A motion was made by Glen Pond and seconded by Brad Liljenquist to
approve the minutes. All Aye.
RE: DISCUSSION ON CRUISING
A group of young men were at the meeting to ask what is going on with
the cruising issue. The mayor explained because of the shooting last
week, in an article in the paper there was a lot of people who said we
need a curfew and need to keep the kids off the streets. In the past
the council have not been in favor of a curfew. We have been told that
a cruising ordinance would be illegal. We have been pressured to have
more police on duty on Friday and Saturday nights. If there are fights
or if there is alcohol and drug use, there will be more enforcement.
Brad Liljenquist stated that he would concur with that. We have
budgeted for another police officer for next year. Nyle Fullmer said
the last two weekends we have had a couple of reserve officers on duty
helping with the situation. If there are illegal things going on and
they are dangerous to other drivers, there will be police out in force
to control it.
Jim Flamm stated that the fellows at the meeting are a good asset to
us, if they know we are not going to kick them off the streets. A lot
can be done with self policing and getting the word out and help
support us.
The mayor said the cruising is not the problem. They asked about the
parking lots. They have been able to park in the lot of the old V1
station and other lots and talk. They were told if it is a problem to
the business, then it is a problem to the city. The V1 Parking lot is
owned by a couple of individuals, and if they don't sign a complaint,
then V1 is fine to park.
Nyle Fullmer stated this is correct unless problems are taking place in
the back of the lot in the dark. He said cruising isn't the. issue. The
problem is the illegal activities that are taking place, the
obstruction of traffic, the harassing of motorist going by, the alcohol
consumption and the rest that goes along with it. This goes along with
the cruising. As long as those problems don't take place there won't
be a problem. Parking on private property is entirely up to the
property owners. If they call us in, that is when the law enforcement
will come in. There is some talk that some private business parking
lot owners are going to post "No Loitering"signs. If that takes place
it will be another situation.
They said they had been kicked out of parking lots. The mayor said
unless it is posted it won't happen anymore.
They asked about turning around at the Courthouse Parking Lot? The
mayor said unless it is posted, anyone can turn around. It would be up
to the county.

RE: BUDGET FOR 1992-1993 PRESENTED BY RICHARD HORNER - TREASURER
Richard Horner presented the Tentative Budget of $13,354,900. He
handed out copies of the budget and copies of the Property Tax
Breakdown. We have kept the property tax to a minimum. The city levy
will go down. A motion was made by Glen Pond and seconded by Brad
Liljenquist to approve the tentative budget and set the hearing. All

RE: ITINERANT BUSINESS LICENSES NOT NECESSARY FOR PEOPLE SELLING
PRODUCE
Discussion on clarification of the Itinerant Business licenses for
people selling produce. They would need to pay for a regular license
fee, if they grow their own produce.
RE: TRAILER HOUSE REPORT
When Morgan Garner was on the council, they had a trailer house
committee, and checked all the trailer houses and either had them move
them or gave them a variance. The mayor stated that he and Rose had
checked the trailers that still remained. We have contacted everyone
except one.
The trailer owned by Cora Nelson at 58 West lst North - The family said
she is in a nursing home and gets upset if something happens to that
trailer house she would never have a place to come home to. We told
them they could leave it there until she passes away.
There is a trailer behind the Candy Company at 251 South 5th West, that
no one lives in since Mr Barrick died. It is unlivable and they store
things in it. The mayor felt in that Industrial Zone it was okay to
leave it there for that purpose.
There is a trailer owned by John Chapple at 228 South 4th West. Our
feeling is it looks better than anything in that neighborhood. It is
landscaped and looks nice. It is almost hidden by the trees. You
don't even notice it when you drive by and our feeling is it is
probably okay to leave.
There is another one that was owned by Hazel Weatherston at 125 South
4th West that has been included in J. D. Hancock's trailer court, so it
is okay.
There is another owned by Ray Loveland at 226 West 3rd South and he
said they would move that trailer.
RE: "RED AND WHITE DAYS" PROCLAIMED
The mayor read a Proclamation for "Red and White Days" August 29,
1992. A motion was made by Jim Flamm and seconded by Nyle Fullmer to
approve the proclamation. All Aye.
RE: REVIEW OF STUDENT HOUSING PARKING LOTS
Review of Student Parking -Last year we had a committee that reviewed
student parking and gave same owners a year variance to get their
paving done. The mayor stated that he and Rose had gone around and
checked them. There are some who still have not done the paving and
say they still can't afford to do the paving.
Raymond Hill at 378 1/2 East Main - has not done his paving and says he
still can't afford it and wants another year extension. His parking is
clear back of the house.
Cliff Jaussi has not paved his lot. We did not talk to him, because
last year he said he did not have money to do it and it is back where
it is not seen.

