A motion was made by Nyle Fullmer and seconded by Farrell Young to approve the minutes. All Aye. RE: PUBLIC INPUT ON THE REQUEST FROM POST OFFICE TO CHANGE SOME STREET NAME S Public input on the request from the Post Office to change the names of the streets 350 South Street, 450 South Street and 350 North Street. They are having a problem with these addresses with the street addresses in the county. Our ordinance 221, passed in 1919, if we would have been careful about following this, we probably wouldn't have had this problem. When they adopted the numbering system for the county they started with 1000 and went out from there. The 350 and 450 would be confusing with the county addresses. The telephone books have got the wrong addresses listed. Lloyd Luke sent a letter (on file) he also testified. He had contacted the people on that street and one person suggested the name "President" street. Another suggested "Bench", some of them liked the number "Rolling Hills". Mayor Boyle read a letter from Alan D Palmer (on file). Patricia Forsgren - is there a chance we won't have to change the numbers? It would be hard to change the name. Could the streets names be grandfathered? Lloyd Luke - could the City Council over ride the Post Office? The mayor told him we could. Rex Larson - Fire Department - said it is getting to be more of a problem all the time where the city and county addresses are nearly the same. You have to be more careful when given an address to get the right one. Lloyd Luke said if the council can over ride the Post Office he would like to leave the streets as they are. Ranae West -450 So - We do have a problem in the School District. If it is a problem for the emergency vehicles, I would agree to change. She would vote for the name Grandview. Jay Flukinger - 450 South - I have had to give my address over the phone and find it confusing. He would not object to having a name assigned to it. Charles West - 450 South- We get the mail for the President of the College because of the confusion. He wouldn't object to changing the name. ~~ Mrs Forsgren - Would you give us one or two years for the change of address and forwarding? The mayor stated that the maps in the phone book would have to be changed and addresses and there would need to be other changes. Brad Liljenquist asked Rex Larson how big of a problem the street numbering is for the Fire Department. Rex said as long as we get the right address, we are okay. Down the road in the future, if the roads go on through, will you keep it the same or change it as you add more houses. He was told the name would go clear through. The suggestions are Rolling Hills for 350 South and Grandview for 450 South. Brad asked about when 550 and 650 go in will we name them. Nile said when those plats were presented we would make sure there were names on the plat. Farrell asked if there are any County streets exactly the same as we have 350 & 450. They start at 1000. The mayor said we need to change 350 North and the suggested name is Valley River Drive. A motion was made by Nyle Fullmer to change 350 South to Rolling Hills Drive. Debbie Leishman - 450 South - We are in the area of the Indian names and she understood that Cresthaven has the View names. How close should we stick to our area with the names. Should we be cautious of naming names that stay in our area? The mayor said we need to be cautious. Brad Liljenquist said he preferred to leave it as it is now. Sheryl Hansen - 450 South - If we change the name, how soon will it go into affect. Will we have to change our checks and everything right away? The mayor said we would have to have a transition period. John Millar stated that the Planning & Zoning did recommend changing the names. Discussion Jim Flamm stated the Post Office started the mess. Nyle Fullmer withdrew his previous motion. A motion was made by Nyle Fuller and seconded by Brad Liljenquist to change 350 South to Rolling Hills Drive; 450 South to Grandview Drive; 350 North to Valley River Drive. Jim Long suggested that Nyle's motion give a date. Farrell stated that the Post Office needed to deliver mail to both addresses for a while. Mayor Boyle asked for a vote on the motion. All Members voting aye. The council stated that they wanted the street signs up as soon as possible. RE: PUBLIC HEARING FOR ANNEXATION OF TERRY BAGLEYS PROPERTY (MELALEUCA ) 8:00 P. M. A Public Hearing pertaining to the annexation to the City (property formally owned by Diet Center, now owned by Terry & John Bagley and leased by Melaleuca). TOWNSHIP 6 NORTH, RANGE 39 EAST, BOISE MERIDIAN, MADISON, COUNTY, IDAHO Terry Bagley- A month ago the council ask him what was produced by Melaleuca on the property. He has asked a representative of Melaleuca to come to the meeting tonight. Jace Pool from Melaleuca was at the meeting and explained items from a box of samples. He explained they have about four operations going on in the building. The first one is a packaging line, last month they sent out 21 truck loads from Rexburg. There is also a soap packaging line, the soap isn't made here only ~, packaged. They have a machine which packages vitamins. The fourth machine makes a lot of the cleaning products. He stated that they had reduced flammable material in Rexburg by 25$. They have tried to find a way they could store these flammable materials without causing anyone any concern. They have located a site in Idaho Falls that they could store the chemicals. Idaho Falls has okayed the site and they have started excavation on the site and soon after they started