Pledge to the Flag.
The mayor told the council he got a letter from "Operation Life Saver"
to invite any city employees or the city council to go to Idaho Falls
and have a one hour ride on the train and they explain Operation Life
Saver on September 28.
A motion was made by Jim Flamm and seconded by Nyle Fuller to approve
the minutes. All Aye
RE: NOISE PROBLEM ON MAIN STREET
TOPIC: (19,33,,,NOISE,POLICE,MAIN STREET)
Mayor Boyle made a report on the Noise Problem on Main Street. The
police looked into buying a decibel meter, but are still not convinced
that is the way to go. They have given three tickets to youth with
really loud mufflers, and charged them with disturbing the peace.
Steve Zollinger stated that he recommended they get the decibel meter.
It would be the easiest way to enforce it. The mayor said we would
follow through with that and see if we can take care of it.
RE: ORDINANCE 760 FOR WATER & SEWER LINE FEES FOR THE DEVELOPER PASSED

Ordinance 760 for Water and Sewer Line Fees for the developer to pay
for the line. (discussion) The mayor explained the ordinance.
PROVIDING THAT A CHARGE OF $10.00 PER LINEAL FOOT OF UTILITY LINE FOR
PROPERTY ABUTTING EITHER OBTAINING A PERMIT TO CONNECT TO THE WATER OR
SEWER MAIN CONSTRUCTED SUBSTANTIALLY AT CITY EXPENSE; PROVIDING FOR
REIMBURSEMENT TO THE CITY FOR THE COST OF ANY SUB-OUTS ACCESSING
PRIVATE PROPERTY; PROVIDING FOR FEES TO BE SET BY RESOLUTION OF CITY
COUNCIL; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by councilman Glen Pond and seconded by Kay Beck that
the rules requiring an ordinance of a general and permanent nature to
be read on three occasions be dispensed with and that said ordinance be
numbered 760.

RE: 1ST READING OF ORDINANCE 761 - APARTMENT INSPECTION ORDINANCE

The mayor read Ordinance 761 the apartment Inspection ordinance.
AN ORDINANCE AMENDING SECTION 6 (a); DELETING SECTION 7; AMENDING
SECTIONS 9 (a), 10, 11,(a); DELETING 11 (b): AMENDING 16 (a) AND 16 (d)
OF ORDINANCE NO. 684 OF THE CITY OF REXBURG, IDAHO, REQUIRING AN
INSPECTION OF RENTAL DWELLINGS AT LEAST ONCE EVERY FOUR YEARS;
PROVIDING FOR A FEE FOR INSPECTION; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE. Steve Zollinger explained the ordinance.

RE: SIDEWALKS IN CITY DISCUSSED - ESPECIALLY MILLHOLLOW

Next on the agenda Sidewalks. The mayor explained that in August we
passed a resolution on sidewalks. As long as he has been on the
council, never have we talked about forcing all the homes along
Millhollow to have sidewalks. That is one street in the city that it
would be hard to put in sidewalks, because that is the only street in
the City of Rexburg that we do not have adequate right-a-way. On the
upper part of Millhollow, we own back of curb to back of curb, so there
won't be any sidewalks on upper Millhollow unless we get a lot of money
to buy right-a-way to put sidewalks in. He has also had a lot of
complaints about lack of sidewalks. The council has decided that we
need to enforce the law that has been on the books since 1968 and
require every house from now on to have a sidewalk.
RE: SIDEWALK AT TONI LUSK HOME DISCUSSED - 546 EDITH CIRCLE

Toni Lusk- 546 Edith Circle- This resolution was passed in August and
her building permit was issued in April. She was not informed about
the sidewalk. Her builder went through all the paper work they had and
could not find anything on it or on the house plans so when she had
taken out a mortgage at the bank they did not plan on sidewalks and
could not come up with the money now. Blair Manwaring came to her
after she had moved in the house and told her she had to have five foot
wide sidewalks. She had come to city hall and talked to Joe Laird and
he told her the law was passed in March. The mayor told her the law
was always there and the resolution just defined the width. Joe Laird
stated that her plans had a five foot sidewalk on them. Toni complained
that Farrell Davidson came up after they had put in the landscaping and
sprinkling system and said the city was tearing out the curb to put in
a handicapped access. She did not think that was very good
organization. (discussion on the landscaper being told about the
sidewalk) Toni felt a sidewalk should go in under an L.I.D. The mayor
told her to bring in a copy of her plans. Toni stated that they also
tore her lawn up to put in a handicapped access. Toni complained that
she had not been notified about the sidewalk until she was in the house
for one week. Kay told her the safety committee and sidewalk committee
were the ones that recommended the sidewalk, but the law has been there
since 1968. Sometimes you have to do things just to be a good neighbor.
RE: NEED TO BE UNIFORM ABOUT SIDEWALKS - MAILBOXES, SIZE, ETC.

