RE: HAROLD NIELSON REQUEST TO MOVE DRAIN DITCH

Harold Nielson was at the meeting to request moving a drain ditch. He
is requesting to move it to follow his fence line. He is loosing about
an acre of ground with the ditch the way it is. He did not want to get
rid of the ditch, because 31 years ago we had water come down from the
hill and he would have been flooded if it had not filled the ditch. If
it were filled in he would be flooded. He recognized the need but
would like to re-route it. The ditch is just for drainage. Farrell
Davidson was at the meeting and said he had looked at it and did not
see any problem with changing it, if he pays for the change, but he did
recommend that the old one is left for a little while to see if the new
one works. Mr Nielson suggested the two problems were (1) finances and
(2) that they might find some rock. He asked if it would be hia entire
expense. The mayor told him we would have the city engineer look at
it, but it would probably be Mr Nielson's expense. We are looking at
storm drainage in the area. The mayor recommended that we give him
approval based on the recommendation from the city engineer and
Farrell. Jim Flamm suggested that he had no problem for him to do it,
but did not feel it was our place to fund it. (discussion on piping
it, because it is so flat there might be a problem) A motion was made
by Glen Pond to give approval to move the drainage ditch based on the
engineer's approval. Seconded by Kay Beck. All Aye
RE: SIGNS AT COMMUNITY PARK

Signs at Community Park. In the past we have given Clair permission to
get signs painted for the American Legion. By selling the signs they
finance their travel and games Clair wondered if the city would give
them permission on an on going basis to do that. Glen felt we could
not do that for more than a year to year basis, because it was funded
by Federal Funds.
RE: RECOGNITION GIVEN TO ADAM GONZOLES

Adam Gonzoles was at the meeting. The mayor honored him for pulling a
four year old boy from a swift canal. Adam had training in swimming and
jumped in the canal and pulled out the four year old boy and saved his
life. The mayor gave him a key to the city for his bravery.

Mayor Boyle read Resolution 94-4 for requirement for sidewalks. (copy
attached) A motion was made by Jim Flamm and seconded by Kay Beck to
adopt the resolution. All Aye.
RE: ORDINANCE 757 ZONING LAIRD PROPERTY & RIGBY/MORRELL PROPERTY

Mayor Boyle read Ordinance 757 zoning the Laird property and the Rigby
Morrell property.
ORDINANCE NO. 757
AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF
REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATE IN REXBURG, MADISON
COUNTY, IDAHO, WHICH HAS NOT PREVIOUSLY BEEN ZONED, BE ZONED AS
HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE. The zoning on the property would be LDR1.
A motion was made by councilman Kay Beck and seconded by Jim Flamm
that the rules requiring an ordinance of a general and permanent nature
to be read on three occasions be dispensed with and that said ordinance
be numbered 757.

Ordinance 757 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Glen Pond and seconded by Jim Flamm that ordinance
757 be passed.

The roll showed all councilmen present voting "Aye" carried, the Mayor
declared that the majority of all the members of the city council had
voted for the passage of said ordinance was duly and regularly passed.
Mayor Boyle declared the motion carried.
RE: ORDINANCE 758 - ANNEXATION OF VILLAGE GREEN TRAILER COURT - 1ST
READING

Ordinance 758, Annexation of Village Green Trailer Court.
ORDINANCE NO. 758
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO
DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG,
IDAHO; AND AMENDING THE CHANGING THE ZONING MAP OF THE CITY OF REXBURG,
IDAHO, AND THE MADISON COUNTY-REXBURG COMPREHENSIVE PLAN 2000 TO SHOW
SUCH ANNEXATION AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING
ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
The mayor had talked to Kay Baker today. He has an 80 foot strip in
the trailer court that he is thinking about putting in a R.V. park.
The way the pre-annexation agreement is he can't do anything else
without out complying with the Mobile Home Ordinance. J. D. Hancock
stated that it is permitted in the Mobile Home Ordinance, but he will
have to comply with that ordinance. The council felt we should hold
off and just do the first reading.
A motion was made by Glen Pond to approve the ordinance for the first
reading only. Seconded by Jim Flamm. All Aye

