Hancock Richard Horner Joe Laird RE: TREES DONATED FOR EARTH DAY BY FOREST SERVICE & WAL MART TOPIC: (19,89,,, TREES,FOREST SERVICE,WAL MART,EARTH DAY) The Forest Service in conjunction with Walmart will donate trees for Earth Day. Anyone can go out and get trees free of charge. A motion was made by Bruce Sutherland and seconded by Nyle Fullmer to approve the minutes. All Aye RE: FINAL ORDINANCES FOR IMPACT ZONE DISCUSSED AND APPROVED TOPIC: (19,89,,, IMPACT ZONE,ORDINANCES,SUBDIVISIONS,ARTERIALS, COLLECTORS,MILLHOLLOW,BARNEY DAIRY ROAD) Richard Smith was at the meeting to present the final Ordinance for the Impact Zone. Last Wednesday the Planning & Zoning Commission met and reviewed all the testimony that was given at both the Joint City -County Public Hearing as well as the Planning and Zoning Public Hearing that was held during this last month. We went over each item and reviewed the written and oral testimony and testimony that has come in subsequent to the hearing dates. From that testimony, there were very minor changes that were made to the ordinance and a couple of changes to the map. Richard reviewed the specific changes to the ordinance. The P & Z members had some concern that the language regarding Arterials, Collectors, and Connectors that would be protected from direct access. Based upon those concerns, we drafted new language page 3 Subsection 5 of Chapter 10 portion of the ordinance. It refers to those roads as direct access restricted roads. Those roads will be designated by City Council together with the County Commission as being subject to protection from direct access. Currently he asked if this body wanted to address and adopt a designation tonight? The county did not. They adopted the ordinance but they did not make the designation. Currently the Planning & Zoning Commission would suggest that you adopt Poleline Road, Hibbard Road, Salem Highway, the Highway going to Sugar City, Moody Highway, Millhollow Road and Barney Dairy Road. The commissioners are struggling knowing what to do with Millhollow and Barney Dairy road. The mayor said after listening to Ruth Smith at the hearing and then talking to Joe after, he is not sure Millhollow hasn't already lost its value as a direct access road and that we are beyond saving any of it. He felt we should do like the County Commissioners did and make the designations at a later date. Richard said after he thought about it, probably the designation north of Ruth Smith's residence probably doesn't make a lot of sense, but from Ruth Smith's south would make sense. He said he owns that property and would not be against it being designated. With respect to Barney Dairy road there is a lot of land that is not yet developed and he has a concern that some of those parcels out there are large parcels and if they develops it into subdivisions, we will be much better off having one or two accesses from those large parcels. The commissioners agreed to specify these roads but to be timely about it. Richard suggested that two city councilman be appointed to meet with the commissioners to firm up that designation. Page 6 of the ordinance we changed subsections 9 and 10 to read the sub division ordinance should apply to smaller type developments, so it would apply to those lots less than one acre or smaller in size. Amendments to Chapter 6 -We added a new subsection 4 -which basically states that in event there is an application for rezoning requested to the commission which request any rezoning of any lot or land that lies within on quarter mile of the Sugar City Impact Zone boundary that we agree as a commission to provide Sugar City with a notice of the application for rezoning. John Millar showed the changes to the map. All changes were in response to the City -County Impact Hearing. Richard stated we have had a great deal of success with the residents in Ag 1 having their cattle indexed in through the City Clerk's office. The county met Monday and adopted the ordinance. We had a lot of people opposed to it to begin with and now we have a lot of people