A motion was made by Nyle Fullmer and seconded by Brad Liljenquist to

RE: AGREEMENT WITH UTAH POWER & LIGHT FOR POWER TO NEW WELL NORTH OF
TOWN
Mayor Boyle read an agreement for a power agreement with Utah Power and
Light for power to the new well north of the city. There has to be a
contract on demand which is $4,179 per year. Glen Pond declared a
conflict of interest, he is an employee of the Utah Power and Light.
(discussion) A motion was made by Nyle Fullmer and seconded by Brad
Liljenquist to authorize the mayor to sign the agreement. All Aye
RE: IDAHO HERITAGE TRUST GRANT FOR THE TABERNACLE
Idaho Heritage Trust has given a grant of $1000 for the Tabernacle
Civic Center for maintenance, we need to fix up all the windows. It is
a matching grant, which we can do the match with $1000 of repairs.
RE: LETTER FROM SOME CITIZENS AGAINST 1~ INITIATIVE
We have a letter from the citizens against the 1~ initiative. They
recommend that we get involved and send a letter to all of our
employees explaining how it would effect the city. The mayor asked the
council how involved they wanted to get? Rexburg would loose $61,452,
which is 9.46 of our property tax. It will be hard to make up. Nyle
Fullmer stated that we need to make the people aware of it, but he
hates to get involved as a council. Glen Pond stated that the public
needs to be aware of what it will cost the city, but there are other
flaws within the 1~ initiative. Nyle Fullmer suggested that the mayor
have a press conference.
RE: MARTHA DAVIS REPLACES JUDY WALKER ON THE TRAFFIC SAFETY COMMITTEE
Bruce Sutherland told the council Judy Walker had moved and recommended
that we replace her with Martha Davis on the Traffic Safety Committee.
A motion was made by Bruce Sutherland to do so. All Aye
RE: STOP SIGN TO BE PLACED AT 1ST SOUTH AND ASH
Bruce made a report on the Traffic Safety Committee meeting to discuss
a stop sign at the corner of 1st South and Ash heading East. After
discussing it and touching basis with the Chief of Police, the decision
was to place a atop sign on 1st South at corner of Ash going east so
the east bound traffic would come to a complete stop. Because of the
shape of the corner, it is also recommended by the Traffic Safety
Committee a one foot line be painted across the street so the traffic
could see exactly where to stop. Chief Siepert felt that where it dead
ends on the corner that that would be an appropriate place for the stop
sign.

RE: DISCUSSION OF STOP SIGN AT ASH & MAPLE - LEAVE IT A YIELD SIGN
The other decision the Traffic Safety Committee made in relation to an
earlier decision is when Madison Profession Plaza was put in, they had
recommended that a stop sign be placed at the corner of Ash and Maple,
right now there is a Yield sign and they recommended that the Yield
sign be left at that corner. (discussion) The mayor suggested that
the council go look at the area and discuss it at the next meeting.
RE: PROPOSAL FROM THE CHAMBER OF COMMERCE TO FORM A COMMITTEE "ADOPT A
POLE", FOR CHRISTMAS DECORATIONS
Brooke Passey and Clair Boyle was at the meeting. Brooke acted as
spokesman for the Chamber of Commerce. They are forming a committee
called Adopt a Pole as far as Christmas Decorations are concerned.
They would like to get the residents and the downtown businesses,
especially along Main Street, to take a street light pole and help with
refurbishing the decorations that are already available and each year
enhancing and adding to those decorations and expanding down 2nd East
and also down 2nd West. There are lights with power hookups down
College Avenue and down toward Penneys. He was not sure how far they
go on Center Street. The plan is to get the committee formed and open
it up to church groups and school classes to come up with some ideas to
make their pole fun. We will have to have some guidelines. We are
shooting for the week before Thanksgiving and have a Thanksgiving
lighting ceremony and Christmas parade with Santa Claus. They wanted
to get the residents involved in decorating Main Street, working with
the city and Utah Power & Light and their equipment, and possibly get
some private businesses that have buckets on their trucks to help.
Brad told him it was a good idea and asked what they needed from the
council.
The mayor stated that we have budgeted $1500 from the city and $1500
from the Chamber. That won't go very far. They would like to see the
citizens get involved. They just wanted to bring it to the attention of
the council. If the council knows anyone that would be a good member
of the committee, they would like some input. Clair said we need
guidelines on it because when the decorations come down they would be
the property of the city. They are looking at the decorations growing
and will need other storage.
The mayor stated that a couple of groups from the college and one from
the Relief Society want it for a project to refurbish the decorations.
Next year we will need to add to the decorations.
A motion was made by Bruce Sutherland and seconded by Jim Flamm to pay
the bills. All Aye
RE: MUTUAL AID AGREEMENT BETWEEN REXBURG AND RIGBY SANITATION
DEPARTMENTS APPROVED
The mayor told the council we had a Mutual Aid Agreement drawn up with
the City of Rigby on the Sanitation. The city attorney had drawn up
the agreement. A motion was made by Nyle Fullmer and seconded by Jim
Flamm to approve the agreement. All Aye (copy attached and on file)

