A motion was made by Nyle Fullmer and seconded by Jim Flamm to approve
the minutes. All Aye
Mayor Boyle asked, after everyone had looked at the fact sheet handed
out by Ted Hendricks about the contract with ECIPDA, if the council was
ready to vote. Brad Liljenquist declared a possible conflict of
interest and asked to be excused from voting. The mayor stated that we
would wait for Bruce Sutherland before we would vote.
RE: AUDIT REPORT
Brad Reed and Scott Bond were at the meeting representing Rudd and
Company to present the audit. Brad stated that they had gone over it
with the Mayor and Richard this afternoon. Brad went over the audit
briefly with the council after he handed out copies of the audit to the
council.(copy on file) He gave the city a clean opinion. A motion was
made by Brad Liljenquist and seconded by Nyle Fullmer to accept the
audit. All Aye
RE: STEVE EAGAN WITH NEW AGE RECYCLING SERVICES
Steve Eagan with New Age Recycling Services was at the council meeting
to discuss his recycling business. He gave the council handouts
explaining what he would be doing. He submitted a bid to the city
council to see if they were interested in a recycling program in the
city parks in the spring. The mayor suggested possibly the golf course
would be interested in the program. They would supply the number of
containers that the city would need in each park and they would empty
them on a weekly or biweekly basis or monthly basis depending on the
need. He said there isn't a lot of value to the recyclable items. The
charge he wanted to charge was $6.00 per container per month and they
would supply the container. The container would be something like the
city provides now in a galvanized steel and they would lock the lid
down and cut a hole in the top only big enough for recyclable items. He
also explained the residential service he would provide. They would
charge $7.00 per month for a biweekly pickup for residents. Nyle
Fullmer suggested that we get an opinion from Clair Boyle and the Parks
and Recreation. Jim Flamm felt we should look into options for the
city and coordinate it. Nyle Fullmer thought it was a good idea. The
Mayor told him we would get back with him about recycling it in the
park.
RE: DISCUSSION ABOUT DUMPING OF USED OIL
Mayor Boyle showed the council an article and told the council that
they are pushing to make it mandatory for the dumping of used oil. In
a year to eighteen months you will not be allowed to dump it in
landfills. Ray Oakey has a place he will allow anyone to dump their
oil and when it gets full it is transferred to a transfer station.
They will have to keep tires and oil out of the landfill. Farrell Young
asked about Upper Valley Industries and their recycling. The mayor
explained and discussed it.
The mayor told the council we need to hold a Public Hearing to amend
the budget for a grant for $10,000 for a state seat belt grant. The
hearing would be set for February 3.
RE: RESOLUTION 93-2 FOR A GEM COMMUNITY ACTION GRANT TO PURCHASE &
CONSTRUCT A LARGE SIGN TO PUT UP ON THE SOUTH SIDE OF REXBURG, PASSED
Mayor Boyle read Resolution 93-2 for a Gem Community Action Grant.
This would be to purchase and construct a large sign to put up on the
South aide of Rexburg. (copy on file) A motion was made by Nyle
Fullmer and seconded by Brad Liljenquist to adopt the resolution. All
Aye.
RE: OLD ORDINANCES ABOUT SNOW REMOVAL IN SIDEWALKS
The mayor told the council we have two ordinances on file Ordinance 5
passed in 1899 for keeping the sidewalks clear and Ordinance 50 stating
that snow needed to be cleaned off the sidewalks on the south side of
Main Street only. These ordinances need to either be revised or
repealed. The council discussed the ordinances and thought we should
not tell the business down town to clean the sidewalks and not the
business on other streets.
RE: DISCUSSION OF CLEARING DRIVEWAYS FOLLOWING THE SNOW PLOW
The mayor told the council that he had gotten a lot of complaints about
snow pushed in driveways by the snow plow. In Idaho Falls, they only
clean the streets when they declare an emergency. They have only
declared an emergency twice and when they do declare an emergency it
will cost them $100,000. When they do clean the streets they have a
front end loader go behind the snowplow and scope out driveways. Sugar
City also does that.- The mayor talked to Wayne Parkinson and he told
him if we hired it out it would cost about $1.00 a driveway. Idaho
Falls pays $1.50 to do that. It would be rather expensive. The mayors
feeling would be people would like to have it done, even if they had to
pay for it. The council asked how we would pay for it? The mayor said
we could not assess it we would have to budget for it and do it.