RE: ORDINANCE 759 - SAFETY WITH WEAPONS ORDINANCE

Ordinance 759. Safety with weapons ordinance.
AN ORDINANCE PROVIDING FOR THE ENFORCEMENT OF RULES AND REGULATIONS
ESTABLISHED FOR THE MAINTENANCE OF A SAFE AND ORDERLY ENVIRONMENT UPON
GROUNDS OF WITHIN FACILITIES TO WHICH THE PUBLIC HAS ACCESS WITHIN THE
CITY OF REXBURG; ESTABLISHING THAT VIOLATION OF SUCH RULES AND
REGULATIONS CONSTITUTES A MISDEMEANOR; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by councilman Kay Beck and seconded by Jim Flamm that

RE: BUDGET - STREET DEPARTMENT (GRADERS)

FRANCHISE FEE)
The mayor suggested as we are thinking about the budget, the money we
get in the Street Budget is not adequate to keep up with all the
demands we have to do. We have two graders that are 26 years old that
are on borrowed time. We have tried to lease some and that is not an
option. If we are going to maintain snow removal we need to replace
the two old graders. The county is returning two of their leased
graders that they keep for 4 to 5 years. We could buy those two leased
graders at $140,000 for the pair of them and with the trade in about
$110,000. They are in real good shape. We also have a lot of streets
that need to be redone. If we are going to do all these things for the
streets, we need to raise the Franchise Fee. He asked the council to
think about it before next Wednesday.
RE: CATERING TRUCK IN CITY PARKS NOT ALLOWED

Francisco Saleto was coming to council, he requested a catering truck
in a city parking lot. The council felt we should not allow this.
RE: CLOSURE OF MAIN STREET DURING DANCE FESTIVAL DISCUSSED)

Glen discussed the closure of Main Street for the Dance Festival that
was the previous Saturday. The Chamber said they had an agreement with
all the merchants along Main Street. Glen had talked to merchants and
that was not the case. Phillips 66 could not get any business all day.
The Bike Shop did not get any business and finally closed. There were
problems from Broulims East. The council felt we need to get feed back
back from all the merchants. We need to be careful next years.

July 27, 1994
At the July 21, 1994 meeting of the Rexburg Traffic Safety
committee, the issue of residential side:walks was dicussed.
With the understanding that the City Council is in the process of
developing a comprehensive sidewalk ordinance, the committee
recommends that the following measures be implemented to direct the
placement of sidewalks in the interim.
1. That a standard sidewalk be five feet in width.
2. That no occupancy permit be issued for new structures unless a
standard sidewalk is installed.
3. That any reconstruction of a residential street or siding be
reconstructed .to include sidewalks.
4. That the City embark on a campaign to encourage residents and
neighborhoods to install sidewalks on existing frontages to
enhance their property, beautify the City, and make conditions
safer for pedestrian traffic throughout the City.

RESOLUTION # 94-4
WHEREAS, the City of Rexburg, desires to provide a
safe and efficient means for pedestrian traffic, and
WHEREAS, pedestrian safety is best provided for by
separating pedestrian travel from automobile traffic, and
WHEREAS, the City of Rexburg has in place a provision
which requires sidewalks together with a provision which
provides for site plan and plat review by the City Engineer,
NOW, THEREFORE BE IT RESOLVED that the City of
Rexburg hereby adopts the policy of complete compliance with
respect to the requirement that there be sidewalks in all areas
within the city limits of Rexburg. It shall be the duty of the
City Engineer or the Planning and Zoning Commission to
determine that a proposed site plan, or plat drawings contain
provisions for minimum 5' sidewalks, unless there is prior
written approval of the City Building Inspector for any
deviation from a 5' sidewalk. It shall further be the duty of
the City Engineer or the Planning and Zoning Commission to
decline to issue permits necessary for construction or
occupancy in the event such sidewalk compliance is not met.
This Resolution shall not repeal any prior action by
the City Council except to the extent that such action is
inconsistent with the terms of this Resolution.
Approved as a Resolution of the City of Rexburg on
the 3rd day of August, 1994, upon a motion made by
Jim Flamm, seconded by Kay Beck, upon which the following roll
call vote was had: those in favor: 4; those opposed: 0.
