RE: DISCUSSION OF ORDINANCE 761 CONCERNING INSPECTION OF APARTMENTS
TOPIC: (19,42,,,ORDINANCES,APARTMENTS,INSPECTIONS)
Ordinance 761 for inspection of apartments. Joe and Jim had some
questions before we pass the ordinance. The mayor stated we could pass
it for the 2nd reading only. Jim had questions on Section 10, Section
it and in the old ordinance in Section 7 and Section 9B. Joe had
question of the definition under "purpose", he would like to see it
more restrictive. Also Section 10. He questioned the fee for
inspections. Section 8 and Section 12, Section 14. They gave their
questions to the attorney for him to make the changes. We will get a
copy of the changes out to the council before the next meeting.
RE: STORM DRAIN PROBLEM BEHIND ARDS GLASS AND PAINT
TOPIC: (19,42,,,STORM DRAINS,ALLEYS,ARDS GLASS & PAINT)
Alley behind Ard Glass and Paint. The mayor explained after looking at
it, the only thing that could be done is to put in a french drain and
asphalt it. This is not a city problem, it is a personal problem. The
council agreed. The city has no title or easement to the alley. There
is another alley 150 feet south, which we have an easement for. Joe
stated that even if we say it is a city alley, it doesn't change the
paving of it. The only way we could pave it is through an L.I.D, but
it would be easier for them to put in the french drain and pave it
without putting it on an L.I.D
The mayor told the council that he was not able to check on the
direction signs. It will be tabled to the next meeting.
RE: CAFETERIA PLAN DISCUSSED
TOPIC: (19,42,,,CAFETERIA PLAN,CHILD SUPPORT)
Richard discussed some Cafeteria Plan Amendments, which are just
Housekeeping changes. One of them designates the council as the body
to amend or terminate the cafeteria plan. The second one is a new item,
which is called Qualified Medical Child Support Order policy. This
states how we will handle this if necessary. If someone has rights to
the cafeteria plan under the Cobra Act, they will have rights to be
part of the cafeteria plan and have rights under the plan. We need
that stated in our document. Nyle Fullmer suggested that we have J. D.
review it and table it to the next meeting.
RE: ANNEXATIONS

Mayor Boyle discussed the annexations that we are planning. We would
like to get it done in October or November. We have the property
description for Walters property. Joe is working on the property out

by Spuds and south of Rexburg. He also explained the annexations of
the Railroad and road. A discussion on annexing the Clinger property.
RE: ITEMS FOR SURPLUS SALE

We have items for Surplus Sale: #11 1975 G.M.C. 10 Wheeler Dump Truck
13 Speed transmission. #12 1975 G.M.C. 10 Wheeler Dump Truck 13 Speed
transmission. F12 Cat Grader Standard Transmission, F12 Cat Grader
Automatic Transmission with dozer attachment. Farrell would like
permission to advertise these for sale. Glen asked if it was worth our
while to sell them or should we use them for backup? (discussion) A
motion was made by Kay Beck to proceed and see what we can get out of
them. Seconded by Jim Flamm. All Aye.
Easter Idaho Special Services wants each councilman to fill out a Needs
Assessment Form and send it back to them.
RE: DISCUSSION OF PROVIDING FREE WATER TO VACANT LOTS
TOPIC: (19,43,,,WATER,VACANT LOTS)
DeLynn wants us to talk about providing free water to vacant lots. The
mayor was convinced that there is abuse, because they drove by the
other day and there were two different people watering their gardens
off the free water hose, the property is owned by Mickelsen but taken
care of by Owen Leishman. There is another one that Dr Lovell owns and
has landscaped and is watering. There are two or three others. Kay
Beck made a motion that we tell them January 1 and it is all over.
Seconded by Nyle Fullmer. Farrell asked if we want weeds or grass?
Nyle felt that if we are having the obvious abuse, then that is wrong.
The council had heard that Owen Leishman won't let the kids play on the
yard. It is great to look at, but no benefit to the city. If it were
used for a park, it would be a good idea. The council felt they needed
to see a full list of lots getting free water. (discussion) If the
lots were open for public use as a park, there wouldn't be a problem.
The mayor felt we should get a complete list and more information
before we vote and table it for the next meeting. Kay withdrew his
motion.
RE: PROBLEMS WITH STUDENTS PARKING ON COLLEGE & REED AVENUES
TOPIC: (19,43,,,COLLEGE AVENUE,REED AVENUE,PARKING,POLICE)
The mayor told the council we received a letter from Richard G Taylor,
who lives on College Avenue. We also had a complaint from Reed
Avenue. The people on College Avenue were concerned about students and
faculty that park on College Avenue all day long and they can't get in
to their houses. The people on Reed have the students from high school
that park there all day long. Sometimes they park in front of the
mailboxes and post office won't deliver their mail and they move the
garbage cans out of the way so they can park. (discussion) Glen said
the experience we had on Madison Avenue, was they want the restriction
on and then they want it off and the police don't know when to ticket
them. The mayor asked Nyle Fullmer to have the police and his
committee check it out and report back at the next meeting. There are
also problems on Cornell.
RE: DISCUSSION OF ENGINEERING ON THE INDUSTRIAL PARK
TOPIC: (19,43,,,INDUSTRIAL PARK,FORSGRENS,CITY ENGINEER)
A question on Engineering on the Industrial Park. We put in for that
grant and Forsgren has always done these in the past. It might be
easier to have Joe as the engineer and then just hire out the surveying
and some of those other things. Joe stated that it is a pretty good
size project and we would have to have aerial photography or a survey.
There would be improvement drawings to do which would be a subdivision
type drawing. Joe would prefer to have the control and direct the
work. The council agreed. Joe could design what he wanted to do and
put out a bid package with a time frame.