Jim stated that everyone we talked to says yes we need a sidewalk but
we need to be uniform. We have avoided telling people what they don't
want to do, and we can't do it anymore. He suggested that we take some
time and see if we can figure out a plan and do an L.I.D. There will

have to be some adjustments and give and take. He suggested that the
people that live on that street get together and figure out what they
can do.
The mayor stated the post office would like to get the mailboxes off
the sidewalks and they will help with the cost. All subdivisions from
now on will have all the mailboxes in one spot.
Jim suggested that he and Kay work with some of the people in that area
and see if we can work it out. Kay said if we could get rid of the
mailboxes on the sidewalks, there would be no problem going back to the
four foot sidewalks.
Isabelle Johnson- 515 East 1ST North- She would have to take out shrubs
and trees and move her sprinkling system. She is a widow and living
off her social security and she does not have the money to move
everything. It cost her $100 to move one tree. She has large pine
trees. She just does not have the money. Kay said that is why there
is not an easy answer and there has never been the talk of going back
and insisting that someone that is already in has to put in a
sidewalk. Mrs Johnson said when she moved here in 1989 no one told her
about sidewalks. She moved from California and everyone there had to
have sidewalks. The children walk in the middle of the road and they
will not use the sidewalks, if they have them. She complained about
the people going through the stop sign by her house.
Mrs Halterman- 14 North Millhollow- It would be hard to walk up
Millhollow in the winter to get the mail. She appreciated her mailbox
right where it is. It is icy and very steep on Millhollow in the
winter. The kids don't use the sidewalks because they all want to gang
together. If the sidewalks would have been put in when the house was
built, that would have been okay. It will be hard to tear down the
trees. Kay stated that there has been no mention of forcing the people
to put in sidewalks that already have their homes built. It was
recommended by the safety committee that we ask people to do it.
Venese Leishman- Complained about the speeding on that road. It is not
patrolled and is dangerous.
Steve Meikle- 25 Millhollow- He is in the middle of construction and
did sign a letter stating that he would put a sidewalk in. He would be
the only one on that side of the street with a sidewalk. He did
realize you need a sidewalk, but not to have one person on one side of
the street put one in. He felt we should look at it and have it
developed so there isn't just 4 or 5 houses with sidewalks. That
morning he had passed 33 children walking in the road on 2nd South and
only 2 people on the sidewalk.
Susan Bodily-She walks every day and it is easier to walk on the
sidewalk. At this time she does not have a sidewalk, however she is
making arrangements to install a sidewalk in the next 18 to 24 months.
Because she lives near Millhollow Road she is a frequent user of this
road to walk. She has noticed a lot of children and other people
walking on this road and dodging vehicles. With over 14,000 people
Rexburg is no longer a rural town. We live within walking distance of
schools and stores and a hospital with a helicopter and for safety we
need sidewalks. We need to look into it before we put an L.I.D. in,
because it sometimes is more expensive than putting in your own
sidewalk. She discussed sidewalks.
Jan Wright-237 Maryanne- She was in favor of sidewalks. On North 5th
West there in no sidewalk. There are a lot of children going to school
along that street and they have to walk in the street. It is a safety
factor.
Linda Taylor- 138 Aries- She is the president of the P.T.A. She has had
a lot of parents express their concern to her, because a lot of the
students have to walk and they do not have sidewalks. Her concern is
if it would save a life of one child it would be worth it.

