a Preliminary Engineering Agreement on the
South Rexburg Arterial Stage 11 but we did not do it by resolution. We
need to pass a resolution to approve this agreement as required by the
State Highway Department. (copy on file) A motion was made by Jim
Flamm and seconded by Nyle Fullmer to pass resolution 95-5 All Aye
Resolution 95-4- setting fees for processing of applications for
re -zoning, conditional use permits, variances and sub -division plats.

RE: ORDINANCE 772 CREATING AN LDR2 ZONE PASSED
TOPIC: (19,115,ORD,772,LDR2 ZONE,ZONING)
Ordinance 772- This is an over site. We passed this a long time ago to
create an LDR2 Zone but did not pass the ordinance.
AN ORDINANCE AMENDING ORDINANCE NO. 725 CREATING A LOW DENSITY
RESIDENTIAL 2 ZONE; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
A motion was made by councilman Kay Beck and seconded by Glen Pond
that the rules requiring an ordinance of a general and permanent nature
to be read on three occasions be dispensed with and that said ordinance
be numbered 772.

Ordinance 772 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Glen Pond and seconded by Farrell Young that
ordinance 772 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the city council had
voted for the passage of said ordinance was duly and regularly passed.
Mayor Boyle declared the motion carried.
RE: CONSTRUCTION OF 7TH SOUTH
TOPIC: (19,115,,, 7TH SOUTH,RICKS COLLEGE)
Phase 1 of 7th South- The mayor reported, we did get the original
preliminary approval from the state that it is in there and scheduled
for construction in 1997. Last Monday, the college called and they are
concerned. During construction, in order to keep all the traffic from
going through the campus and through the city they would like
permission to put some gravel on 7th South and open it as a gravel road
immediately. As soon as it is dry enough, we will take a grader in and
push the sage brush aside and the college will hire Edstrom
Construction with a cat to push the good usable top soil to the south
and the city can haul it off anytime for the city to use. The part
that isn't good top soil they will put over where they are going to
build the baseball field and what we scrape off with the sage brush
they will haul to the baseball field. After talking to the engineers,
we felt we had to have at lease two feet of that dirt moved so when we
fill that back up with gravel, we have two feet of pit run gravel plus
for a good base on that road. They will haul eight inches of gravel on
the entire road and make a connection up on 2nd East so that road will
be travelable even starting this year during the construction phase.
The college have specified in the bid that loaded trucks and
contractors will travel that road.
Gale Harding asked about the problem on the storm drainage where the
nursing home is. The mayor said we are going to correct that.
Jim Flamm reported on the coordinating committee. They are trying to
get a long term plan. We need to get our needs to them. We need to be
aware of what is happening in the committee. (discussion)
Glen reported on the Jail Committee.
RE: DISCUSSION OF ROAD CUTS AND DIGGING PERMITS
TOPIC: (19,116,,, ROAD CUTS,DIGGING PERMITS,INTERMOUNTAIN GAS)
Nyle asked about patching the roads? The mayor reported that they
can't put in a good hot mix, but we are going to recommend to
Intermountain Gas that if they cut the roads in the winter they put in
a good cold mix, and in the summer they put in a hot mix.
Joe reported that we will open bids on seal coating on Friday.
The bids were opened on the North Highway Stop Light. The time frame
is at our pleasure when the weather permits. The bids will be awarded
now.
The mayor asked the sewer committee to stay after the meeting.
A motion was made by Nyle Fullmer and seconded by Glen Pond to pay the
bills. All Aye
