A motion was made by Glen Pond and seconded by Kay Beck to approve the

RE: ANNEXATION ORDINANCE DISCUSSED - WALTERS READY MIX
TOPIC: (19,76,,,ANNEXATIONS,WALTERS READY MIX,PUBLIC HEARINGS,

The mayor discussed the annexation ordinance. The attorney for Walters
Ready Mix came to the last meeting and objected to Walters being
annexed to the city. The mayor, Nyle Fullmer, Jerry Rigby, met the
other day to discuss the annexation. There are some things he would
like to check, one is which Walters would like to open 5th West. With
that and the legal questions, the mayor and Nyle felt they should drop
the annexation of the Walters property right now and do some checking.
J. D. said we would not have to have another hearing to take them out
of the annexation. When we do annex them, we will have to hold another
hearing, but will not be able to annex them until we pass the Impact
Zone.
A motion was made by Jim Flamm to delete the Walters property from the
annexation, but resolve it within 6 months. Seconded by Farrell
Young. All Aye.
RE: ORDINANCE 767 - ANNEXATION OF CERTAIN LANDS, PASSED

CLINGER*ARGUS)
The mayor read Ordinance No. 767- AN ORDINANCE ANNEXING CERTAIN LANDS
TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME
A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE
ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND THE MADISON COUNTY,
REXBURG, IDAHO, AND THE MADISON COUNTY- REXBURG COMPREHENSIVE PLAN 2000
TO SHOW SUCH ANNEXATION AND THE CLASSIFICATION OF THE SAME UNDER THE
ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO: AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE. (annexing Cook property, south
highway Spuds, Piece Goods, Thompson Rental, High Country Potato, all
property on the West side of the road going south out of town, and
Argus Clinger property).
A motion was made by councilman Glen Pond and seconded by Kay Beck that
the rules requiring an ordinance of a general and permanent nature to
be read on three occasions be dispensed with and that said ordinance be
numbered 767.

Ordinance 767 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Glen Pond and seconded by Kay Beck that ordinance
767 be passed.

The roll showed all councilmen present voting "Aye" carried, the Mayor
declared that the majority of all the members of the City Council had
voted for the passage of said ordinance was duly and regularly passed.
Mayor Boyle declared the motion carried.
RE: BEER LICENSES
TOPIC: (19,77,,,BEER LICENSES)
Mayor Boyle read beer licenses to be approved. Broulims, One Stop
(Spuds), Oasis Country Market, Rexburg Food Center and K & R Lanes.
A motion was made by Glen Pond and seconded by Jim Flamm to approve the
beer licenses. All Aye
RE: REPORT ON THE STREET LIGHTS
TOPIC: (19,77,,,STREET LIGHTS)
Glen reported on the street lights. The list was given to the power
company and they have looked at them and determined that there could be
larger lamps put on the poles. They will put larger lamps on them
after the first of the year and the council can look at them and see if
that will solve the problem.
RE: AGREEMENT FOR PROFESSIONAL ENGINEERING, SURVEYING AND MAPPING

Agreement for professional Engineering, Surveying and Mapping. Joe
explained the changes that had been made. A motion was made by Glen
Pond to pass the agreement with the engineering company. Seconded by
Kay Beck. All Aye.

RE: APPROVAL OF EMPLOYEE'S MANUAL, WITH CORRECTIONS
TOPIC: (19,77,,,EMPLOYEE'S MANUAL)
Employee Manual- There are a few corrections and typos. 404 Sick Leave
Bank Eligibility- "Those eligible for monthly retirement."
715 Security Inspections- Insert (except for law enforcement officers,
who use these in the performance of their duties.)
104- Leave the word first out.
507- 2nd Paragraph leave out (Police & Fire).
603- Scratch last sentence on first page.
703- Drug Testing- Time and place of test (as designated by the city)
705- change (Fit for duty)
109- Glen discussed, what is a relative? J. D. explained it is defined
in the State Statute, 2nd degree of kinship. (clarify)
A motion was made by Jim Flamm to approve the Employee Manual with the
corrections. Seconded by Farrell Young. All Aye. The council can
make exceptions on working procedures as noted on the first page.
RE: CLEANING OF SIDEWALKS - DOWNTOWN REXBURG
TOPIC: (19,77,,,SIDEWALKS,BUSINESSES)