Graydon Burton- You can't walk on the sidewalks on Main Street without
breaking an ankle and branches hit you in the face. The sidewalks are
in such poor condition.
Sharon Daniels- 125 Millhollow Drive- they have lived there for 24
years. They have 380 foot of frontage. When the street was paved they
took more than was allowed in an easement off the front of their
property. We have 40 foot pine trees, about 150 foot of cedar fence,
three rows of bushes and flowering trees, and sprinklers. Behind that
fence, if a sidewalk was put in, you would have to build it like a
bridge, because there is no ground under it. Between them and Joe
Romney's house, there is the same problem. I would hate to see one
house with a stripe of sidewalk and three or four houses without
sidewalk. She felt that the speed limit should be more controlled up
there. We have worked to make the yard beautiful and it would be
tragic to have to take it out. She felt sidewalks should have been
planned before all the landscaping was put in.
The mayor told her that along where she lives the city right-a-way is
only 40', back of curb to back of curb. Kay told here that along her
area there had not been any discussion on sidewalks.
RE: PUBLIC HEARING FOR BUDGET
TOPIC: (19,36,,,PUBLIC HEARINGS,BUDGET,FRANCHISE FEE,GARBAGE)
8:15 P. M. Public Hearing for the budget. Richard gave out handouts
and explained. (on file) The mayor explained the county charge on the
taxes for garbage vs the city charge and the amount they would charge
the city for the tonnage on garbage.
Pat Burton asked about the franchise charge for Total Electric homes.
The mayor said he had a call from Grant Hope and Boyle Summers, who
have electric heat. They felt the franchise fee should be on the gas
heat. We would like to raise the money with a qas tax, but we need to
tell our legislators. A.I.C. is trying to increase the gas tax and if
they succeed, we will lower the franchise fee.
Pat Burton stated it would be a more fair way. Glen Pond told them we
could raise the registration fee on vehicles, that is an option the
state has, but they have neglected doing so. We need to work on the
Legislators. The residential people will pay their share but the
commercial people will pick up the greater amount.
Ed Hoopes- In Boise when they pass something, they dump it into the
general fund and we don't see any.
Budge Clay-437 West 6th South- He hasn't had his garbage picked up
since March 21. He has a compose pile, and he recycles everything he
can. He believes that if everyone in the city would take account of
what they are doing with garbage, they could cut it down.
Jim Nielson- The reason some people don't have very much garbage, is
they put it in his bin.
(discussion on the mess behind J. C. Penny) The mayor told them we are
going to pass an ordinance with a fine for putting garbage in someone's
bin.
Budge Clay- If anyone catches him he would be glad to pay.
The costs are going up because of unfunded mandates and the A.I.C. is
working with Senator Kempthorn to stop unfunded mandates. Richard
explained the garbage fees and the reason for rate increase.
Discussion on sewer rates and how sewage is measured.
Jim Nielson- He owns a laundry and 25~ of his water goes out the stack
because they dry it and don't put it down the drain. The mayor told
him the only option he would have is to buy a meter for the sewer and
those are expensive. The mayor explained about the grants vs the

government only loaning the money. Jim said his bill jumped about $100
from January to July.
Richard explained the tax levy rate, showing a scale.
Bryan Birch- Stated that with the sewer figured over the winter months,
it isn't fair because his water increased over the winter with college
students and decreases in the summer. He asked about extending the
contract on the wastewater. If we extend the contract, we might need
to repair or add to the plant in 15 years.
Joe Romney- You are talking about grants. We need not to use federal
grants unless we need them, because we pay for it. The mayor explained
and explained A.D.A. requirements.
Kerry Park- questioned the increase in golf course fees? Richard
explained.
Budge Clay- He is not objecting but he reads his own water meter and
all he uses is 4000 gal a month and is charged for 6000 a minimum and
asked about his garbage fee? The mayor explained the fee and minimum
water fee.
Barbara Jaussi- Questioned why we have to make the tabernacle
handicapped accessible? Glen explained the A.D.A. regulations.
Barbara also questioned the recreation funds? Richard explained that
most of the money is raised by the people that use the recreation.
Glen told her that sometimes we have to take pride in our city to have
nice parks and recreation facilities.
RE: ORDINANCE 764 ANNUAL APPROPRIATION ORDINANCE FOR 1994-95, PASSED

Mayor Boyle read Ordinance 764, the annual appropriation ordinance.
AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF
REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1994 TO SEPTEMBER 30,
1995, AND APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS
OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED
FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE
NECESSARY OR ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED
NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND
LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1995.

