Hancock, Attorney Richard Horner, Treasurer A motion was made by Nyle Fullmer and seconded by Darlene Petersen to approve the minutes. All Aye. RE: DISCUSSION ABOUT PAINTING THE DUMPSTERS Jim Barrette was at the meeting to make a proposal to paint the garbage dumpsters. There are 98 dumpsters and he would paint them all one uniform color. (he showed pictures of dumpsters) He had a break down of the price at a total of $3722 making it $37.97 each. Bruce Sutherland suggested if they were painted, we would be able to sell them easier but we might want to wait until the time we sell them. Glen Pond said after seeing the pictures, there is a difference. Nyle Fullmer said it would help the appearance of the whole city. He would stencil the writing on the dumpsters at the same price. The council questioned if we could afford it in the budget. Richard suggested with our purchasing rules we need three bids. The mayor felt we should get Darlene, Farrell and Vern to check it out and see if they wanted to do it in their budget and make the recommendation. The council agreed. Richard stated that we did not have it in the budget and would have to transfer it from another item in the budget. RE: ALLEY BLOCKED BY UTAH POWER AND LIGHT CONSTRUCTION Mayor Boyle discussed Utah Power & Light blocking the alley for construction. He said he had talked to several people, who would like to see the alley changed to two way traffic instead of one way. Glen Pond said he talked to the contractor today and they would like to keep the alley closed until they can get the brick and get it framed up. They think it will be until the middle or end of September. The mayor also asked the council how they felt about giving permission to close alleys. The council felt we should look at the reason for closing an alley before we determine. The mayor asked the council to think about it and make a decision at another meeting. RE: CLAIM BY ADAM RAY PRESENTED & REJECTED The mayor presented a claim by Adam Ray hurt on the slide at the pool. A motion was made by Bruce Sutherland to refuse the claim and send it to the Insurance Company. Seconded by Glen Pond - after discussion Bruce withdrew his motion. A motion was made by Nyle Fullmer to reject the claim, seconded by Brad Liljenquist. All Aye. RE: PASSING OF ORDINANCE 721 ADOPTING THE 1991 NATIONAL ELECTRICAL CODE Mayor Boyle read Ordinance 721 adopting the 1991 National Electrical Code. ORDINANCE 721 - AN ORDINANCE REPEALING SECTION II OF ORDINANCE NO. 702 OF THE CITY OF REXBURG, IDAHO, AND ADOPTING THE NATIONAL ELECTRICAL CODE, 1991, ASSOCIATION, INC. FOR THE CITY OF REXBURG, IDAHO; REQUIRING COPIES OF SAID CODE TO BE KEPT IN THE OFFICE OF THE CITY CLERK; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND FOR SEVERABILITY; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by councilman Bruce Sutherland and seconded by Nyle Fullmer that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 721. Those voting aye: Darlene Petersen Glen Pond Brad Liljenquist Bruce Sutherland Farrell Young Nyle Fullmer Those voting nay: None Ordinance 721 was then placed before the council. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Bruce Sutherland and seconded by Farrell Young that ordinance 721 be passed. Those voting aye: Glen Pond Darlene Petersen Brad Liljenquist Nyle Fullmer Bruce Sutherland Brad Liljenquist Those voting nay: None The roll showed all councilmen present voting "Aye" carried, the mayor declared that the majority of all the members of the city council had voted .for the passage of said ordinance was duly and regularly passed. Mayor Boyle declared the motion carried. RE: PASSING OF ORDINANCE 722 ADOPTING THE UNIFORM BUILDING CODE Mayor Boyle read Ordinance 722, and ordinance adopting the Uniform Building Code, 1991 addition. Ordinance 722 AN ORDINANCE REPEALING SECTION II OF ORDINANCE NO. 688 OF THE CITY OF REXBURG; ADOPTING THE UNIFORM BUILDING CODE, 1991 EDITION, TOGETHER WITH AMENDMENTS AND REVISIONS THEREOF WITH THE INCLUSION OF APPENDICES; REQUIRING COPIES OF SAID CODE TO BE KEPT IN THE OFFICE OF THE CITY CLERK; ALSO PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. All fees are set by resolution. We have factored them to 75~. Mayor Boyle declared the motion carried. RE: READING & PASSING OF ORDINANCE 723 CREATING LID 27 FOR IMPROVEMENTS IN THE CRESTHAVEN SUB DIVISION AND ON CORNELL J. D. Hancock read the minutes of the public hearings for the new LID 27. Ordinance 723 creates LID 27 for improvements in the Cresthaven Sub Division and on Cornell. The cost of the LID will cost $162,000, $45,000 will be paid by the city and balance of $117,000 by the property owners. Ordinance 723 AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT NO. 27 FOR REXBURG, IDAHO, FOR THE PURPOSE OF CAUSING CERTAIN STREETS AND PARTS THEREOF WITHIN THE CORPORATE LIMITS OF SAID CITY, TO BE GRADED, RE-GRADED, GRAVELED, PAVED, RE-PAVED AND OTHERWISE IMPROVE THE HEREINAFTER DESCRIBED STREETS WITHIN THE DISTRICT AND TO CONSTRUCT AND RECONSTRUCT SIDEWALKS, CURBS, GUTTERS, DRIVEWAYS, DRAINAGE FACILITIES, OFFSITE STORM SEWER AND OTHER WORK INCIDENTAL TO ALL OF THE FOREGOING IMPROVEMENTS ALONG SAID STREETS. A motion was made by Councilman Bruce Sutherland and seconded by Councilman Brad Liljenquist that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 723. Mayor Boyle declared motion carried. RE: DISCUSSION OF PROBLEMS ON MILLHOLLOW The council discussed problems on Millhollow. Mayor Boyle said he got a letter from Mr Sifford and he sent the original notes when Larry Perkins did the plat for Millhollow and Larry justified not putting curb and gutter on the east side of the road to not magnify the run off. Glen Pond said the engineer came up with an alternative on a way to drain it if we do put a curb and gutter in. The mayor said it was still contrary to our ordinance and should have curb and gutter. Nyle Fullmer asked if the ordinance is there, why can't we go back to the homes that have been built in the last 18 months and tell them they need to put in curb and gutter and do it themselves. The mayor felt it all needed to be done at once. Glen said we need to address the run 1 off. The mayor said the next time we need to be better prepared to answer questions. RE: APPROVAL TO DO THE ROAD IN THE CRESTHAVEN SUB DIVISION The council discussed the Cresthaven LID. The mayor told the council we have enough money to do the road this year so the council felt we should go ahead and do it all at once. We could bid it at the same time as the other. RE: BUDGET PRESENTED BY RICHARD HORNER Richard Horner presented the budget. He explained the funds and revenues. He said there was no need for utility rate increase this year. We might need to raise the water rates slightly next year. We will have to raise the sewer, but we don't know how much. EPA keeps coming up with things and sometime get unreasonable. RE: MOTION PASSED TO APPROVE THE TENTATIVE BUDGET - PUBLIC HEARING SET A motion was made by Bruce Sutherland and seconded by Farrell Young to approve the tentative budget for $5,296,000 seconded by Farrell Young. All Aye. Glen Pond made a motion to set the Public Hearing for September 4 at 7:45 P. M, seconded by Bruce Sutherland All Aye A motion was made by Nyle Fullmer and seconded by Bruce Sutherland to pay the bills. All Aye A motion was made by Glen Pond and seconded by Farrell Young to go into an executive session to discuss the hiring of a Building Inspector. All Aye. Meeting re-convened.
