RE: SUMMARY OF ANTI-DISPLACEMENT & RELOCATION ASSISTANCE PLAN APPROVED
Ted Hendricks representing ECIPDA was at the meeting, he has been
assigned the responsibility of the Block Grant application and the
administrative duties, if the city does receive the grant from here on
out. There are some items that need to be addressed to go into the
state. One of the items is the Anti-Displacement and Relocation
Assistance Plan. This basically means if this project displaces any
individual you will fill federal laws and relocate them. If you bought
some property for the plant and there is an individual in a house on
that property, you would have to take certain steps to comply with
federal requirements to relocate those individuals. You have adopted
this type of plan in the past on other federal funded projects that the
city has been involved with. This particular plan is a new floormat
and has recently been adopted by the Department of Commerce and Block
Grant. They are asking the city to re-adopt the current document and to
publish a summary in the paper. He had a copy of the summary for the
council approval tonight. Ted read the summary (copy attached).

RE: SUMMARY OF FAIR HOUSING RESOLUTION TO BE PUBLISHED
Next is a Summary of the Fair Housing Resolution, this has been passed
previously with any grants the city has participated in. To qualify we
have to pass a summary of that document. Ted read the summary (copy
attached) A summary should be published each year in April. The mayor
authorized him to publish The Fair Housing Resolution in summary.
RE: COMMUNITY BLOCK GRANT FUNDS - CONTRACT WITH ECIPDA
When the city applied for Community Block Grant Funds, the city also,
in the pre-application process, procured professional services hiring
your engineering firm and your administrative firm to assist you in
your project. The engineers are not getting paid from federal money
and do not have to follow federal steps for procurement. You will have
to follow federal steps because administration fees will come out of
the block grant. The city has done that and selected ECIPDA to serve
in that capacity. In order for us to fulfill the addendum
requirements, you have to negotiate a contract with ECIPDA, at this
point in time, to send into Boise for their approval. The contract is
also conditional upon receiving their money. Ted handed out a copy of
the contract for the council to review. There are a lot of things that
need to be taken care of between now and April if you are ready to
construct in May. The Block Grant does not want hindrances because the
city has not acquired their professional service agreements and have
their professional staff on board with them. Jim Flamm suggested that
the council study the contract and make a decision at the next
meeting. Ted said Diana Cluff is coming over next week. She is the
liaison between the Department of Commerce and the City. It may be
helpful for the council to meet with her. (Ted explained the
contract)
RE: REPRESENTATIVE FROM COLONIAL LIFE & ACCIDENT INSURANCE
Ena Harmon representing Colonial Life & Accident Insurance was at the
meeting. Currently the city is pre-taxing the dollars, but they are
not really following the regulations. She said she had not gotten the
permission to speak with the employees so they have the freedom of
making choices. Rose told the council that she had been given
permission to talk to them, but not during working hours. Nyle Fullmer
asked her what she wanted. Did she want the council to set up an
appointment with each of our employees? Mrs Harmon, stated basically
yes, we just work through the department heads and they tell us we need
to talk to them during their breaks. The mayor asked her if there is
something we need to do in the tax thing. She stated that the form
needs to be filled out correctly. Mrs Harmon said you can't
discriminate, it needs to be available to all employees. Glen Pond
said Richard handles it and should be able to coordinate it with the
rest of the program. Bruce said he did not think we would be
discriminating anyway when it is the employee's choice. Nyle Fullmer
stated that we should draft a memo describing what she has to offer and
submit it to the employees and if they are interested they can make
contact with her. The mayor stated that Richard would coordinate the
whole thing.
RE: RESOLUTION 93.1 - DESTROYING CERTAIN RECORDS - PASSED
Mayor Boyle read Resolution 93-1 to approve the destroying records (see
list attached to the Resolution). A motion was made by Bruce
Sutherland and seconded by Nyle Fullmer to authorize the city clerk to
destroy the records as listed on the resolution. All Aye
RE: GARBAGE SERVICE OUT OF CITY LIMITS DISCUSSED
We have received a letter from Don Pope's attorney because the city is
hauling garbage from different places out of the city. There are a few
places out of the city limits that were not getting garbage service and
requested us to pick it up and we have been picking up their garbage.
If he can provide that service we will have him take over all of that
service out of the city limits.
RE: SANDING PROCEDURES FOR WAL MART AND K MART DISCUSSED
We had a complaint about the city sanding the entrances to Walmart and
K Mart and several of those places where they are heavy traffic areas.
After talking to Farrell, we probably do go in further than our 99 foot
right-a-way. A fellow wants to provide that service. For safety
purposes, if he wanted to do the whole lot or in front of their stores
that would be a good idea, but until that time we would continue to do
just the entrances to make it safe so the people could stop as they are
coming out of the entrances.
RE: STORAGE OF CHRISTMAS DECORATIONS
Clair Boyle was at the meeting to discuss storing Christmas
Decorations. We have been storing them in the Pump House, which is a
small area and they get damaged pretty bad. Clair showed the council
bids he had gotten for storage. We had $1000 in the budget for
Decorations and the Chamber was going to match that amount. We still
have money to store them instead of stacking them in the Pump House.
The council felt that we should store them and take care of them by
renting storage. The council felt we should authorize the Chamber to
decide on the storage and we would pay 1/2 and they could pay 1/2.
RE: DISCUSSION OF NEW PARK PROPOSED BY ROTARY CLUB BY MILLHOLLOW
TRAILER COURT
The Rotary Club have proposed to build a park, between the Millhollow
Trailer Court and the housing development east of the football stadium
and the ditch. They are proposing to cover the ditch. Glen Pond asked
if Clair had reviewed the plans. A discussion of the maintenance the
Park Department would have to maintain it. Bruce suggested that we
would need to put in a sprinkling system. The council felt that we
should authorize Clair Boyle to work with them and see what the
finished project would be.
A motion was made by Brad Liljenquist and seconded by Nyle Fullmer to
approve the bills. All Aye