digging they notified them that the water supply was a problem. They are working with the public works department to solve the problem, then all the flammables will be moved to the Idaho Falls location. Only a couple of the products handled in Rexburg use the flammable products. There might be only 30 to 50 gallons of the flammable product. They bring it in drums and mix it with the product. They have about 60 employees in Rexburg now and by the end of the year they will have about 150 employees. Their monthly payroll is bout $84,000.. Copy of letter explaining it attached. Terry Bagley said he met with Planning & Zoning by invitation by the City to annex the balance of his property that is not annexed. About 1/3 of the warehouse is in the city and about 2/3 of the warehouse is not in the city. He was not opposed to the annexation. They would like it zoned for light industrial use. .They bought that property with the idea in mind to develope light manufacturing such as Melaleuca, and the other permitted uses in the light manufacturing area. We would like to see offices, warehouses, building supply warehouses, auto supply places, farm equipment, and farm equipment fabrication going in. The ingress and egress will be between the building on the north and the warehouse. There are 200 feet between the buildings, so there could be a 50 or 60 foot wide road between to service the lots behind those buildings. Mayor Boyle read out of the Zoning Ordinance what is allowed in the Industrial Zone. It would protect with the uses of Light Industry. Davawn Beattie representing Ricks College was at the meeting. They would like to go on record opposing any action that would limit their use of the property just south of the proposed annexation. They have coal yards on their property and also a plant nursery. The coal yard would produce dust. The mayor told him it would be grandfathered. Charlene Brown - Asked what the zoning is now. The mayor told her it isn't zoned but the rest of the property is zoned industrial. A question was asked what the location of the property was. Nyle Fullmer showed them on the map. John Millar stated that Planning & Zoning felt it was important that this property be annexed. It would let the city have control on what goes in on the property. Terry Bagley - In the zoning ordinance it reads: if they are abutting a residential area, they would have to put a fence up. He did not think it was practical, because their property runs on the south side of the canal and the canal company says you have to leave appropriate room for them to get down the ditch to maintain the ditch. For them to put a fence up along there, he did not know where they would have to put it. If a fence needs to be put up, he suggested that it should be put up on the other side of the canal, which is not their property. It is residential and it would seem that the residents on that side of the canal would like to fence their children away from the canal. It also says there needs to be some trees and they are in agreement to put in some trees, but opposed to putting in a fence. The mayor said he was sure they could not put a fence very close to the canal bank and it could be worked out. The mayor said because of the canal company right-a-way , it would be a good idea to put in the trees or shrubs. Jim Long- Asked if the first time we annex a piece of Industrial Property, we throw out our new ordinance requirements, what is the point of having them in the new ordinance. The mayor said we could do the ground cover and trees but not the fence because of the canal. J. D. Hancock read from the ordinance 4.7. It does not say there needs to be a fence only landscaping. f `r Jim Flamm stated the city has requested the zoning of the property. The property that is in the city is already zoned light industry. If it is left in the county they can do what they want, but if we annex it we are looking at more control. Terry Bagley stated again that they are opposed to a fence because they feel it is an unnecessary expense. They are not opposed to an investment of streets and other improvements. The fence should be on the other aide of the canal. John Millar stated the annexation doesn't necessarily need to address that at this time. As the property is developed they will have to come before Planning & Zoning. The mayor said he and J. D. could not see where it required a fence. Farrell Young said if our ordinance does not require a fence we don't need to address that issue. Terry said their property is 10 to 20 feet away from the canal. Jim Long stated that it appears that the property does not abut a residential area it abuts the canal. Nyle Fullmer stated that he had received a letter from Sandra Larsen opposing the Industrial Park. (on record) Nyle stated that the Industrial Park would be uniform with the existing area. There is a good spread between the residential area and the Bagley property because of the canal. It is already light industry and manufacturing south of it anyway. It would just improve the area and give us the control. A motion was made by Nyle Fullmer to annex the property and zone it Light Industrial. Seconded by Brad Liljenquist. All Aye. RE: PUBLIC HEARING PERTAINING TO DE-ANNEXATION OF VAL DIETRICH PROPERTY - SOUTH OF THE PARK STREET CHURCH Public Hearing 8:30 P. M. Public Hearing pertaining to de-annexation from the City of the property owned by Val Dietrich just south of the Park Street church. Val was at the last meeting. Someone wanted to build a house on that property and grow trees on