Brad Liljenquist made a motion to approve the minutes. Farrell Young seconded the motion. All Aye. RE: CONCERN FOR UNCOVERED DITCH BETWEEN TARAUS & PARK ST. Kristy Keller - 640 Park Street - A few weeks ago a policeman came to her with a complaint from Mr. Steiner, the owner of a ditch in her back yard, about all the debris in it and felt it wasn't his responsibility to clean it out. This has been taken care of but the officer was surprised that that ditch was there and uncovered. She wants to bring it to the Councils attention again. This is a stretch of ditch that goes the length of 3 homes between Taurus and Park Street. Some time ago most of that ditch was replaced with a culvert - along the park on 5th West, ran down between the two streets, the residential area by Kennedy School and most of that was taken care of. However, there was a family or two who felt it wasn't to their best interests to pay their portion and have it taken care of and as a result (speaking specifically about the Hubbard Family) they stopped it because they didn't want to pay and have the job done, and so by the last 3 homes the ditch is open. It is running full, it is fast and deep and it is dangerous. They are not in the country, they are in the City right by an elementary school and she feels something needs to be done. At the very least, would they come and look at it. Richard said it cost approximately $2,500 a lot to do it. In the future the City needs to look at developments and what should be done with the ditches. Right now the developer is responsible for what is done but the developer must answer to the City. Bruce suggested putting in a gate with a lock so Mr. Steiner could still get in when he needed to but children could not. The Mayor felt the City could put the gate in. Council will look at the problem. RE: DECISION MADE & MOTION PASSED FOR ARTERIAL & COLLECTOR ROADS Next item discussed was the arterial roads. A report from Pres. Bennion of Ricks College was entered into the minutes. (report at the end). The recommendation from the College is that 7th South be a major arterial down to 2nd West and then 2nd West with a gradual curve over to 11th S. and then go down 11th S. and tie in with the highway. Mayor asked Dick Dyer how close they had to be on whether it was a major or a minor arterial, collector, etc. Dick said basically if you name it anything from a collector on up that gives you the eligibility that you are after which is the purpose of this map, so that at some future date as you go to develop it you can justify what it is. (Some discussion.) ' ':~ Brad Liljenquist moved that they delete from the map as a collector 2nd West North of 3rd North and add as a collector that section of land between section 20 and 21, (from Barney Dairy road north to 1000 East). Bruce Sutherland seconded the motion. All Aye. Bruce Sutherland made the motion that they delete 9th South as a major arterial from the Yellowstone Highway to Mill Hollow; add as a major arterial from Yellowstone Highway on 11th South to 2nd West, from 2nd West to 7th South and 7th South to Mill Hollow Road. The motion was seconded by Brad Liljenquist. All aye. A motion was made by Brad Liljenquist to designate 7th South as a minor arterial road from the Yellowstone Highway to 2nd West. Also, that 11th South be a major arterial road from 2nd West to Mill Hollow. Bruce Sutherland seconded the motion. All aye. Jim Flamm moved that they designate 2nd West a major arterial from 11th South to 4th South. Nyle Fullmer seconded the motion. All aye. RE: MOTION PASSED TO AMEND THE MADISON COUNTY-CITY OF REXBURG COMPREHENSIVE PLAN 2000 Nyle Fullmer moved that they amend the Madison County-City of Rexburg Comprehensive Plan 2000 to conform with the above changes. Motion seconded by Bruce Sutherland. All aye. RE: FIREWORKS PERMITS APPROVED Those asking for fireworks permits are: 1. Alice Johnson Ellsworth - Beehive Book parking lot 2. Ned Sweat - Broulims Market 3. Ned Sweat - Vacant lot next to McDonalds 4. Connie Smith - King's 5. W. Charles Porter - Porter's Book and Variety Brad Liljenquist moved that the above people be approved to receive fireworks permits. Nyle Fullmer seconded the motion. All aye. RE: RESCHEDULING NEXT CITY COUNCIL MEETING It was discussed when to have the next City Council meeting due to the A.I.C. meetings being held in Boise on June 17th. It was decided to have the meeting on Tuesday, June 16th at 8:00 a.m. Brad Liljenquist was asked to notify the "Shop Rexburg" people that their meeting would have to be moved to the break room. RE: ABRAMOWSKI TORTE CLAIM DENIED The City has been served with a Tort Claim from the Abramowski family. Bruce Sutherland moved that they deny the Tort Claim. Nyle Fullmer seconded the motion. All aye. RE: EASEMENT PROBLEM BY DAVE MOORES HOME J.D. will check in to the easement problem up by Dave Moore and will report back to the Council. RE: LENI DAVENPORT APPOINTED TO THE ARTS COUNCIL Ruth Christensen has asked to be released from the Arts Council and they have asked that Leni Davenport be appointed. Farrell Young said she was very artistic and articulate and willing to do it. The Mayor was given the approval to go a head and appoint Leni Davenport to the Arta Council. RE: REPORT FROM PLANNING & ZONING Jim Flamm reported on the Planning determined that variances are to be committee. and Zoning meeting. It has been granted by the planning and zoning RE: RETRIX r i Jim is concerned about the problem with Mike Ferguson adding on to Retrix. Everyone