A motion was made by Glen Pond and seconded by Nyle Fullmer to approve

RE: WATER ISSUE: TETON PIPELINE AGREEMENT & REXBURG IRRIGATION
We have on the agenda the Teton Pipeline Agreement. Rexburg Irrigation
called and wanted to come in. They met today looking at old minutes.
We would like to have a work meeting with them. We had an obligation
to them to furnish water to the people on the South side of the city
along the ditch on 5th West. About 20 years ago we gave them 6.5
C.S.F. of water to furnish water to those people. They are coming back
now saying that isn't enough water and they are running short. We will
hold off and meet with them and with the Teton Pipe Line group.
Roger Hoopes, representing Teton Pipe Lines, their concern is that it
is time we had this accomplished. I remember twenty years ago when we
went through this discussion. It seems illogical that they could say
now that they need the water when before they didn't. There is less
irrigated land out there in 1994 than there was in 1974. Perhaps what
has created all the interest is at the meeting two weeks ago, it was
mentioned that if the other 6.5 C.F.C was not being used, we would be
interested in it and still are. Two weeks ago we simply came to renew
our lease that had been in effect for twenty years. The mayor stated
that we need to be fair. We need to have a work meeting before the
next council meeting. Rexburg Irrigation is paying $300 a year and
Teton Pipelines is paying $3000 for the same amount of water. Rexburg
Irrigation is saying that is water we owe them to deliver to the
irrigators on the South side of the city, about 90 acres. Roger said
they would be willing to meet with the council at anytime.
Nyle asked if we couldn't go ahead and approve the lease. Two weeks ago
we asked J. D. to review the lease and we would act on it tonight. J.
D. said they are maintaining that they are not getting enough water to
service their area and we need to find out for sure and check the
watermaster's records. Water is leasing right now for a low price of
$10 an inch and in checking, the average is somewhere between $15 and
$25 per inch. 6.5 C.S.F is 325".
The mayor stated we need to find out how much excess water we have.
Nile explained as he remembered the meetings we had 20 years ago. He
read from minutes 12/3/75. He told them we would do some checking and
contact them if we have a meeting. Roger stated that by June 1 it will
be irrigation time for them and they would like it resolved as soon as
possible.
RE: PUBLIC HEARING FOR BLOCK GRAND FOR WASTEWATER TREATMENT PLANT
Public Hearing. The city has received an Idaho Community Development
Block Grant in the amount of $500,000. These funds are being utilized
to provide funding assistance for the construction of a new wastewater
treatment facility that will treat sewage from the City of Rexburg.
The hearing will include a review of project activities and
accomplishments to date. (copy on file)
We are required to have a hearing where the public can give either
verbal or written comment, which will be accepted for five days.
John Millar gave a quick review of where we are and how it is going. We
have been working on the project for about one year. The work is
approximately 70~ completed and it is ahead of schedule and should be
completed about September 1. There has not been any major problems.
Ted Hendricks, ECIPDA - Basically this is the second Public Hearing
required by the Block Grant. Rose has worked on the A.D.A.
compliance. We spent approximately 60~ of the funds to date. The
progress reports and civil rights reports have been coming in, with
documentation to send to E.P.A. We procured Spindler Construction,
Forsgren Associates, and E.C.I.P.D.A. We have obtained all the
necessary legal documents that were necessary. All environmental
recommendations have been addressed. At a later date with John Millar
there will be the sludge disposal and treatment addressed. Diana
Clough from the Department of Commerce, that administers the funds
from the state, has been here and monitored the records that the city
has kept with John and Ted and everything has been found in order. We
will be having another audit by the State of Idaho to audit the records
and books before they release the final 10~ of the loan funds to the
city.
A motion was made by Glen Pond and seconded by Nyle Fullmer to close

RE: MADISON BASEBALL ASSOCIATION - USE & CARE OF CITY FIELDS
Randy Huskinson from the Baseball Association. They appreciate
everything the city has done for them. They are asking that Clair
could receive additional assistance to help in taking care of the parks
and starting a little earlier in the Spring. There are some situations
that are critical. The irrigation sprinkler heads are in need of
repair and the infields are extremely rough. He is able to get some
equipment from the college to help with aeration and he needs to
coordinate it with Clair. The main thing he is requesting is that the
city council will extend their budget to the Parks and Recreation to
allow a little more help with the ball diamonds. He would appreciate it
if the council will take it under advisement.
Sugar Salem has used our ball diamonds for the past several years,
free. All of their high school games have been played in Porter Park
in Rexburg. He had received a firm commitment from the college for a
two week block for the critical time frame for the last two weeks in
April we can use some of their fields. He is working with them to use
their fields on a schedule on an instruction basis. The baseball
season starts the first of April. When we have our try outs, every
spot of grass in the city is being used for practice. During the last
two weeks in April we need the fields to be in shape. The sprinklers
are the most important.
RE: REXBURG CITY DITCH DISCUSSED
Randy also wanted to make it public record that he is on the Rexburg
City Ditch and has water that comes out the Woomansee Johnson and which
is diverted and goes into the Rexburg City Ditch where it is carried
approximately 200 yards down and then he diverts it into a pond and
pumps out of it. (copy attached)
He also stated that under most canal company bylaws, that water can't
generally be diverted down stream. It needs to be diverted up stream.
As a Rexburg city ditch user, he could protest down stream movement of
that water as the Rexburg City share.
RE: DISCUSSION ON THE SHOSHONE-MILLHOLLOW STREET ALIGNMENT PROPOSAL
Discussion on the Shoshone-Millhollow street alignment proposal. The
estimates are about $2000 to remove the curb and gutter and about $2000
to put it back in and about $8000 on paving. The mayor stated as we
realigned that road, he was not sure how much the city is ready to
spend out of our street budget this year to do the street. Farrell
asked who is requesting this? The mayor told him it is a little of
both, but mostly the property owners. Glen suggested that Joe give us
alternatives and costs before we set a public hearing. Nyle suggested
that if the developers are requesting it they should pay for it.
(discussion) The mayor suggested that John and Joe should get together
and come up with a plan. John said he would talk to the Randall
Corporation and see how much they are willing to pay.
RE: PROPOSED SIDEWALK ORDINANCE
J. D. Hancock handed out copies of a proposed Sidewalk Ordinance to
review. The mayor told the council we need to decide what we want to
do with sidewalks. (discussion) As Joe has looked through the
ordinances, there isn't anything to cover sidewalks except sub division
ordinances. Jim understood that we had an ordinance for sidewalks. He
suggested that we do something like a survey to see how people feel
about sidewalks. The mayor stated we have had no enforcement in the
past, where do we go from here. Jim said he wanted to come up with
some alternatives. The mayor asked J. D. to look up when the Sub
division ordinance was passed and how many sub divisions have come in
since then? The council will study the ordinance and discuss it in two
weeks.
RE: FIREWORKS PERMITS APPROVED
The mayor read the Fireworks Permits.