Hillcrest and Chaparral have neither one done anything. They have
plenty of room, but all their spaces are not blacktopped. Chaparral
was inspected and have some other problems that have to be done.
The mayor asked the council how strict they wanted to be and if we
should grant any extensions? Brad Liljenquist thought we need some
bases for granting an extension and is not having the money enough
bases for granting an extension. The mayor said Cliff Jaussi and
Raymond Hill have a good base on their parking lot and their lots are
clear behind the houses and no one would see them. (discussion) Glen
Pond asked what was the intent? The mayor stated it was to get them
into compliance. Nyle Fullmer felt it was also to clean them up and
make them look nice. It was felt by the council that the commercial
units need to be done this year, the parking at the homes we would give
another year extension. The mayor said we would write a letter.
RE: REVIEW OF THE WASTEWATER TREATMENT PLANT STUDY
The mayor discussed when to raise the rates. He felt we should start
raising the rates in May, because it would be a sizable increase for a
lot of people who don't have time to budget for it, especially the
apartment owners. We thought we would raise the fees May 1 to make it
more fair. As we looked at the construction schedule it will not be
finished until the fall of 1994. We may not have any payments in 1994
and we might have just one. By the time the payment comes due we will
have $300,000 in excess for the payment. (discussion) We need to
decide whether to go 10 or 15 years on the bond. Brad said he
.originally thought 10 years to get it paid off. With the effect on the
sewer bills, we need to be sensitive to that and keep the sewer bills
as Iow as we can. The mayor asked John Millar if in 10 years we have
to do something else like phosphate or nitrate removal, what kind of an
additional figure are we looking at? John said the one he would see
being more prevalent would be phosphate removal, which would probably
cost under 1/2 million. (discussion) A motion was made by Jim Flamm to
set the rates on a 15 year pay out. Seconded by Farrell Young. Those
voting aye: Jim Flamm, Glen Pond, Brad Liljenquist, Farrell Young.
Those voting nay: Nyle Fullmer
The council felt we need to do more study on a base fee. They asked
Richard to figures for equivalent user fees.
RE: DISCUSSION OF PROPERTY BY WALKER SUBDIVISION NEXT TO 3RD EAST
John Millar talked to the council about property along the road next to
the Walker Subdivision next to 3rd East. 3rd East is 99 feet and then
it narrows back to 60 feet. The Walkers would like it narrowed back to
60 feet so it would line up. It would be the 200 feet north of the
bridge. If the road was 44" wide it would be as wide as 2nd East. J.
D. Hancock said it would have to be abandoned equally on both sides and
we would have to have a formal petition.
A motion was made by Brad Liljenquist and seconded by Nyle Fullmer to
pay the bills. all aye.
Jim Flamm discussed raising fees for garbage collection. (discussion)
It was decided to put it off until after the bond election.

NOTICE OF PUBLIC HEARING
BUDGET FOR FISCAL YEAR 1992-93
CITY OF REXBURG, IDAHO
Notice is hereby given that the City Council of the City of Rexburg, Idaho,
will hold a public hearing for the consideration of the proposed budget for
the period October 1, 1992 - September 30, 1993, pursuant to the provisions of
Section 50-1002, Z.C., said hearing to be held at City Hall, Rexburg, Idaho,
at 7:45 p.m., on September 2, 1992. At said hearing all interested persons may
appear and show cause, if any they have, why said proposed budget should not
be adopted.

The following is an estimate set forth in said proposed budget of the total
proposed expenditures and accruing indebtedness of the City of Rexburg, Idaho,
for the fiscal period October 1, 1992 - September 30, 1993.

and revenues for fiscal year 1992-1993, all of which have been tentatively
approved and entered at length in the Journal of Proceedings. I further
certify that the City of Rexburg, Idaho, did give notice for said hearing with
notice having been published at least seven working days prior to the adoption
of the budget by the City Council. Citizens are invited to attend the budget
hearing on September 2, 1992, at 7:45 p.m., and have the right to provide
written or oral comments concerning the entire City Budget. A copy of the
proposed City Budget in detail is available at City Hall for inspection during
regular office hours, 8:00 a.m. to 4:00 p.m.
