A motion was made by Nyle Fullmer and seconded by Brad Liljenquist to
approve the minutes. All Aye
RE: NYLE FULLMER TAKES THE OATH OF OFFICE
J. D. Hancock read the Oath of Office to Nyle Fullmer. Nyle repeated
the oath and signed the Oath of Office.
The mayor told the council about the elected official's dinner on
February 27 at the Shilo Inn.
RE: WEST ONE RECEIVED BID FOR TWO POLICE CARS
The mayor stated that we opened the bids on the police cars a while
ago. We contacted the banks for the lowest interest rate. West One
Bank was the lowest to finance two police cars at $16,500 at 6.25 to
be paid off by February 1,1993. A motion was made by Bruce Sutherland
to accept the low bid for lease purchase on two police cars with West
One Bank. All Aye.
RE: COUNCIL APPROVAL GIVEN FOR BIDS FOR NEW PICKUP FOR THE SEWER
DEPT.
Because we split the water & sewer departments, we have in the budget a
new pickup for the Sewer Department by council approval. The mayor told
the council we have some prices on used pickups, but the prices for
used pickups and new pickups is so close we need to decide whether to
bid for a new pickup or buy a used one. The prices are:
Madison Ford for a new 1992 with two wheel drive is $11,679 or a 4 x 4
is $13,650. They also had a 1990 Custom 2 wheel Drive for $8,200.
Taylor's had a new one for $11,105, 1989 Ford for $11,400, 1989
Chevrolet for $9,500.
The new pickup will be for Dave and the new man will get Dave's
pickup. A motion was made by Nyle Fullmer and seconded by Brad
Liljenquist to open it up for bids for a new pickup for the sewer
department. All Aye.
RE: APPROVAL FOR AN AMENDMENT TO THE CAFETERIA PLAN
We need to approve an Amendment to the city Cafeteria Plan. This will
make it so they can come in the first of every quarter to sign up on
the plan. (copy attached) A motion was made by Bruce Sutherland and
seconded by Nyle Fullmer to amend the Cafeteria Plan. All Aye.
RE: DISCUSSION OF SOUTH ARTERIAL ROAD - 7TH, 9TH, OR 11TH?
Mayor Boyle told the council we received a letter form Madison School
District. The letter is about the south arterial. In about 1980 or
1981 we had hearings to determine the south arterial where we wanted it
to go and appear on the master plan and sent a copy to the State
Department of Transportation. At that time the city felt we should go
up 7th South, but when we had the hearing we had letters and testimony
from Rex Bennion and Brent Kinghorn representing the college along with
several others that they did not want 7th South to go through and split
the campus until they knew what the master plan was going to be. At
that time instead of going to the end of 2nd East, we went clear up to
the pole line road on 2nd East and used all of our funds. Now there is
a change with the new highway bill. There is a change in the way they
distribute the money to local governments. It isn't on an allocation
anymore. It is on a presentation to them and then on a state level.
Your competing with everyone that wants a road done. Now if we have a
good plan we can present it and have a chance of getting it funded.
Madison School district is recommending that 7th South be put in to the
college and come down so they would have a way to get their buses off
the hill down to the new school. Their suggestion on the main
arterial is that we go off of 11th South and go right up the hill by
Cresthaven by the Cresthaven Church, and that be the main arterial on
the South, with 7th South being put in as well. There are some reasons
why that is realistic. If the college gets approval for their plan
and build on the campus, there is no way we could allow any
construction to start that would impair 4th South at all until 7th
South is in. It will take a long time to get a plan through the
state. 7th South would be cheaper because it doesn't run so far. 11th
South runs almost three miles, all new road. The mayor asked if the
council wanted to have hearings or wait until we have all the
information. Nyle Fullmer made a motion that we wait until we have all
the information. He also disagreed with 11th South being the main
arterial. Brad Liljenquist stated that the Master Plan called for 9th
South being the main arterial. Brad also suggested that the Traffic
Committee look at the traffic now and projected traffic and proposed
bus routes and make a recommendation.. Nyle's motion died for a lack
of a motion. Jim Flamm felt we need to open it to the public for input.
RE: DISCUSSION OF ZONING MAPS
The mayor told the council we have a big zoning map and it is being
framed. He gave prices for colored maps to the council. It was
suggested that we get some more prices.
RE: MOTION PASSED TO HELP PAY FOR BROCHURES PRINTED BY CHAMBER
The mayor told the council a year or two ago the Chamber printed some
Brochures. The city's share is $1500. They want to know if we could
help pay for them. It would go under Economic Development.
(discussion) A motion was made by Bruce Sutherland that we pay for the
brochures. Seconded by Nyle Fullmer. Those voting aye: Bruce
Sutherland, Nyle Fullmer, Brad Liljenquist, Farrell Young. Abstaining:
Jim Flamm.
RE: DECISION MADE ON EXPENSES FOR NEW ECIPDA BUILDING
The mayor discussed the new building ECYPDA is building for Incubator
Businesses. The County Commissioners have voted to exempt them from
taxes. This will be a good service for the city. The building permit
will be $1164, the plan check $223, the plumbing permit $570 and the
increase in water hookup with the difference from a 2" and 4" is
$2400. They will need a 6" line to run their fire protection. There
isn't a 6" line so they would have to get a grant for that. A motion
was made by Brad Liljenquist that we charge them only our actual
expenses for the Building Permit, Plan Check, and Plumbing Permit.
Seconded by Nyle Fullmer. All Aye
Nyle Fullmer said he had talked to the Sheriff and they want us to do
something on a building, because they need the room.
RE: MELALEUCA
Nyle also ask about Melaleuca. The mayor said they are meeting with
the City of Idaho Falls to get a plan approved and all of their excess
chemicals will be moved. The lawyers for Bill Henderson called and