SUMMARY OF
RESIDENTIAL ANTI-DISPLACEMENT AND RELOCATION ASSISTANCE PLAN
A RESOLUTION OF THE CITY OF REXBURG, IDAHO, APPROVING A
DISPLACEMENT POLICY AND RELOCATION PLAN FOR THE CITY AND ITS
SUBGRANTEES.
A summary of the principal provisions of the Plan adopted by
the CITY OF REXBURG, Idaho, on JANUARY 6, 1993, is as follows:
Section 1: Sets forth the purpose, intent, and authorizing
authority for the Plan.
Section 2: Sets forth the procedures for providing replacement
Y~ousing for low/moderate-income dwellings, demolished or converted
to a use other than low/moderate-income dwellings.
Section 3: Sets forth. the authorizing authority for providing
relocation assistance.
Section 4: Sets forth the steps that will be taken to minimize
displacement of persons from their homes.
The full text of said Plan is available at City Hall, 12 North
Center Street, Rexburg, to any citizen upon personal request during
normal office hours and is posted throughout the communit~.

RESIDENTIAL ANTI-DISPLACEMENT AND RELOCATION
ASSISTANCE PLAN
Onder Section 104(d) of the Housing and Coomunity Development Bct of 1974, as amended

The City of Rexburg will replace all occupied and vacant occupiable lowlmoderate-
income dwelling units demolished or converted to a use other than as lowlmoderate-
income housing in connection with an activity assisted with funds provided under the
Housing and Community Development Act of 1974, as amended, as described in
24 CFR 570.606 (b) through (g) .
All replacement housing will be provided within three years after the commencement
of the demolition or conversion. Before entering into a contract committing the City
of Rexburg to provide funds for an activity that will directly result in demolition or
conversion, the City of Rexburg will make public by advertisement in the Standard
Journal, and submit to the Idaho Department of Commerce the following information
in writing:
1. A description of the proposed assisted activity;
2. The location on a map and number of dwelling units by size (number of
bedrooms) that will be demolished or converted to a use other than as
low/moderate-income dwelling units as a direct result of the assisted
activities;
3. A time schedule for the commencement and completion of the demolition or
conversion;
4. The location on a map and the number of dwelling units by size (number of
bedrooms) that will be provided as replacement dwelling units. If such data
are not available at the time of the general submission, the City of Rexburg
will identify the general location on an area map and the approximate number
of dwelling units by size and provide information identifying the specific
location and number of dwelling units by size as soon as it is available;
5 . The source of funding and a time schedule for the provision of the replacement
dwelling units;
6. The basis for concluding that each replacement dwelling unit will remain a
low/moderate-income dwelling unit for at least 10 years from the date of initial
occupancy;
7. Information demonstrating that any proposed replacement of dwelling units
with smaller dwelling units (e. g. , a 2-bedroom unit with two 1-bedroom units)
is consistent with the housing needs of lower-income households in the
jurisdiction.
The City Clerk, City of Rexburg, 359-3026, is responsible for tracking the
replacement of housing and ensuring that it is provided within the required period.
The City Clerk, City of Rexburg, 359-3026, is responsible for ensuring
requirements are met for notification and provision of relocation assistance, as
described in CFR 570.606 (b) through (g) , to any lower-income person displaced by
the demolition of any dwelling unit or the conversion of a low/moderate-income
dwelling unit to another use in connection with an assisted activity.

Consistent with the goals and objectives of activities assisted under the Act, the
City of Rexburg will take the following steps to minimize the displacement of persons
from their homes:
1. Coordinate code enforcement with rehabilitation and housing assistance
programs .
2. Evaluate housing codes and rehabilitation standards in reinvestment areas to
prevent their placing undue financial burden on long-established owners or
tenants of multi-family buildings .
3. Stage rehabilitation of apartment units to allow tenants to remain during and
after rehabilitation by working with empty units or buildings first.
4. Establish facilities to house persons who must be relocated temporarily during
rehabilitation .
5. Adopt public policies to identify and mitigate displacement resulting from
intensive public investment in neighborhoods .
6. Adopt policies which provide reasonable protections for tenants faced with
conversion to a condominium or cooperative .
7 . r? dopt tax assessment policies such as deferred tax payment plans to reduce
impact of rapidly increasing assessments on lower-income owner-occupants or
tenants in revitalizing areas .
8. Establish counseling centers to provide homeowners acid renters with
information on the assistance available to help them remain in their
neighborhood in the face of revitalization pressures .
(The jurisdiction should include one or more of the above to implement the planning
for minimizing the direct and indirect displacement of persons from their homes. )
The City of Rexburg hereby certifies it has officially adopted and published said
Residential Anti-Displacement and Relocation Assistance Plan. This plan shall
become effective January 6, 1993.

HOUSING RESOLUTION FOR THE CITY.
A summary of the principal provisions of the Fair Housing
Resolution adopted by the CITY OF REXBURG on DECEMBER 18,1991, are
as follows:
Section l: Sets forth the purpose and intent of civil rights
protection legislation and the areas to which the plan will apply.
Section 2: Sets forth the policy and procedure for carrying
out activities in a nondiscriminatory manner in project assessment,
processing, and decision making.
Section 3: Sets forth the assistance that will be available
from the City to those who feel they have been discriminated
against.
Section 4: Sets forth the steps the City will take to
publicize this resolution and give notice to the public of the
City's policy and procedures concerning nondiscrimination.