the property. Because of the distance from the water line and the height of the property it would make it hard to hook to the city water and sewer. They wanted to put their own sewer system in and dig a well. Because of our ordinance we thought it was not possible. After checking our ordinance 638, we find "If a parcel of land is not within 300 feet of a sewer, connection is optional". The mayor stated that he can still put in a septic tank and be in the city. He will not have to be de-annexed. Nyle Fullmer stated that he would prefer to leave it in the city so we will have the control over it. Farrell Young made a motion that it should be left in the city. Christy Keller- She felt it should remain in the city so the city would have control. She had a question of the access to anything going in that area. She had a concern that Park Street should not handle any other traffic. Mayor Boyle stated that they had looked it up and along the South side of the church there is currently a 30 foot dedicated street to the City of Rexburg. When the property on the south is developed it is planned that the other 30 feet to make that street wide enough will come off that property and there will be a street that will run right along where the church is if those plans are drawn. On the east, south and west side of the church there is a 30 feet easement. John Millar stated when the new development is put in, it will have to go before Planning & Zoning and they will recommend an access over to the County Road. The mayor said we are all in agreement that Park Street has too much traffic for the width of the street now. If we don't de-annex, what ever plans they have for that property they would have to go before Planning & Zoning. ~' ~' John Millar stated that Val's property is in the city but has not been zoned. Planning & Zoning need to zone that property. Jim Long suggested it could be agriculture if they want to raise trees. Planning & Zoning will have to approve it. Nyle Fullmer recommended that we send it to Planning & Zoning for a recommendation of zoning. Farrell Young restated his motion. Nyle Fullmer seconded the motion to not de-annex the property and turn it back to Planning & Zoning for zoning. All Aye RE: DEAN BIRCH APARTMENTS Jim Flamm gave a report from Planning & Zoning. Dean Birch wants to to extend his apartments with a new building. His site plans were not adequate. John Millar said his plans still need some revisions. RE: DISCUSSION OF WESTERN LAND HOLDINGS REQUEST TO ANNEX MORE PROPERTY Western Land Holdings have requested to annex 8 1/2 acres just north of the property that has already been annexed for the shopping mall. There is a possibility of annexing another 1 1/2 acres. Planning & Zoning recommended annexation contingent upon the purchase of the property. Jim Long said the Re-development Association discussed it and was not sure how far north the annexation went. Their concern was if it went to the Horkley road that any ingress or degrees would have an impact on that intersection. He was concerned that as soon as it is developed, then someone will want to get the next piece of property and we will have to worry about annexing it. He wondered if we should annex the property clear to the Horkley road. That way we would have control over that intersection. Six months down the road someone might want to annex. Nyle Fullmer stated the concern he had is if they did not annex and developed the land. RE: CONSIDERATION FOR PROPERTY ACROSS FROM WALMART - PLACEMENT OF LIGHT Sherwood Ricks was at the meeting. He stated that in the planning process the people on the opposite side of the road need to be addressed so people can do business on both sides of the road. We need to be concerned for both sides as the development goes to the north. The mayor stated that on the next development we need a plot plan. We have got to make it line up with the road on the other side of the street just north of the bowling alley so there is some access to the property behind Wendys. John Millar said they were going to be surveying the road this next week. Discussion on the accesses. The state highway department worked with them on the accesses and light for the Walmart development. Now the stop light area goes into the Walmart-Albertson area but on the other side of the road there isn't a street, it goes right into a store. It doesn't hook up very well with the other side of the street. Nyle Fullmer stated that he had some concerns about it and thought before we annex anymore property we need to address it. The mayor stated that they had talked to Western Land Holdings and to change the light it will take a law suit and about $100,000. The mayor said we couldn't hold up a building permit because the state have given their approval of the light and curb cuts and all the city divisions have given approval of the site plan. They have all the legal agreements between developer, Walmart Corporation and Albertson. Albertsons wanted it right in front of Albertsons and it was further north. If we try to go further north, Albertsons will fight to not let it go further north because it will affect them. They say we will have to pay all the legal fees to run it through all those corporations and pay 1/4 of the cost of the light. If we slow them down it will coat more. Sherwood Ricks stated that they are looking at about $50,000 to change their building, depending on where the light goes. If you are to continue to go to the north the city had better look at the whole project. Nyle Fullmer stated that he was