RE: BUDGET HEARING DATE SET
The mayor discussed the budget work schedule. A motion was made by
Glen Pond and seconded by Nyle Fullmer to set the Budget Hearing at
September 1 at 8:00 P. M. All Aye
RE: REPORT FROM THE AIRPORT BOARD - GRANT DISCUSSED
Gerald Taylor was at the meeting representing the Airport Board. The
Airport Board met with Ron Larsen of the FFA. They spent about one and
half hours with him and got information about the $150,000 grant and
also discussed the consultants. The city, county and airport board
need to be concert on this issue. Mr Larson said the project could be
stopped at anytime. He had a concern because it would take a long
time, possible one or one and half years for the grant. The site
selection will probably take three months and if approved it will take
five to six years beyond that to finish the thing out. We are talking
about even possibly ten years. If we decided to not go with the grant
now we can re-apply later. He did not know when we would be accepted.
If we don't like the site selection and are against it we will be like
we are now and can only get grants for repairs but won't be able to
extend the runway.
One thing that was brought to their attention was the Core of Engineers
was asking some questions. It would have cost about $30,000 to finish
that project out and the grant money had run out so it was a hardship
for the present consultants to continue on without being paid for it
and Mr Larson realized this.
After Don and the Mayor left the Airport Board had a meeting and a
motion was passed to recommend to the city and the county that they
wanted to proceed with the project with the grant. The city's share
will be $3750.
Jim asked if we get the study going and get a feel of the project, can
we do some creative things to raise money? Gerald said he talked to
some people from Driggs and they sold gravel, had payments in kind, and
had donations, so there are ways. The Grant People will be working very
close with the city and the county. There will be Public Hearings and
Information Hearings.
Jim asked about spending the money in the budget designated for the
Airport? Jim felt we should move forward with the project. The grant
will be 90~ Federal money, 5~ State and 5$ shared with the City and
County. (discussion)
A motion was made by Jim Flamm to go ahead with the study and use the
money earmarked for the Airport to pay our share $3750. All aye.
RE: PAVING OF ROADS IN THE SHERWOOD HILLS SUBDIVISION (HARVARD &
5TH SOUTH)
Nancy Whyte was at the meeting to discuss the paving of roads in the
Sherwood Hills Subdivision. The mayor explained, we had hearings last
fall to close Harvard and it was voted against closing. We approved
this plat with only 30 feet streets. The other area is suppose to come
off the other side of the road. The people on the other side of the
road and the people up and down Harvard do not want that to be a
through road. We have been trying to get Mr Pingree to oil 5th South,
because it is used so much. He wants to do all the oiling at the same
time to get the best prices he can. We would need ten feet off the
property on the west or let him pave the 30 foot street on Harvard.
The people on the West would not like to give up that 10 feet, because
they need it for parking. John Millar suggested that they might take 5
or 10 feet off of three lots and move to the East. The mayor said if
we had no access for the lots in the West, there would be no problem
with a 30 foot street. It has not worked before on the streets we have
allowed to be smaller. The residents have put in curb cuts and it has
presented a problem. (discussion) Nyle Fullmer suggested that we go
to the property owners on the west and tell them they will need to pay
for curb and gutter or we will require them to fence it and there will
never be an access to their property. The mayor said we could live
with it, if their apartments never had access onto the street. There
is a piece of the road next to Shaddock Apartments that would be their
responsibility.
The mayor suggested that we need to tell them they will have to pay for
curb and gutter or pay for curb, gutter and street. Farrell Young
suggested that if the plat had been approve with a 30 foot street, we
might need to let them finish it that way. Jim suggested that a 30
foot finished street would be better than a 30 foot half street. The
mayor said they could talk to the property owners and give them a
couple of options. Nyle suggested that the property owners would need
to give a bigger access along there or tell them they will not have
access onto that street and have somekind of a setback with a barrier.
They could pave that street last. Glen asked in thirty years how would
the owners of those apartments know they don't have access. The mayor
said he would get in touch with those property owners and give them
their options.