in favor of it. He would hope the council would take action on it tonight because he is getting calls from people in the Impact Zone that have a great deal of concern about some activities and developments that are on going and they are concerned about getting this implemented to stop any activity that might decrease the value of their land or to harm their use of their land. Bruce thanked Richard and John and all the Planning & Zoning for all the hours of work and the good job. The mayor felt it was a good job and not overly restrictive. Bruce stated that the nice thing is the people in the county have learned what zoning is for and it has been an excellent educational experience. RE: ORDINANCE 769 - AREA OF IMPACT, APPROVED TOPIC: (19,90,ORD,769,IMPACT ZONE) Mayor Boyle read Ordinance 769 for the area of Impact. ORDINANCE NO. 769 AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, PURSUANT TO IDAHO CODE, SECTION 67-6526, ESTABLISHING AND DEFINING A GEOGRAPHICAL AREA OF CITY IMPACT FOR THE CITY OF REXBURG, IDAHO, BY ADOPTING A MAP IDENTIFYING SAID AREA OF IMPACT WITHIN THE UNINCORPORATED AREA OF MADISON COUNTY; AMENDING ORDINANCE NO. 737; AND PROVIDING FOR THE EFFECTIVE DATE. A motion was made by councilman Bruce Sutherland and seconded by Jim Flamm that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 769. Those voting aye: Farrell Young Glen Pond Bruce Sutherland Nyle Fullmer Jim Flamm Those voting nay: none Ordinance 769 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Nyle Fullmer and seconded by Bruce Sutherland that ordinance 769 be passed. Those voting aye: Farrell Young Glen Pond Nyle Fullmer Jim Flamm qi Bruce Sutherland Those voting nay: none The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the city council had voted for the passage of said ordinance was duly and regularly passed. Mayor Boyle declared the motion carried. RE: ORDINANCE 770 - CHAPTER 10 AREA OF IMPACT APPROVED TOPIC: (19,91,ORD,770,IMPACT ZONE) Mayor Boyle read ordinance 770 adding chapter 10 regarding the Impact Zone and amending chapter 6 of the Zoning Ordinance. CHAPTER 770 AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, AMENDING ORDINANCE 725; ADDING CHAPTER 10 WHICH SPECIFIES THE REGULATIONS APPLICABLE 6 OF ORDINANCE 725 REGARDING THE COMPOSITION OF THE PLANNING AND ZONING COMMISSION. APPEALS OF MATTERS ARISING WITHIN THE AREA OF IMPACT, FEES AND ENFORCEMENT; AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT. Mayor Boyle declared the motion carried. RE: REQUEST BY MADISON HIGH SCHOOL TO PUT BANNER ACROSS MAIN ST. OR 2ND EAST TOPIC: (19,91,,, MADISON HIGH SCHOOL,MAIN STREET,2ND EAST,BANNERS) Val Johnson representing Madison High Musical Theatre was at the council to request putting a banner across either Main Street or Second East to advertise their play "Seven Brides fro Seven Brothers". The banner is 30" by 601. They would like to secure it with rope on light posts. They will put it 18 feet off the road and will only leave it up for ten days. The mayor told him he would need to get permission from the power company or who ever owns the poles where they want to attach the sign. The council suggested that there is a wire across Main Street by the Junior High that has been used before. RE: JERRY JEPPESEN APPROVED TO SERVE ON REXBURG REDEVELOPMENT TOPIC: (19,91,,, JEPPESEN*JERRY,COUNTY COMMISSIONERS,REDEVELOPMENT) The mayor told the council that Dell Barney was on the Rexburg Redevelopment representing the County Commission. He suggested Jerry Jeppesen to replace Dell Barney and serve on the Redevelopment. A motion was made by Glen Pond and seconded by Jim Flamm that Jerry Jeppesen serve on the Rexburg Redevelopment. All Aye RE: BID ADVERTISEMENT FOR TRAFFIC LIGHT ON HWY. 33 BY HORKLEYS TOPIC: (19,92,,, STOP LIGHTS,TRAFFIC,HIGHWAY 33,HORKLEYS) John Millar reported that they would advertise for the bids for the Traffic Light construction on Highway 33; it will be advertised for three weeks. It is the intersection out by Horkleys. It is all set to go. They will start as soon as weather permits. RE: AGREEMENT & RESOLUTION 95.04 - OBLIGATION OF THE CONSTRUCTION & MAINTENANCE OF IMPROVEMENTS TO STATE HIGHWAY 33 TOPIC: (19,92,RES,95.04,STOP LIGHTS,TRAFFIC,HIGHWAY 33,AGREEMENTS, HORKLEYS) We need to pass the agreement and Resolution 95-4 stating obligation of the construction and maintenance of improvements to State Highway 33. It also stated how much money they will put up and we will put up. A motion was made by Glen Pond and seconded by Nyle Fullmer that we accept this agreement and authorize the mayor to sign it on the Traffic Signal on Highway 33 and Salem Road with the State Highway Department. All Aye RE: APPROVAL GIVEN TO ADVERTISE FOR BIDS FOR CRACK SEALING & SEAL COATING TOPIC: (19,92,,, BIDS,CRACK SEALING,SEAL COATING,STREETS) Joe reported on the advertisement for bids for the Crack Sealing and Seal Coating for the streets. We have $375,000 this year we were going to devote to the improvements on our streets. $50,000 is for Crack Sealing which we need approval to advertise for bids. The other would be $165,000 to cover street reconstruction and overlay work. The remainder of that amount about $160,000 we would devote to a a Seal Coating process for the streets. We need approval from the council to bid the three projects. A motion was made by Bruce Sutherland and seconded by Jim Flamm to authorize Joe to advertise for bids. All Aye RE: DISCUSSION ON STREET CONDITION, REPAIRS AND COSTS TOPIC: (19,92,,, STREETS) Discussion on our streets and costs. The mayor stated if we don't start repairing the streets we will loose the roads. He reported on bills in the Legislature and possibility of the Gas Tax. He also discussed passing a bond to repair the streets. RE: RESOLUTION 95.01 APPROVED: ADOPTS STANDARDS & SPECIFICATIONS SET FORTH FOR STREETS, WATER LINES, SANITARY SEWER & STORM DRAINS TOPIC: (19,92,RES,95.01,STREETS,WATER LINES,SEWER,STORM DRAINS) Mayor Boyle brought before the council Resolution 95-1 that adopts standards and specifications set forth for streets, waterlines, and sanitary sewer and storm drains. This has been discussed at previous meetings and the changes have been made. Planning & Zoning reviewed it and recommended it. A motion was made by Bruce Sutherland and seconded by Nyle Fullmer to adopt Resolution 95-1. All Aye RE: INTERVIEWS FOR FIRE CHIEF TOPIC: (19,92,,, FIRE DEPARTMENT) Nyle Fullmer reported they got about 132 applications for the Fire Chiefs position and they have narrowed it down to six finalist. They have been asked to come and interview and also take a physical. They have also asked five finalist to take the physical agility test also those for the basic fireman's position. We also have four full timers that have applied for the position. We will do the interviews on February 25. They will make the decision shortly there after. RE: REPORT FROM THE AIRPORT BOARD MEETING - PUBLIC HEARING SET TOPIC: (19,92,,, AIRPORT,PUBLIC HEARINGS) Nyle reported from the Airport Board meeting and that there will be a public hearing on March 15, at 6:30 P. M. concerning the ongoing planning efforts for the Site Selection, Environmental Assessment, and Airport Master Plan Richard Smith reported that they had met with Armstrong Associates and they brought them up to date on what they have done on the Airport plan and gave the airport board some options for expansion at the current location. RE: RESIDENCY REQUIREMENTS FOR CITY EMPLOYEES TOPIC: (19,93,,, EMPLOYEE'S MANUAL,RESIDENCY) The mayor stated that for sometime we have been discussing the Residency Requirements for City Employees. We need to finalize the '.. employee manual so we need to make a decision on it. It would have to be for all employees except the Joint City County Fire Department. A --- motion was made by Glen Pond that we require City Residency for new city employees with the exception if someone wanted to live outside the city they would have to get approval from the City Council. That does not affect the employees working for the city now living outside the city. The motion was seconded by Bruce Sutherland. All Aye.
