All Aye RE: REQUEST TO CLOSE ROAD BEHIND WATER TOWER (DEE LANE MAUPIN) TOPIC (19,16,,,STREET CLOSURES,WATER TOWER) Justin Maupin representing Dee Lane Maupin requesting the road closed that goes behind his house from Blair Heinz property to Poleline Road, and Blair Heinz wants it closed from where the Satellite dishes below the water tower south from there. It is an unmaintained road and there is a lot of traffic that doesn't need to be there and a lot of hassle in the winter with kids getting stuck. The houses that go along Skyline drive have property back about 90 feet from the road, so the road goes through their property and probably should have gone back behind their property line. The farmers use it once in a while to get in their field but there is another access. Bill Henderson lives on the end and he wants it closed and Brian Larson lives there and he wants it closed. This was the old road that was used before they built the new one. The mayor stated that if the council approves it we will have to start the legal proceedings for abandonment and require the other road to be built. Whoever gets the value out of the abandonment would have to pay for the road. Glen suggested rather than to do an abandonment why not just close it off and not deed it to anyone. The mayor suggested that before you could do that you would need to build at least a gravel road into Blair Heinz's property and the city people. Mr Maupin told him there is a gravel road into Blair Heinz's property. Glen stated that we can always block it off and turn it over to Planning & Zoning for their recommendation. The mayor said he would do some checking and let them know. RE: DISCUSSION OF WATER & SEWER FEES & HOOK-UP TOPIC: (19,16,,,WATER HOOK-UP,WATER FEES,SEWER FEES) Joe Laird discussed (and handed out a sample ordinance from Idaho Falls) a charge for water & sewer hookup fees for new development. The mayor suggested a charge of $11 or $12 a a running foot. Richard suggested that we set it by Ordinance but set the amount by resolution. The mayor gave it to J. D. to review and bring it up in two weeks. 17 RE: DISCUSSION OF A LIFT STATION TO SERVE THE PROPERTY SOUTH WEST OF THE CITY TOPIC: (19,17,,,LIFT STATIONS,WATER LINES,SEWER LINES,SPUDS, COMFORT INN) The mayor discussed a lift station to serve the property South West of the city. We probably could not get back the cost of the lift station, but could get back the cost of the line. The cost of a lift station is usually looked at the same as the cost of a well in the water system. That cost is collected as we collect the connection fee. The lineal foot charge would apply to how much pipe we have to put in the ground. When we put the sewer in for the motel, we ran a four inch pressure line from the manhole over to the canal, so we wouldn't have to dig up the parking lot. Sometime we will need to cross the canal and decide where the lift station needs to be. (Joe explained what the lift station would take care of and what the one by the golf course would handle and how it would work.) The mayor told the council that someone is interested in building out by Spuds and was interested in extending the water and/or sewer from where it ends down between the Dome building and the fabric shop to the major road and over somewhere in front of Spuds. That property is not in the city and we need to decide if we will extend water and sewer to anyone out of the city. If you annex it you would have to be contiguous to the city. Jim questioned that we have set a precedence that we don't hook water and sewer unless it is in the city. Glen stated that we can't set any hard fast rules. RE: COST OF LIVING RAISE TOPIC: (19,17,,,CITY EMPLOYEES,BUDGET,COST OF LIVING) Richard told the council that he had checked with A.I.C. about the cost of living raise and the National was 2.4~ and Idaho is 3.5~. Bruce Sutherland made a motion to set the cost of living raise at 3~ for the next year. Motion died from lack of second. (discussion) A motion was made by Jim Flamm to set the cost of living raise at 3.5$ for the next year. Seconded by Farrell Young. Those voting aye: Jim Flamm, Farrell Young, Kay Beck. Those voting nay: Glen Pond and Bruce Sutherland. Motion passed. Richard handed out the Budget preparation schedule and the mayor discussed it. It was decided to change the August 3 meet to 7:00 A.M. because of the dance festival. RE: LOT CLEAN UP ON WEST MAIN (BY PAT BURTON) TOPIC: (19,17,,,CLEAN UP,MAIN STREET) The mayor discussed the clean up on the lot on West Main next to Pat Burton's owned by Verlan Lowder. He did not know how you could write an ordinance preventing someone from disking up the weeds on property. We can't write an ordinance to cover everything. Farrell Young suggested that they should work it out together. The mayor said he would talk to Jack Covington about it. RE: DISCUSSION OF HOLIDAYS THAT BEER CANNOT BE SOLD ON TOPIC: (19,17,,,BEER) The mayor had some people question the sale of beer on July 4 when we do not allow it on Memorial