ROUGH DRAFT
MUTUAL AID AGREEMENT
THIS AGREEMENT made this 1st day of October, 1997.,
between the CITY OF REXBURG, a municipal corporation, whose
mailing address is 12 North Center, Rexburg, Idaho, and the
CITY OF RIGBY, a municipal corporation, whose mailing address
is 158 West Fremont Avenue, Rigby, Idaho.
RECITALS
1. The parties desire to enter into a mutual aid
agreement f_or the exchange of garbage trucks when one city or
the other's garbage truck is inoperable or incapacitated,
2. Each party is willing to aid and assist the other
in the conduct of this mutual public service operation.
3. It is agreed that the most desirable form of
business for conducting the operation is through a mutual aid
agreement.
For the reasons cited above, and in consideration of
the mutual covenants contained in this agreement, the parties
agree as follows:
SECTION ONE
SCOPE AND DESCRIPTION
By this agreement, the parties enter into a mutual
aid agreement for non profit.
SECTION TWO
CONTRIBUTIONS
The City of Rexburg agrees to provide one of its
garbage trucks to the City of Rigby whenever the City of
Rigby's garbage truck is incapacitated, inoperable, or unable
to perform its function and will make said truck available upon
the terms and conditions set forth in Section Three.

The City of Rigby also agrees to the same terms and
conditions when the City of Rexburg's garbage truck is
inoperable or is for any reason unable to perform its
functions.
SECTION.THREE
TERMS AND CONDITIONS OF MUTUAL AID AGREEMENT
1. Each party shall be responsible for providing the
driver for its own truck when called upon to aid the other.
7. The driver of each party's truck shall be covered
by the owner of the truck's workmen's compensation and
liability insurance and the premium f.or such insurance shall be
paid by the owner of the truck.
3. .The city using the other's truck agrees to
reimburse the actual cost of the .city providing the .truck upon
presentment of a written invoice on a monthly basis.
4. Any repairs, accidents or other damage or injury
occurring to the city's truck caused by the operator_ or while
in the operation of the truck by the other party hereto, shall
be the individual responsibility of the owner of the truck.

SECTION FOUR
TITLE TO THE PROPERTY
Title to each respective truck shall remain within
the ownership of the city furnishing the truck. The parties
agree to provide aid on an emergency basis to the city
requesting such aid.
SECTION FIVE
RECORDS AND ACCOUNTING
Each city shall maintain or caused to be maintained
accurate records concerning the operation of the truck while

engaged in the aid or service of the other requesting the use
of the truck. On a monthly basis, each city shall transmit any
billings for the use of its truck by the city being benefited.
SECTION SIX
INSURANCE
Each city shall maintain full insurance coverage on
each of its garbage trucks and shall also make sure that any
drivers or operators of said trucks are properly licensed and
fully covered by workmen's compensation insurance.
SECTION SEVEN
ASSIGNMENTS AND TRANSFERS
Neither party shall assign its rights or duties in
this mutual aid agreement without the express written consent
of the other. Any attempted transfer or assignment made
without the consent of the other party shall not relieve the
transferor or assignor of its duties or obligations pursuant to
this agreement.
SECTION EIGHT
ARBITRATION
In the event of any dispute arising out of the
performance of the terms and conditions of this agreement, such
agreement shall be submitted to arbitration under the
provisions of Idaho Code, Title 7, Chapter 9.
SECTION NINE
TERM
The effective date of this agreement shall be the
date first above written, and this agreement shall
automatically be renewed on an annual basis until properly
terminated as set forth in Section Ten of this agreement.
SECTION TEN
TERMINATION OF AGREEMENT
Either city may terminate this agreement by giving to
the other at least ninety (90) days advanced written notice of_

its desire to terminate this agreement. Any monies due and
owing by the other shall be accounted for and paid and then the
agreement shall be terminated at the end of the ninety (90)
days. The parties may also agree in writing to mutually
terminate this agreement upon such terms as are agreeable to
both.
IN WITNESS WHEREOF, the parties have executed this
agreement the day and year first above written.