Under state law you can't sell Fireworks Permits in stores.
A motion was made by Nyle Fullmer and seconded by Glen Pond to approve
the fireworks permits. All Aye
RE: START ANNEXATION OF VILLAGE GREEN TRAILER COURT (KAY BAKER OWNER)
The mayor stated that we need to start annexation for Village Green
Trailer Court. They will hook up to city water, but will maintain
their septic system. We need to set a hearing as soon as we can.
RE: APPROVAL GIVEN OF SELL OF 2 FIRE DEPARTMENT RADIOS
We have two fire department radios they want to sell as surplus
property, they are worth about $250 each. A motian was made by Nyle
Fullmer and seconded by Glen Pond to approve the sale. All Aye
RE: NEED TO MOVE RECYCLING BUILDING BEHIND PENNEYS
The property where the recycling building is behind Penneys has been
purchased by Flamms and they would like the building moved. The mayor
asked the council to look around for a place to put the building.
RE: PROBLEM WITH LARGE TREES IN CITY RIGHT OF WAY IN FRONT OF PEOPLES
HOMES
The mayor stated that we have had several requests for big trees to be
cut down that are on city right-a-way in front of people's homes. They
think the city should remove them. He asked Bruce to look into it.
RE: ANDERSON LUMBER ADDITION
Joe said Anderson Lumber is going to build onto their existing
building. The way the footings are designed they would need to stick

out three or four feet in the city right-a-way. There would be five
footings that would stick out in the right-a-way. They are trying to
keep the addition lined up with the existing building on the west. The
footings would be underground two feet and you would never see them.
Glen stated that he had a real concern where they are right across from
the school and we are talking about making that street into a major
arterial. The council felt they need to stay on their own property.
RE: NEW INDUSTRIAL PARK OUT BETWEEN ULTIMATE DIRECTIONS & ARTCO -
APPROVAL GIVEN TO TAKE MONEY FROM REVOLVING LOAN FUND TO PURCHASE
PROPERTY
The mayor discussed the Industrial Park out between Ultimate Directions
and Artco. We have an offer on the property and met with Diana Clough
from the Department of Commerce. Since there is a price involved in
the purchase of this property, we need to go into an executive
session. A motion was made by Nyle Fullmer and seconded by Bruce
Sutherland to go into executive session. All Aye
A motion was made by Jim Flamm and seconded by Bruce Sutherland to go
back into regular session. All Aye
We have been working on this Industrial Park for some time and the
property was tied up in an estate. It is out of the estate now and we
got a reduced price from what it was offered at before. A motion was
made by Bruce Sutherland that the city take the money out of the
Revolving Loan Fund to purchase 23 acres of land for an Industrial Park
for $184,000, seconded by Nyle Fullmer. All Aye
RE: MOTION TO APPLY FOR A GRANT FOR MONEY FOR INFRASTRUCTURE FEES FOR
THE INDUSTRIAL PARK
A motion was made by Nyle Fullmer and seconded by Glen Pond to proceed
with F.H.A. to apply for a Grant for money for Infrastructure Fees for
the Industrial Park. All Aye
RE: TREES ON COLLEGE AVENUE - PROBLEMS WITH TRACTOR TRAILER TRUCKS
ENTERING ALLEY OFF OF COLLEGE AVENUE
Chuck Porter stated that he really likes the trees that are planted in
the downtown area. The problem on College Ave is it is so narrow and
most trucks that go down the alley go from Center Street and go clear
through and service that area. The problem we have is once in a while
we have a tractor trailer truck that tries to pull off of College
Avenue into the alley and scrapes the trees and building. Could we put
a sign up making it illegal for tractor trailers to turn into the alley
off of College Ave? A sign could read "Trucks must enter alley one
block west on Center Street". He would like permission to plant a
steel pole by the tree. The mayor told him we would have the police
look at it and figure out a sign. No problem in putting in a pole.
A motion was made by Glen Pond and seconded by Jim Flamm to pay the
bills. All Aye
John Millar invited the council to come and look at the Treatment Plant.