Day. J. D. read our ordinance which does not allow the sale of beer on Memorial Day, Thanksgiving, and Christmas. Our ordinance is the same as the State Code for the sale of liquor. The council felt that we need to leave it as it is. RE: COMPLAINTS ABOUT PEOPLE USING THEIR DUMPSTER - (YARD WASTE) TOPIC: (19,17,,,DUMPSTERS) The mayor had a complaint from Kathy Firth about the people using her dumpster. They have to dump it every day and it is very costly. Glen said it will come to businesses locking their dumpsters. Kay suggested a heavy fine, part going to the owner of the dumpster, part to the I person that turns them in and part to the city. We need to work on the ordinance and get it passed. Discussion on where to put yard waste. RE: REPORT ON IRRIGATION - CITY DITCH TOPIC: (19,18,,,IRRIGATION,CITY DITCH) Glen Pond reported on Irrigation. Two weeks ago he went around with the Water Master and took a tour of the city ditch and went clear out where it comes in from the Teton River where the head gates are. The following week he went out south of town to find out what is being done and told the individuals we would be setting some meetings to meet with the different people that are interested in the water and what they feel like the agreements have been over the past years. Then the irrigation committee will present it to the council after we have had a chance to meet with all of them. In touring the city ditch, behind Madison High School and Ricks Palmer subdivision, we have some major problems over there. We allowed the Rexburg Rotary Club to put in culverts behind a piece of property that Dean Ricks donated for a small park. They didn't flare that out with concrete abutment and the grate comes straight down. The ditch rider has to get down on his stomach to clean that out because when he puts a fork in, the grate is not on an angle and can't scrape it out. The other problem is the kids are getting in and pulling the grate up and there is a real concern about a kid getting in the culvert and not being able to find his way out the other end and being closed in there. The other problem along there is you have willows and growth along the ditch bank in the back of those homes. The ditch bank needs to be built up on that side, because if you get high water it will qo into those people's back yards. You have some people that have come clean back to the ditch with their fences. The mayor said he bet the ditch is just an easement across their property and their property goes clear and including the ditch property. The kids put planks across the ditch and the debris gets lodged and when he cleans it out they put them back again the next day. We need to find a way to clean up the ditch bank. (discussion) It is a Wastewater ditch and is the city's responsibility to keep it clean. Where the culvert is we need to flare it with concrete,. either the Rotary Club or the City needs to do that for safety. RE: DISCUSSION OF THE APARTMENT INSPECTION ORDINANCE FOR RICKS COLLEGE TOPIC: (19,18,,,APARTMENTS,RICKS COLLEGE) The mayor discussed the apartment inspection ordinance for student apartments. The college has written a new policy. They have taken any reference to city inspection out of their policy. They have been specific about requiring a G.F.I, and requiring a fire extinguisher and smoke alarms. We need to revise our ordinance. RE: ORDINANCE 757 ZONING LAIRD & RIGBY/MORRELL PROPERTY, PASSED TOPIC: (19,18,ORD,757,ORDINANCE,ZONING,LAIRD,RIGBY/MORRELL) Mayor Boyle read Ordinance No. 757 zoning the Joe Laird and Rigby Morrell Property LDR1. When this property was annexed, but it was not zoned. AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATE IN REXBURG, MADISON COUNTY, IDAHO, WHICH HAS NOT PREVIOUSLY BEEN ZONED, BE ZONED AS HEREINAFTER DESIGNATED: AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by councilman Bruce Sutherland and seconded by Ray Beck that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 757. Those voting aye: Jim Flamm Bruce Sutherland Glen Pond Farrell Young Kay Beck Those voting nay: none Ordinance 757 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the ~ ~={ motion was made by Bruce Sutherland and seconded by Kay Beck that ordinance be passed. Those voting aye: Jim Flamm Bruce Sutherland Glen Pond Kay Beck Farrell Young Those voting nay: none The roll showed all councilman present voting "Aye" carried, the mayor declared that the majority of all the members of the city council had voted for the passage of said ordinance was duly and regularly passed. Mayor Boyle declared the motion carried. RE: RECOMMENDED ANNEXATIONS TOPIC: (19,19,,,ANNEXATIONS,WALTERS READY MIX,ARGUS CLINGER, RICKS COLLEGE) The mayor stated that the Planning & Zoning had recommended that we annex the college property, Argus Clinger property and the Walters property. The mayor would talk to those people and then we need to move on it. A motion was made by Glen Pond and seconded by Bruce Sutherland to pay the bills. All Aye Meeting adjourned. ti,- Mayor, Ni a L.