RE: ORDINANCE 762 - THE U.P.L. FRANCHISE FEE ORDINANCE, PASSED

The mayor read Ordinance 762 the U.P.L. Franchise ordinance. AN
ORDINANCE AMENDING THE FIRST AND LAST PARAGRAPHS OF SECTION VII OF
ORDINANCE NO. 651, INCREASING THE UP&L FRANCHISE FEE FROM TWO PERCENT
TO SIX PERCENT: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH: AND PROVIDING THE EFFECTIVE DATE OF THIS ORDINANCE.
Glen Pond asked if in March when we can raise the gas franchise tax,
will we collect the extra revenue from the gas franchise fee or will we
then lower the U.P.L. franchise fee to off set the income coming from
the gas franchise tax? The mayor stated that he thought we should
lower the U.P.L. franchise fee at that time and even go further and if
the State passes increase of any tax, that we lower the U.P.L.
franchise fee as well. To balance the budget right now we have to do
it this way. The council agreed that if we get the extra revenue from
the gas company, we could lower the U.P.L. franchise fee for that
amount.

RE: ORDINANCE 765 - A GARBAGE ORDINANCE ESTABLISHING A FEE FOR
UNAUTHORIZED DEPOSITING OF REFUSE IN OR AROUND THE GARBAGE CONTAINERS
OF ANOTHER, PASSED

Mayor Boyle read Ordinance 765 a garbage ordinance establishing a fee
for unauthorized depositing of refuse in or around the garbage
containers of another without the containers owner's consent.
AN ORDINANCE PROHIBITING LITTERING; PROHIBITING THE UNAUTHORIZED
DEPOSIT OF REFUSE IN GARBAGE CONTAINER(S) BELONGING TO SOMEONE ELSE;
DEFINING NON-RECYCLABLE GARBAGE; OBSTRUCTING DUMPING OF CITY GARBAGE
CONTAINERS; SETTING FORTH FREQUENCY OF COLLECTION AND CHARGES FOR
COLLECTION SERVICE; ESTABLISHING CIVIL PENALTIES FOR ANY VIOLATION
THEREOF: AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
Steve Zollinger explained. Sherwood Ricks stated that he has an office
out in the building of the Oasis and the Oasis has a R.V. dump site.
When people come to use the dump site, they put their garbage in his
dumpster. Jim Flamm stated that we need a sign painted on each
container. Nyle Fullmer told Mr Ricks he is in a bad situation with
the dumpster next to the dump site. The council felt that the fine
needs to be $300 and it needs to be a fine for dumping around the
dumpster. Richard explained that some of the wording on the not
allowed items needs to be changed
A motion was made by councilman Glen Pond and seconded by Nyle Fullmer
that the rules requiring an ordinance of a general and permanent nature

the ordinance with the wording changes that have been so designated and
to change the fee to $300 and it be numbered 765.

RE: REQUEST FOR THE CITY TO PUT A STORM DRAIN BEHIND ARDS GLASS & PAINT

Don Ard and Dr Walker were at the meeting to request the city to put a
storm drain behind Ards Glass and Paint, Dr Walkers and Davenports.
That alley is a mess, it is a mud hole. They would also like some help
to pave the alley. The mayor stated that it is a real problem. The
storm drain is on Main Street. There is a big hole there in the
alley. Kay suggested that Joe go look at it. That is not a city
alley. Discussion on if the alley could be closed. Nyle stated that
he did not think it was the city's responsibility to provide the
drainage on the alley. Steve explained that because the alley had been
used over a period of years as a public alley, there is a prescriptive
right. Joe suggested that possibly a french drain would work, but it
would need to be paved to make it work. Mr Ard said they would like to
request the city to put in a drain and they would pave it. Joe would
look at it and report back.

Mayor Boyle read Resolution 94.6 to increase the garbage rates. A
motion was made by Jim Flamm and seconded by Farrell Young to pass

The Mayor read Resolution 94.7 to increase the wastewater rates. A
motion was made by Kay Beck and seconded by Nyle Fullmer to pass

The Sign Ordinance would be tabled to the next meeting to give the
council a chance to review it.