they have a meeting set up for February 3 with the Fire Department.
Melaleuca said they should have an answer by then.
RE: DUMPING WATER FROM CARPET CLEANING AND LITTERING OF ORANGE BAGS
Jim Flamm asked what we had found out about dumping the water after
they clean carpets in the sewer. The mayor said he hadn't found out
anything, he would check on it. Jim also asked about the orange bags.
The mayor had called the Post Register and they are putting it all on
the computer and anyone that does subscribe to the Post Register should
not get one. They should have an answer in 30 days. Nyle Fullmer
asked why we couldn't just tell them not to deliver them unless they
are requested.
A motion was made by Brad Liljenquist and seconded by Bruce Sutherland
to pay the bills. All Aye.
A motion was made by Nyle Fullmer and seconded by Brad Liljenquist to
go into an executive session for a legal decision. All Aye.
Meeting reconvened after executive session and a motion was made by
Brad Liljenquist and seconded by Nyle Fullmer to adjourn. All Aye.

Dear Mayor Boyle:
You and I have had extensive discussions on the upcoming problem
of trafific flow around the new Middle School that will be con-
structed along Yellowstone Highway off Seventh South_ Obviously,
we are interested in participating in a plan that will provide
the greatest amount of safety for our students.
We have discussed the prospect of Seventh South being extended to
Second East. This would be beneficial to the school district in
that it would establish much easier access to the Middle School
location fior those who live in the hill area_ At the same time
it would increase traffic flow an the north side of the new
Middle School, and special arrangements to handle traffic flow
during the start and close of the school day will be necessary_
We have scheduled the new Middle School to be on the "late"
schedule, so that activities at this school cause the least
amount of interfierence with morning rush hour trafifiic. This
means the school's "rush hour" will be between the hours of 8:45-
9:30 a_m. and 3:00-3:45 p.m.
We have also discussed extending Eleventh South to connect with
Second East. This would greatly alleviate traffic flow by the
new Middle School site, in my opinion, since those who exit
Highway 20 at Spud's would be more likely to continue heading
east to gain quicker access to the college and other parts of
Rexburg. It would provide approximately the same amount of
access to the Middle School site for those living on the hill as
would the Seventh South option.

In order to facilitate northbound traffic, the school district
would take a serious look at donating some land along Yellowstone
Highway for the construction of a one lane "offi ramp" between
Bell Builder's and Seventh South. I would envision this inter-
section to be a modified version of what northbound traffic faces
at Horkley's North when taking the Sugar City highway just before
crossing the railroad tracks (only not that sharp of a curve).
The purpose of this "ofif ramp" would be to funnel those who are
heading for the Middle School out of the main stream of north-
bound traffic. If Seventh South is extended to Second East, this
lane could be modified to allow that traffic pattern also.
The City, County, and State. Highway Department need to -take a
serious look at handling southbound traffic on Yellowstone High-
way_ The school district will have to put on an additional six
buses to handle. the students who qualify fior safety busing by
living north of Frontier Pies. Our optimum route is to have
these buses approach the Middle School from Yellowstone Highway.
Because of the potential risk involved in our approach from the
north of the new Middle School, I would suggest a controlled
intersection be established at Seventh South and Yellowstone
Highway and at Fourth South and Yellowstone Highway by Frontier
Pies. In order to allow trafific flow to continue as much as
possible, these lights should be on a timer that turns them on
only during the 45 minute time span twice per day noted above_
In addition to the electronic signals mentioned above, it would
be desirable to have a flour-way stop sign installed at the corner
of Fif th West and Seventh South. If Seventh South is extended to
Second East, this would start slowing that downhill traffic as it
approaches the school. The same affect would be seen on those
northbound and southbound on Fif th West. For those eastbound on
Seventh South, especially our buses and parents picking up their
students, it will allow them exit from the school area on a regu-
lar basis without clogging up the street in firont of the school
building.
Thank you for your concern about the safiety ofi the students in
the Madison School District_ I am firmly convinced that by
working together we will arrive at a mutually satisfactory solu-
tloh.

AMENDMENT TO CITY OF REXBURG
CAFETERIA PLAN
The City of Rexburg, located in the County of Madison, State of Idaho,
acting through its mayor, having previously adopted the City of Rexburg
Cafeteria Plan, the "Plan", effective July 1, 1985, hereby amends that
Plan by restating the following designated sections:
Section 2.12 is amended in its entirety to read as follows:
"Plan Entry Date" shall mean the first day of the first,
fourth, seventh and tenth months of every plan year.
This amendment is effective for the Plan Years beginning on or after
January 1, 1992.
In all other respects the Plan as previously adopted and amended its
hereby ratified and affirmed in its entirety.