RE: DISCUSSION ON OPTIONS FOR FENCING CANAL
Rosa Mann - 405 West 4th South- Last month Tim Taylor was at city
council, right after Mr Mann's son was drown in the canal, to request
that a fence be put up along the canal. Mr Mann wanted to discuss
that, plus add three more suggestions.
(1) Construct an 8 foot fence on each side of the canal plus along the
forks that lead off the canal. He had talked to Keith Erickson and his
concern was that they be able to clean the canal.
(2) To cement the canal to reduce the upkeep as other communities have
done and put up a fence.
(3) In Boise they bury the canals with a culvert which would be the
safest way. It would reduce the safety hazard.
There is an actual need for safety in the canal area. The canal needs
to be made safer as many people he had spoken to have agreed. Along
the canal are several apartment complexes with many young children.
There are two schools in the immediate area of the canal. When it is
warmer weather, many children walk or ride bikes along the canal which
increase the chance of a child slipping into the canal. He proposed
that the city start on a solution for the problem immediately to deal
with it like a feasibility study. The city needs to look at all
alternatives.
The mayor told the group he had called Keith Erickson, the canal
company has rights all along the canal. Anything we do, they would
have to approve it. The city owns the property along the canal from
Main Street to 4th South. It is along 4th West street. The canal is
so close to the street, there would not be room for a fence and to give
them room to get in and clean the canal, unless the Canal Company could
always clean from the West side. The cost of a fence is $10 to $12 a
foot. When the Steiner Ditch went down through the Starlite Addition,
we put a culvert in and the property owners paid for it. It cost about
$3000 each. They were concerned about the safety. The mayor said we
could go ahead with some type of a study. John Millar said to cover
the canal through the city would cost about $6 Million Dollars.
Kevin Davis lives on 3rd West. If it cost $3000 he would have to take
out a loan to come up with the money. He thought we need to get rid of
the canal.
Mark Jaynes-355 Cul de Sac- He did not know who owns the canal, or
which was here first the canal or the residences. He works at the
college on construction and if they dig a hole and do not barricade it
the college is liable if someone falls in it. He did not know where
the liability lies with city. He discussed when a child is lost, you
can't compare which case is worse. If there is something that could be
done about it, it should be done. He showed pictures of the canal, from
the public street, it is about 1 1/2 foot to the canal. He said he
didn't know why we have to have a canal going through our city. The
mayor told him it had been there about 95 years.
Doug Nielson - He asked if we have had requests to fence the canal
before? He lives on 4th West across where the pictures were taken. He
asked if there was a way to address the issue without getting bogged
down.
Mr Mann felt that the Canal Company should shoulder some of the
responsibility to make the canal safe. Mr Davis suggested that the
canal be moved out of the city limits. He asked who was liable. J. D.
Hancock stated that the canal company owned the canal. The mayor told
him, he didn't think the canal company was even sueable and just
because the canal is there is not reason enough to sue them.
Jim Flamm told them the canal had been there for 95 years and when the
canal was put in it was okay. The danger is the encroachment of homes
and street that were built around the canal. Don't blame the canal.
Nyle agreed with Jim, the people that bought homes near the canal knew
it was there. We need to get beyond saying the canal is unsafe and
who's fault is it because it is unsafe and go forward and see what we
can do.
Sandra Mann- If we can get the city to help, the canal company to help,
and the community to help and possibly passing a bond, maybe we could
get something done. We could put it before them and the public could
see it is an important issue. If we made it a public issue we maybe
could get donations. People get hurt in the canal and children play in
it and something needs to be done.
Doug Nielson gave the City Council a proposal, he had put together. He
felt that fencing or piping in the canal would not fly, especially if
it would cost $50,000 to fence two or three blocks. He would probably
have to sell his house to come up with the money. Could we do
something to minimize the danger. He proposed to plant some wild roses
along the canal bank. Across from his house is a wild rose hedge and
neither an adult or child would go through them to get into the canal
and he has lived on the canal for fourteen years. (copy of the
proposal attached) He felt a feasibility study would be a good idea
and he would be glad to help. He felt it was something they could sell
and do with minimal cost and something to get involved in.