The mayor stated he had a call about sidewalks. Aldene Smith called
and asked who cleans the sidewalks on the down town Rexburg? She is
blind and she can't get down the street, especially if the building is
empty, the sidewalk is not cleared. (discussion) Jim Flamm suggested
that we work with the Chamber to put pressure on the merchants. Clair
Boyle will put it on the Chamber agenda.
RE: ERIC ERICKSON APPOINTED TO THE PLANNING & ZONING COMMITTEE
TOPIC: (19,78,,,PLANNING & ZONING)
The mayor told the council he would like to appoint Eric Erickson on
the Planning & Zoning as a member of the Impact Zone. He will
represent the home owners. Jerry Jeppesen recommended him. A motion
was made by Glen Pond and seconded by Jim Flamm to appoint Eric
Erickson to the Planning & Zoning. All Aye.
The mayor stated that the city would like to thank Jerry for his help
as a member of the Planning & Zoning representing the Impact Zone. He
has worked long and hard. The city will present him with a plaque.
RE: MAYOR TO SIGN SUBSCRIBER AGREEMENT WITH I.C.R.M.P. INSURANCE

The mayor discussed with the council the subscriber agreement that
needs to be signed with I.C.R.M.P. There is a 14~ decrease in the rates
for next year. A motion was made by Kay Beck and seconded by Glen Pond
that the mayor be authorized to sign the Subscriber Agreement for next
year with the I.C.R.M.P. Insurance. All Aye.
RE: PROBLEMS WITH PARKING IN LOT BY ANDERSON PHOTO; LOT TO BE POSTED 2
HOUR PARKING

Jim Morris came in the other day to discuss the parking problem in the
parking lot between his shop and Anderson Photo. Awhile ago we let
I.N.E.L. employees park in the lot down on the far end. There is still
a problem with parking up in the front of the lot. Jim Morris would
like us to put the first half of the lot in two hour parking. Some of
the people from apartments are parking their cars in the lot and never
moving them. We would need to poet it for two hour parking. Jim Flamm
stated that when we gave I.N.E.L. permission to park there, they were
to go to the back of the parking lot during the day and they are not
doing what they agreed. They are filling up the front spots and also
the people that rent apartments are parking over there and filling up
the lot. (discussion)
A motion was made by Kay Beck and seconded by Glen Pond to poet and
enforce the front (east end) of that parking lot for two hour parking
from 6 A.M. to 6 P.M. All Aye
RE: RECOMMENDATION FOR STATE FUNDING FOR OUTDOOR RECREATION
TOPIC: (19,78,,,PARKS AND RECREATION)
The Parks and Recreation Department Enhancement. They are are
recommending the state set up a fund for public outdoor recreation.
The state would like to set up a trust for Outdoor Recreation. The
concept is good. A motion was made by Glen Pond to approve the
concept. Seconded by Jim Flamm. All Aye
Glen suggested that we go into an Executive Session on personnel.
RE: PLOWING OF CHURCH PARKING LOTS
TOPIC: (19,78,,,PARKING LOTS,TOWING,CHURCHES)
Farrell stated that they have had a hard time plowing the church
parking lots because there has been as many as 25 cars parked in them
and the lots are posted. Farrell said the had signed a complaint but
they still did not get towed away. (discussion on towing)
RE: DISCUSSION OF HIRING A NEW FIRE CHIEF

Farrell also stated that he had someone suggest to him that as we hire
a new Fire Chief that we consider hiring a Director of Public Safety
that would handle the Fire Department and the Police Department as far
as supervisory responsibility. The mayor said he had checked into that
and there is only one in Idaho. Glen said, Rex fights fire and if we
had a Director of Public Safety, we would have to hire for two
positions. He did not think we were a big enough city or had the
finances to do it, but the concept is good. (discussion)
A motion was made by Glen Pond to pay the bills, seconded by Jim
Flamm. All Aye
A motion was made by Glen Pond and seconded by Kay Beck to go into a an
executive session. .All Aye