surprised that the state ~~`' t would give their approval when there is a fair amount of traffic on the west that needs to get on the road. John Millar said it was not brought to light until December that there was an access there, it is only an access and not intended to be a street. Jim Flamm stated that there is the traffic even if there isn't a street. The mayor said there is 57 feet between Wendys and Odells,and we can't take a street less than 40 feet. There is only a 30 feet easement. RE: DISCUSSION ON THE PLAN CHECK AND TRAFFIC Discussion on the plan check and traffic. John Millar stated that all the property owners on the west need to have a plan on what they are going to do. The mayor said the undeveloped property is owned by the church and they are trying to sell it. Sherwood Ricks thought that we need to get Mr Pruitt up to talk about it and talk about moving the light. The mayor said the state required them to be so far from the bridge with the light for safety reasons and they placed the light. John Millar said to line up the light with Wendys is not feasible, the light~is at the limit. A motion was made by Nyle Fullmer to set the hearing for annexation contingent upon the purchase of the property and annex the property clear to the road. The mayor said we couldn't annex to road unless the property owners agreed. Seconded by Farrell Young. All Aye The mayor told John Millar as soon as he got a survey done on that area we would have a work meeting. We need to have the Highway Department and Mr Pruitt there. RE: DISCUSSION OF TENTATIVE BUDGET AMENDMENT The mayor told the council we need to approve the tentative budget amendment. We can't spend anymore money than is in the budget. It was approved last September. We need to open the budget so we can spend $190,000 to re-surface the airport. The money comes from the FAA. The money is appropriated and we can't spend it until we open the budget and allow it to be in the budget. (copy on file) Hearing will be held at the City Hall 18th of March at 7:45 P. M. For $190,000 for the Airport and $15,000 grant to start the Dare Program. A motion was made by Nyle Fullmer and seconded by Brad Liljenquist to hold the public hearing March 18 at 7:45 P. M. RE: EXPLANATION OF DARE PROGRAM - PURSUE DRUG AWARENESS GRANT The mayor explained the Dare Program in the grade schools. It has to be run by a Certified police officer. We would probably loose someone from our police force. In St Anthony the chief of police resigned and took the position up there. The person who does this would be paid through a federal grant from drug money. It will be an educational program in the Madison and Sugar Salem school districts. A motion was made by Brad Liljenquist and seconded by Jim Flamm to pursue the Drug Awareness Grant. All Aye RE: APPROVAL GIVEN TO DESTROY OLD RECORDS Mayor Boyle read a list of records that the recommended time for retention had expired. (copy on file) A Motion was made by Jim Flamm and seconded by Farrell Young to approve the destruction of the records. All Aye RE: DISCUSSION OF THE CITY LOGO Discussion of the City Logo. It is felt that the Centennial Logo with a few changes on the wording would be the choice of the department heads. A motion was made by Jim Flamm and seconded by Brad Liljenquist to change the Logo. All Aye Jim Flamm recommended staying away from the fancy letters and use a clean, crisp lettering. ~TM RE: MEETING WITH WASTEWATER DEPARTMENT ON MARCH 17, 1992 On March 17 there will be a meeting with the Wastewater Department to go over our sewer system with the engineers. It will be held at 10:00 A. M. The mayor ask as many of the council as possible to attend. RE: BUNGIE JUMPING A discussion on the Bungie Jumping last Saturday. We have had more requests for people to come to Rexburg for the same thing. The mayor asked about what kind of a license we need to make them get. We did not require a license on Saturday because when we found out about it the mayor and attorney felt it was on private property and there would be a liability if we charged a license. Clair Boyle suggested that we need some traffic control if we have any more of the same. The council mentioned that the police were there and were using the P. A. system and the council wondered why they were there. It was decided by the council the Bungie Jumping companies will have to purchase an Itinerant Business License and pay that fee. RE: CAREER WEEK AT THE SCHOOLS - MARCH 16 TO 20 The mayor told the council that from March 16 to the 20 was Career Week at the schools. The mayor made a Proclamation for career week March 16 to 20. RE: BILL IN LEGISLATURE THAT WILL INCREASE THE AMOUNT OF MONEY THAT GOES INTO RETIREMENT SYSTEM - COUNCIL OPPOSED TO IT The mayor explained that there is a bill in the Legislature for the Retirement System that is called "A Proposed Benefit Enhancement". It will increase the amount of money that goes into the Retirement System. to make the retirement better. It would cost the city an additional $40,000 a year. That is about the same amount that we pay into the cost of living increase. Richard wrote a letter against it for the Legislature. Most of the Department Heads felt the same. We have the 401 K plan and some cities do not have that. Jim Flamm made a motion to oppose it. Seconded by Nyle Fullmer. All Aye. The mayor stated that we have been working to get the salaries up. Nyle Fullmer felt the council should direct the mayor to send the letter. RE: STREET REPAIR The mayor read a list of streets that need repair. We have $200,000 