The mayor thanked him for his comment. The mayor asked John Millar to
get some figures. He asked Mr Nielson to act as chairman of the
committee and he and the mayor could organize the committee with people
living along the canal and some people that live away from the canal.
We would need to get the canal company involved in the committee.
RE: PUBLIC HEARING TO AMEND THE BUDGET.

We are increasing the budget to $6,000 for the amount we got from the
Forestry Commission to plant the trees, $10,000 to start the Dare
Program, and $5,000 for the American Legion for the painting of the
baseball signs for a total of $21,000. This money has been used
according to the provisions authorized by the separate grants and the
$5000 would be given to the American Legion to support the American
Legion baseball. A motion was made by Nyle Fullmer to amend the
budget, seconded by Glen Pond. All Aye
RE: REVIEW OF BIDS TO REPAIR THE STREETS
John Millar reviewed the bids to repair the streets, (copy attached).
A motion was made by Nyle Fullmer to accept the low bid to H & R for
Alternate #1 as recommended by the engineers. Glen asked if we had the
money in the budget. The mayor said we had $400,000 in the budget and
we have to date spent only $50,000 for crack sealing. Motion seconded
by Glen Pond. All Aye.
RE: ORDINANCE #747 PASSED CHANGING THE ZONING ON THE PROPERTY FOR THE
ERICKSON PONTIAC EXTENSION
Mayor Boyle read Ordinance #747 changing the zoning on the property for
the Erickson Pontiac extension.
ORDINANCE 747 AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE
CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF
THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATE IN REXBURG,
MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by councilman Nyle Fullmer and seconded by Glen Pond
that the rules requiring an ordinance of a general and permanent nature
to be read on three occasions be dispensed with and that said ordinance
be number 747.

Ordinance 747 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Glen Pond and seconded by Nyle Fullmer that
ordinance 747 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the city council had
voted for the passage of said ordinance was duly and regularly passed.
Mayor Boyle declared the motion carried.
Jim Flamm gave a report on the Planning & Zoning Seminar held in Boise.
RE: DISCUSSION OF GRANTS FOR BICYCLE PATHS
The mayor reported that he had met with John Barnes from the Idaho
Department of Transportation on Bicycle Paths. There are possible
grants available. We need a committee and get them working on it. We
need to get the paper work in by April. We need an overall city plan
to qualify. The green belt by the river would not qualify. You need
to show it is part of the plan to move people. We will need estimates
on what it will cost. Quite often they use existing roads and you put
a path along the road.

RE: SOLID WASTE HEARING SET
The mayor told the council that there would be a Solid Waste Hearing on
Tuesday, August 3 at 7:00 P. M. at the Tabernacle. He would like all
the council to come to the meeting and give their option to the
County. If we don't have it close to the city will have to raise
rates. The city needs to be there to testify on where they would like
the location to be. He recommended the site by the airport.
A motion was made by Nyle Fullmer and seconded by Jim Flamm to approve
the bills. All Aye

GOAL:
To keep toddlers out of the canal water.
Proposal:
1. Plant Wild Roses (or some other well suited, sticker bush) along
both sides of the canal, to create a hedge.
2. Install chain link gates at the spots used for canal entrance,
to do the maintenance work.-
How to Accomplish the Proposal:
Promote this safety issue as a serious.. concern, that ought to be
shared by all members of the community. Turn this project into one
like the Centennial Carousel was.
1. Have Ricks College Horticulture Department participate by
identifying which "bush" would best serve the need. Then help grow
the starts in preparation for planting.
2. Have scout troops and other civic organizations participate by
helping to raise some of the money needed to fund the project. One
idea could be to sell first aid kits and/or flashlights to the
Rexburg residents and to the student housing owners, to put into
each unit.
3. Have local contractors participate by donating time and the use
of their equipment for the site preparation.
4. Have Ricks students participate by helping with the planting
process. This could be done as part of an Opening Social/Service
Project on the third Saturday of September.
5. Have .prospective eagle scouts undertake annual maintenance to
the safety hedge each Spring, as their eagle service project.
How to Proceed:
1. Do not make a decision FOR or AGAINST the proposal tonight.
2. Conduct a feasibility study to evaluate the merits of the
proposal..