RE: ORDINANCE 763 TO AMEND ORDINANCE 755 & 756 FOR THE ANNEXATION OF
COMFORT INN PROPERTY, PASSED

Mayor Boyle read Ordinance 763 to amend Ordinance 755 and 756 for the
Annexation of the Comfort Inn property.

DESCRIPTION OF THE LANDS ANNEXED TO THE CITY OF REXBURG, IDAHO: AND

RE: BIDS FOR THE 3RD SOUTH STREET WORK

The mayor told the council that we were unable to open the bids for the
3rd South work. They would be opened on Friday and we need approval so
we can start. A motion was made Kay Beck and seconded by Glen Pond to
authorize, due to the pressing weather, the mayor and engineer to
accept the low bid. All Aye

The mayor discussed with the council, Ralph Hall has taken back K & R
Lane Bowing alley. He managed the bowing alley previously and had a
utility bill which he always kept current, but he is just leasing the
building, can we wave the $200 deposit. A motion was made by Nyle
Fullmer and seconded by Kay Beck to wave the deposit. All Aye
RE: SIDEWALK FOR MICKELSENS DISCUSSED

Kay Beck asked, "Do we allow exceptions on the sidewalk for Mickelsen?"
We gave him ample notification on it. Steve Zollinger stated if we let
him leave it in he will have to get a variance and it won't meet the
criteria for a variance. The council felt we should just follow
through with it and make him correct the sidewalk.
RE: SIDEWALK FOR TONI LUSK DISCUSSED

Kay asked about the sidewalk for Toni Lusk? The council felt that she
needed to bring in her plans and see if they show a sidewalk. If they
were shown on the corrected stamped plan, she needs to put it in.

Steve Zollinger stated that her plans have no legal bearing unless
stamped approved. Nyle Fullmer suggested that it would be helpful to
have a change order list signed.
Steve also suggested that we could have a limited grandfather
regulation, requiring if the property is sold that a sidewalk be put in.
A motion was made by Nyle Fullmer and seconded by Farrell Young to pay

RE: DISCUSSION OF SALARY RANGE SUMMARY

Richard discussed the Salary Range Summary. (handout on file)
Discussion on the Sanitation Driver. A motion was made by Nyle Fullmer
and seconded by Farrell Young to leave the scale for Sanitation Driver
as Richard has it on the summary. All Aye
Wastewater Line- Discussion. A motion was made by Glen Pond and
seconded by Kay Beck to leave it where it is and not change it. All Aye
Lab Technician- The range we have is in the ball park. A motion was
made by Kay Beck and seconded by Farrell Young to leave the range where
it is now. All Aye
A motion was made by Kay Beck and seconded by Nyle Fullmer to approve
the range for the Plant Operator. All Aye

Wastewater Superintendent- A motion was made by Jim Flamm and seconded

RE: DISCUSSION REGARDING THE RESIDENCY LAW ON EMPLOYMENT

Discussion regarding the Residency Law on employment. Richard read
from the Idaho Code. The mayor told the council that we called A.I.C.
and they said there is no way we can make employees live in the city.
Steve Zollinger stated that we could create incentives or response time
can be set. You cannot discriminate because they live outside the
city.
RE: DISCUSSION OF POLICY CONCERNING DRIVING OF CITY VEHICLES HOME

Discussion driving a city pickup/car home policy. Discussion on the
need for the Police Chief to use his car and the other department
heads. Mayor Boyle read the policy as he had written it. (discussion)
The council stated that the mayor has all their thoughts, and
authorized the mayor to write the policy.
RE: DISCUSSION OF THE SIGNING FOR TRAFFIC COMING IN TO REXBURG
TOPIC: (19,41,,,SIGNS,RICKS COLLEGE,TRAFFIC,MAIN STREET)
Glen Pond stated that he had a business man approach him about the way
we sign traffic into Rexburg. We try to direct all of the College
traffic off of the South entrance. He had a concern that we maybe
should try to bring the traffic down Main Street, so people could look
at our city. He felt that we need to look at those signs and point
them to Main Street. (discussion)