RE: DISCUSSION ON THE NORTH HIGHWAY PROJECT
TOPIC: (19,44,,,NORTH HIGHWAY PROJECT)
Discussion on the North Highway project. It won't get done this year
because Forsgren didn't get the engineering done in time. Dick Dyer
was in charge of it until about one month ago when they turned it over
to John Millar. Discussion on the Treatment Plant.
RE: BID OPENING FOR 3RD SOUTH PROJECT

The mayor reported that we opened the bids on 3rd South. The bids came
in about $25,000 over the engineers estimate. We rejected the bids and
we will have Farrell, Joe and Kay take the bids for next year for
street maintenance and they will include this and get them all ready to
bid early next spring.
RE: PROGRESS OF THE WASTEWATER TREATMENT PLANT - ALSO, STREET LIGHTS
DISCUSSED

Jim Flamm reviewed the Wastewater Treatment Plant progress. Jim also
mentioned that as the new developments come in we need to make sure
there are street lights put in them, also some of our street lights are
out or dim. The mayor said anyone can call the city and we will have
Utah Power take care of the lights that are our or have problems. Nyle
said he would have the police do a light survey. Glen Pond said Utah
Power will fix any that need fixed if they are contacted about them.
RE: STREET LIGHTS IN SUBDIVISIONS - SHERWOOD HILLS

Joe said street lights are required in the Subdivision Ordinance.
Sherwood Hills does not have lights in it. Nyle Fullmer asked if Joe
could draft a letter to that developer.
Glen Pond reviewed the Planning & Zoning Meeting.
A motion was made by Glen Pond and seconded by Nyle Fullmer to approve
the bills. All Aye

RE: CITY EMPLOYEES DUMPING IN FIRE STATION DUMPSTER
TOPIC: (19,44,,,DUMPSTERS,CITY EMPLOYEES,ILLEGAL DUMPING OF GARBAGE)
After reconvening Rex Larson told the council that there are a lot of
employees dumping in the dumpster behind the fire station. Some unload
pickup loads of garbage. Rose told the council there were some
employees that live out of town that pay the city a garbage fee to dump
in the dumpsters. The council stated that we need to tell the
employees that they could not dump in the dumpster and that those
employees living out of town would not be allowed to bring their
garbage in to the city even if they paid for it.
RE: DRIVING THE WRONG WAY IN THE ALLEY BY CITY HALL
TOPIC: (19,44,,,ALLEYS,CITY HALL,CITY EMPLOYEES)
Glen Pond stated that many employees are driving through the alley
behind the city hall the wrong way. A lot of people have mentioned
it. The mayor said he would notify the employees.