for repairs. The mayor asked if any of the council have suggestions. Brad said there is a hole on Harvard by Lofthouses. The mayor said we have got to get more money in the street fund. Brad asked what the option was on funding. The mayor told him only taxes. RE: CITY PARKS Jim Flamm told the council Denton Brewerton had suggested that we post signs in the parks for no littering. The parks need cleaning. Clair Boyle asked if there could be some police protection in the parks. There have been a lot of vehicles driving around in the parks. We need to patrol them. (108) 522-0700 March 4, 1992 Mayor Nile Boyle 12 North Center Rexburg, ID 83440 Dear Mayor Boyle: As an update for you and others who may be interested, :let me tell you how our operation is progressing in Rexburg. At present we. have a customer order packaging line, a bar soap packaging line, a vitamin packaging line, and a home care products processing and packaging line in operation. Some of these lines run two shifts. Over'the next thirty days we will also be taking delivery of and starting up a second hor;~e care products processing and packaging line. Currently we have approximately sixty emplovees on two shifts, for a monthly payroll of about $40,000. If growth continues as projected, we will employ approximately 115 people for a rrronthly payroll of about $84,000 by the end of this year. Construction on our flammable storage area in Idaho Falls, which would relieve our Rexburg flammable storage, has been halted by the city.. Excavation work was in progress when the fire department determined the water supply, in case of fire, is inadequate for the site. This lneans we must install a fire hydrant on site. Since the water supply belongs to the city, but the storage site is located in the county, there are questions of annexation which must be dealt with. We are currently working with the Public Works Department to solve this problem as quickly as possible. However, being aware of the situation, we have done our best to minimize our flammables inventory. During the last six weeks we have reduced the amount of flanunables in our Rexburg facility by 25%. We will continue our reduction efforts until our Idaho Falls storage site is completed, at which tune we will move the flarrunables to the new location. ~'~ ~/ Mayor Nile Boyle March 4, 1992 Page Two That is the latest news affecting our Rexburg operation. have other questions, please don't hesitate to ask. Sinc rely, C~.j~ Ja e Poole Engineering Manager JP: jd If you .. . ~. ~ I I a,.: ~~ February 14, 1992 Mayor Nile Boyle City of Rexburg Rexburg, ID 83440 Dear Mayor Boyle: 1 Due to the fact that I am involved with a concert on campus March 4 when you have scheduled a public hearing regarding a potential industrial part located on South Fifth West, I am taking the opportunity to write this letter. A few years ago while I was a member of the Rexburg City Council, there was serious consideration given to an industrial park located north of town adjacent to the then Artco Company building. It was cited that this location was ideal for several reasons--space, railroad connections, away from residential neighborhoods, and yet near enough to the center of town. Since that time little or nothing has been mentioned of this plan. Now a new development dealing with the former Ferguson property and surrounding area is under consideration for an industrial park. May I just make an observation regarding this location. There are very few residential locations in Rexburg that are not impacted with some sort of industrial, commercial, or business properties nearby. I'm sure much of this has occurred due to following trends at a given time in history and especially businesses following along the old highway that used to dissect the city north and south. But times have changed. Does the city have any long-range goals or guidelines to help us in these decisions or do we continue to jump every time a private party wants to annex or rezone for private interest or gain? Certainly, at some point we need to have courage to take a stand. Why not try locating this park in the area that was considered several years ago? If this industrial park was interested in locating on some farm land on the east bench next to the residential areas located there and then requested annexation to the city and rezoning, you would certainly see a large negative reaction to that idea. In reality, the same feelings exit for the location being considered. The area in question has residential neighborhoods that are trying to provide a comfortable setting for families. There is even talk of an additional residential development being built next to the area in question. To say that a canal would be sufficient to seperate the two areas is really a weak argument. 1 ~- .. Mayor Nile Boyle February 14, 1992 Page 2 Many of us living just off Fifth West have tried desperately for years to have the city council plant trees along Fifth West to soften the look between commercial and residential properties. Trees were planted, then died, and nothing else has transpired since then to assist this situation. Please don't impact the azea further. Somewhere there needs to be a plan and direction for the city. There has already been enough "checker boazd" developments over the years. Hopefully, this city council has the courage to address these needs. I believe in progress for a community, but not at the expense of residential neighborhoods trying to enjoy their homes and the savings investment that has gone into these properties.
