State of Idaho) County of Madison( ss City of Rexburg Present were the following: Mayor: Nile Boyle Councilmembers: Nyle Fullmer Farrell Young Brad Liljenquist Glen Pond Darlene Petersen Absent: Bruce Sutherland Also Present: Rose Bagley, City Clerk J. D. Hancock, Attorney Richard Horner, Treasurer Pledge to the flag. A motion was made by Farrell Young and seconded by Darlene Petersen to approve the minutes. All Aye RE: DISCUSSION ON RECYCLING - DONATION OF $5,000 The mayor discussed recycling. Upper Valley Industries is going to take the recycling over. They have suggested in addition to the drop off we have now to have one at Broulims, and one at K Mart parking lot. They have hired a part time college student to keep it cleaned up. When they get the program going the stuff will not be left like it has been. It will be taken over to Upper Valley Industries. They have cost estimates on the bins for $7000 each and $10,000 for a bailer. They have a grant for $14,000 from CHC and another $2000 from someone else. We had told them the city would help them. They asked if the city would give them $5000 toward the $24,000 and felt if the city would help, Upper Valley Industries could do the project. Nyle Fullmer said he had a suggestion from Ken Benfield that a bin be put in the city parking lot behind his business. The mayor said another problem is the garbage department has been picking up card board boxes from stores. We charge them for it. The card board is valuable, but it is a nuisance for us to pick them up. Upper Valley Industries would like to pick them up and charge them the same as we do. This would provide more jobs. A motion was made by Glen Pond and seconded by Brad Liljenquist to approve donating $5000 for the recycling. All Aye. RE: HOLIDAY TIME OFF FOR CITY EMPLOYEES The mayor discussed the Holiday season. He said on the day before Thanksgiving if they don't take a lunch they would like to go home an hour earlier, the council felt that would be okay. He also ask about the employees getting off a little early the day before Christmas and the day before New Years. After a discussion, a motion was made by Brad Liljenquist and seconded by Nyle Fullmer to allow the employees to get off work two hours early the day before Christmas and the day before New Years. All Aye. RE: READING AND PASSING OF ORDINANCE 727 - AMENDING 80 & 118 Ordinance 727 an ordinance amending 80 and 118. It would add four more misdemeanors to already existing ordinance so the police can cite to Rexburg City ordinances rather than the Idaho State Code pertaining to misdemeanors. With I-STARS program in effect the only fines and forfeitures that the city will be entitled to 90~ of the proceeds is those that are cited for city codes, motor vehicle codes, and motor vehicle laws of driving while intoxicated or driving without l~/ privileges. The police felt that by covering these misdemeanors it would cover about 90 ~ of the misdemeanors under the city code. ORDINANCE 727 AN ORDINANCE AMENDING ORDINANCE NOS. 80 AND 118; ADDING PROVISIONS FOR THE OFFENSES OF ILLEGAL CONSUMPTION OF ALCOHOL BY PERSONS UNDER AGE TWENTY-ONE 21; BATTERY; TRESPASS; MALICIOUS INJURY TO PROPERTY; AND DRAWING CHECK WITHOUT FUNDS; MAKING A VIOLATION OF THIS ORDINANCE A MISDEMEANOR; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by council member Nyle Fullmer and seconded by Brad Liljenquist the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 727 Those voting aye: Darlene Petersen Glen Pond Nyle Fullmer Farrell Young Brad Liljenquist Those voting nay: None Absent: Bruce Sutherland Ordinance 727 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Darlene Petersen and seconded by Nyle Fullmer that ordinance 727 be passed. Those voting aye: Darlene Petersen Farrell Young Brad Liljenquist Nyle Fullmer Glen Pond Those voting nay: none Absent: Bruce Sutherland The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the city council had voted for the passage of said ordinance was duly and regularly passed. Mayor Boyle declared the motion carried. RE: BUSINESS LICENSE INSPECTIONS Business licenses inspection fees was discussed. The inspectors felt it should be $10.00 for each inspector. Brad Liljenquist suggested that we check with surrounding cities and table it. RE: CHRISTMAS TREE SALES The mayor reminded the council about last year when the fellow sold Christmas trees and left a mess on the lot. He ask the council what they felt we should do to prevent it. The attorney stated that it should come under 707 requiring a $500 bond. (discussion) A motion was made by Nyle Fullmer and seconded by Glen Pond to charge a regular business license fee for Christmas tree sales and make them exempt from the Itinerant Merchant Licence. That we also require a deposit from the merchant we had a problem with last year not cleaning up the lot, refundable after the lot is cleaned up. All other merchants would be exempt from the deposit unless we see a problem. All Aye The mayor told the council that between now and January we would like to have a department heard meeting. It was decided to have it 7:00 A.M. on December 3. RE: DISCUSSION OF THE IMPACT HEARING DECEMBER 4th The mayor talked about the hearing that has been postponed for the Impact Area to December 4. He asked Glen Pond how that would affect the impact area. Glen told the council it would be so we could have control on further developments such as new businesses and sub divisions. ;_--- L RE: DICK DAVIS AND THE RECYCLING BUILDING Farrell Young asked the council what obligation we have to Dick Davis on the recycling building. The carousel is out of it now and all of their signs need to be taken down. The clerk said she would research the agreement. The mayor also told the council meetings in January would be on the 2nd and 4th Wednesday. A motion was made by Glen Pond and seconded by Nyle Fullmer to pay the bills. All Aye. Meeting Adjourned.