RE: NEED TO REMOVE SNOW AT EAST MAIN INTERSECTION(?) BY PROFESSIONAL
PLAZA
Margie Waldren 71 South 2nd East, was at the meeting with a petition.
As you are at the old Hospital coming west down Main Street and want to
turn into Professional Plaza, and pull between the medium across from
Professional Plaza, you look for cars and can't see around the snow to
see cars. You finally have to pull out a little to see the cars.
Margie did that and was hit by a car and her car was totaled. She felt
the city should cut the snow back so you could see if there were any
cars coming. Just give the snow a haircut so you can see the traffic
coming from the west. The snow has never been chopped this year. It
is dangerous. The police gave her a ticket because she had pulled out
in the road a little to see the traffic. On the ticket the police
called it an intersection. Two police officers could not agree if it
was an intersection and finally got their book out to check. If it is
an intersection, then treat it like one. It needs to be sanded and the
snow chopped so it does not obstruct your view. Jim Flamm said he
thought we should block it and close it off in the winter. He was in
agreement with the problem. Brad Liljenquist stated, we have an
ordinance saying you cannot plant trees and shrubbery next to an
intersection to block the view. Snow is the same principle, it blocks
the view. A discussion on the trees that are planted along the medium.
Jim told the council that the East side of the medium is bad, you can't
see around the snow to see the cars. Mrs Waldren said she had not seen
any sand around that medium all year. Brad said we need to get the pile
of snow moved that is obstructing the view.
The mayor said he would get with Farrell Davidson and the Police Chief
and go look at it and see what can be done.
RE: DISCUSSION OF SNOW REMOVAL
The mayor asked the council if there was anything the council felt that
could be done different to help with the snow removal. Brad mentioned
that one year the council looked at an attachment for the snow plow to
clean out driveways. It was discussed but Farrell did not like the
idea because it was too slow. Nyle did not feel we should clean out
everyone's driveway. We could be like Idaho Falls and say we would
plow it when we get six to eight inches of snow on the ground. That is
unrealistic and it is also unrealistic to say we would go plow out the
driveways. The mayor said he really felt sorry for widows and people
with poor health. Nyle suggested that the boy scouts or neighbors
should help. Nyle asked how many driveways we had in town. Richard
said there is over 2000 water hookup. Nyle stated it would cost around
$3000 every time they plowed out the driveways.
Mr Waldren suggested that the people that wanted their driveways
cleaned could get on a list and pay $1.00 each time. The mayor said
it would cost a lot more if they had to travel all over. Mr Waldren
said most of the people would want it.
Jim Flamm suggested that we talk to some contractors and see what we
can find out and possibly let people know that service is available.
RE: DISCUSSION OF SNOW REMOVAL ON THE SIDEWALKS
Council discussed the ordinance of removal of snow on the sidewalks.
It was suggested that we write letters and see if we can resolve it
without making rules.
RE: GARBAGE CONTAINERS ON COLLEGE AVENUE
Brad Liljenquist discussed the garbage containers that are left on the
sidewalks on College Avenue and boxes. They need to be cleaned up.
Jim Flamm discussed sanding the whole street coming down the hill.
RE: BIDS ON THE SENIOR CITIZENS CENTER
The mayor told the council the Senior Citizens Center bids came in
$60,000 too high. We do not have that much money and we will have to
make some changes.
Jim Flamm reported on the Impact Zoning work meeting.
A motion was made by Nyle Fullmer and seconded by Brad Liljenquiat to
pay the bills. All Aye.
RE: DISCUSSION & APPROVAL OF ECIPDA FOR THE ADMINISTRATION FOR THE
GRANT ON THE WASTEWATER TREATMENT PLANT
Discussion on the contract with ECIPDA.
Bruce Sutherland arrived at 8:50 P. M.
A motion was made by Farrell Young and seconded by Jim Flamm to accept
and sign the contract with ECIPDA for the Administration for the grant
on the Wastewater Treatment Plant. Those Voting Aye: Nyle Fullmer,
Jim Flamm, Farrell Young. Those Voting Nay: Bruce Sutherland. Brad
Liljenquist abstained.