on P & Z and the City Council want him to build on to the back right to the fence line but they need to find a way for him to do it within the requirements of the law. J.D. will work with him to get all the legal paper work ready. RE: HENDERSON SUBDIVISION The Henderson sub division was brought before the committee for them to see some of the changes that have been made. RE: HENDERSON APARTMENTS The Henderson Apartments up by the Armory were discussed. There were no strong feelings either way. Hendersons would be asking for Harvard to be closed. The general feeling of the Council was that that would be okay. RE: AGRICULTURAL ZONE Suggested ideas for agricultural zones were handed out by J.D. The Mayor asked for a copy so he could have it for the Impact Zone meeting. RE: R.V. PARKING ORDINANCE Planning and Zoning felt the R.V. parking ordinance should remain the way it is. The Council agreed to leave it the way it is. Jim Flamm will work with the people on Rolling Hills to work out the problem there so they comply with the intent of the law. Bruce Sutherland asked about a home on the corner of Rolling Hills and Shoshone that has been built in the last 2 years but has no sidewalk. Why has this been allowed? The Mayor will talk to our building inspector about it. RE: PROPERTY BEHIND TERRA VISTA NEEDS TO BE CLEANED UP The Mayor mentioned that the property behind the homes on the South side of Terra Vista drive, being farmed by Darrell Neville, is really a mess. The mess that is there is caused by all the property owners not Darrell Neville. The Mayor has written a letter to them stating that they need to clean that up so the City can maintain it. RE: PROPERTY BY RANDALL PORTER NEEDS TO BE CLEANED UP Brad said there is a piece of property behind Randall Porters place on 2nd East - from the Armory to Porters - that is really looking bad. Rose was asked to send them a letter to clean it up. RE: DISCUSSION OF CITY SHARING COSTS OF AIRPORT RESURFACING Nyle Fullmer reported that last Summer when they did the resurfacing of the runway the airport board made the determination that they wanted to go ahead and prepare to extend a water line underneath the runway at the time so that if and when they got ready to bring over City water and sewer it would be in place and they would not have to go back in and dig up the runway. The airport board has respectfully requested that the City pick up part of that bill. There was $3,100 in pipe that they would pay for but would like the City to pay the $2,700 in backhoe and excavation charges. Brad asked if they were strapped for money and Richard said they have 40-45 thousand dollars in their account. Nyle said their only rational was that they feel like the City is getting benefit from that and they would like to use their funds for equipment and up grading the airport itself. It is the Cities airport. The Council felt they should have been notified before the work was done. Brad moved that the City not pay for it. Jim Flamm seconded the motion. All aye. RE: SEWER LINE BY TAYLOR CHEVROLET Taylor Chevrolet would like us to extend a sewer line to them. The Middle School will have their own pump station. Not knowing what kind „~ ~~ , of development will be going on there and also with the other major sewer costs we are looking at, it was felt they could not consider it at this time. RE: $30,000 CHECK FROM WALMART FOR NEW WELL The Mayor said we have a check for $30,000 from WalMart for the well and the land. With the moratorium the only thing the well can be used for now is fire protection. They think the moratorium will be reviewed and lifted sometime in the next year. WalMart already has water for culinary use. Farrell asked how the L.I.D. was coming for Cornell and Cresthaven. The Mayor said the bide would be opened at 2:00 p.m. Friday. (June 5th) There was some concern expressed about how close the Middle School is being built to 7th South. It looked like there was no room for a drop off lane. The Mayor will ask Terry to check on it. Farrell Young moved that they pay the bills. Brad Liljenquist seconded the motion. All aye. Meeting adjourned. Bennion SUBJECT: Ricks College Recommendations for Major Arterial Services for the South End of Rexburg Ricks College has appreciated the opportunity the city has provided for giving input into the future planning of major arterial services for the south-end of Rexburg. The college realizes that its location on the south side of the city is a factor in the city's planning for future street locations that would best aid the flow of traffic into and out of the city. At the same time, the college also has concerns for the safety of its 7500 students and for a city plan that would take into consideration the needs of those students and the college as a whole. The college is also concerned that whatever steps are taken are in accordance with the direction the college receives from its Board of Trustees. After reviewing the proposed plans and after considering the needs of the city as well as the concerns of impacted residents, the college would like to propose the following: Consideration should be given to Locating as soon as possible a major four Lane arterial at the south end of Rexburg beginning at the south freeway exit at 11th South. The arterial should proceed straight east across 5th West to approximately 2nd West where it would gradually turn North running through Ricks College property until it reaches 7th South. At this point it would gradually turn east at 7th South running through Ricks College property until it intersects with znd East. Consideration should also be given to a Long range plan of continuing 11th South straight east from 2nd west until it intersects with 2nd East at the Cresthaven Church. It is the College's opinion that this plan has the following merits: 1. It incorporates the benefits of short term design into the long, range plan. By directing the access arterial from the freeway exit :rtaight east .along 11th South to 2nd West approximately 60 percent of an eventual long range 11th South Street through to 2nd East will already be developed. 2. While this route may be a little longer than an angle route to its merge with 7th South, its added costs would be reduced i .~.~ .~ because of its minimal impact on home and land acquisitions along 5th West. In the long run, its costs would be further reduced because 60 percent of the 11th South option would already be in place. 3. The minimal impact on homes and land along 5th West would be welcomed by those residents living along 5th West. 4. The proposed route would by pass the new Middle School and greatly reduce the safety concerns of school patrons. 5. The proposed rc~ite would allow room for a four lane arterial that would greatly speed up the traffic into and out of Rexburg. 6. The proposed .route through college-owned property, while extensive, would follow .non-tillable contours and would minimize impact on the long-range college master plan (including the development of a possible college/community arboretum.) 7. The suggested route would funnel considerable traffic down 2nd West and reduce the impact on 2nd East. 8. The proposed route would allow the college to create an attractive entrance way through college-owned property onto campus and into the city that would be beneficial to both. SUNII~IARY ~` Ricks College would: hope that the Rexburg City Council would carefully consider the above proposal as it: 1. Addresses the safety needs of both the new middle school and the college. 2. Provides short term east/west access on a four lane hiway into and out of Rexburg while tying in to a future long range plan. 3. Most of the residents along this stretch of road built their homes fifteen to twenty years ago and did not anticipate that it would become a main road into Rexburg. With the building of a new school near the area, it is expected that within a few years a subdivision and/or more neNV homes will be built in this area. It is and will be a dangerous road if more traffic is directed through it from the hill. The road does'not access the freeway entrances easily and has many people who would have a hard time accessing the road from their homes because of the high volume of traffic this would create. Brent I{inghorn called me immediately folliow~~n yfrom Wedne day n~ght toe of the street development plans. The shift of you g early Wednesday morning to accommodate the high school graduation also made it possible for me to know the results of your decisions prior to attending the last formal Board of Trustees meeting that will not be held until late August. At any rate, I wanted to report the results of my presentation to the Board. I discussed principally. the shorter term plan t outh tooSe and Westtand do admoderate the old Yellowstone Highway on Eleventh S bend (not aright-angle turn) at Second West moving north to Seventh South where there would be another mcx;erate bend at Seventh- South going east to Second East. I mentioned how critically this street was needed to provide solid access to various parts of Rexburg and to Ricks College, and I emphasized the vital safety concerns that would be met with this route bypassing both the new middle school and Ricks College. The Board of Trustees discussed the matter after about a 10 to 15-minute presentation and voted to donate the land that the collegelChurch owns on this route to the city of Rexburg for the development of this arterial. I had underscored the urgency of timing with this project in that the proposal needs to be written and submitted to Boise within a few days and also that the middle school will be opened by August 1993 and the increased flow of traffic from the east to that part of. town and back will be substantial. The donation of this land to the city of Rexburg is contingent on the city of Rexburg donating Fourth South (Viking Drive) to Ricks Co flegoe (f seodmbuilding at Ricks econd East). As you are aware, with the developme p po College moving south across Viking Drive, we are deeply concerned about the safety /.~, ;^i !1 Mayor Nile Boyle and Members of the Rexburg City Council June 4, 1992 Page 2 and the aesthetics of the campus. We are likewise concerned about making a smooth transition with the city as these developments occur so that adequate cross-town routes are available. The Board of Trustees also approved the development of aloes-maintenance arboretum that will border the Second West and a good portion of the Seventh South arterial--making an attractive entry to the campus and that part of town. I wanted to share these outcomes with you and also express appreciation for the cooperative discussions we have had on several occasions concerning these vital community developments. I am gratified that the Board of Trustees acted in both a timely and generous way to expedite support for the project. We are keenly aware of the critical need to support you in any way we possibly can to help make this project a top priority for funding in the immediate future.
