Hancock, Attorney RE: MILLHOLLOW LID John Millar gave an explanation of what was planned for Millhollow is to basically extend Millhollow on up hill as it exists from 2nd South to 1st North. We are looking at a 40 foot street with curb and gutter on both sides, no sidewalk at this time. It would require modifications of driveways in most instances to facilitate matching grade with the proposed road. We would look at reconstructing the road completely. The road in most circumstances would be lowered so the curb and gutter grades would fit the properties better. The cost estimate for the project (copy attached). There are two reasons that the city is looking at this LID. The city has an ordinance which requires all properties to have curb and gutter and almost without exception the city has adhered to that and all streets have curb and gutter. The other reason is for safety for vehicles and pedestrians. The road right now is very narrow. It is approximately 20 to 24 feet wide. There are instances where people have landscaped right out to the edge of the oil. Farrell Young told the people that this is a hearing and we are here to listen to the pros and cons and try to accumulate information. Steve Mack- 239 Millhollow - i think if the issue is a matter of safety, he urged the council to listen to the advise of the people who live on Millhollow. He has young children, where the safety issue comes into effect and widening Millhollow would increase the safety of the road, he would be in favor of widening of the street at any cost to him if it would save the life of a child. His feeling is the exact opposite, by widening and putting curb and gutter in it will increase the danger for the children. It may be an increased risk to vehicles, having the narrow road, but having the road as presently exists for the kids now it seems to be safer, where you have parking on the sides, your kids can run in and out between cars rather than an open access. His opinion is to keep the road as it presently exists. If the council is interested in increasing safety to the children, they will adopt a policy of putting some stop signs. That is a problem of safety on Millhollow. He suggested a stop sign at 350 South Street and on 2nd South. When he moved in there were no improvements so he landscaped. He wondered why the city had waited so long to do something. Roger Mc Phetters - 275 Shoshone - He had a petition (attached). He had measured the distance on the 40 foot roadway across from Frank Daniels during the class reunion at his home with cars parked on both sides of the street, it was restricted at 21 feet by the vehicles that were on it. On Millhollow Drive, we currently have the ability in most of the people's driveways to pull off the road and get two to four vehicles out of the roadway. If you take ten feet off the road they will not be able to park their own vehicles in the driveway and have a visitor park behind them; therefore they will park on the road and you have defeated the purpose of widening the road. We still have not addressed the drainage problem. Joe Romney - 53 South Millhollow - They are not in the area that is being discussed. They are aware of the drainage problem and the safety problem and should be taken into consideration. Richard Smith - 637 South Millhollow - He is not a city resident. We have been talking about this issue for 15 years. Everyone is concerned about safety. The council should consider, what are the farmers on the bench going to do for a farm to market road. Millhollow has been a farm to market road since the bench was developed. We don't have a suitable road anymore. People can't say they are going to stop the traffic going back and forth to the farms. You might stop the truck traffic, buses, cement trucks, grain and potato trucks. The real culprit is not the trucks, but the pickups and traffic going to and from work. He agreed that the traffic on Millhollow is too fast. He said his first concern is safety. He believed that widening the road would make it a safer road. He said he has to bring combines down the road and can't move it down unless all the cars, bikes and people are not on the side of the road. There are a lot of people who have to bring equipment up that road to farms. He felt that installing stop signs would improve the safety. He did not think a stop sign at 350 South and at 2nd West was necessary. He felt if we stopped the traffic at 350 South it would resolve the problem and they would proceed down the hill slower. He asked if the hearing would be closed tonight or if he could bring in subsequent petitions. He was told he could have until tomorrow night. He felt there was no advantage in putting in curb and gutter. This is the narrowest street in the city. There are very few roads that are traveled anymore than this road. He felt there could be a compromise made between the city and the property owners on the width of the road. Owen Leishman - 539 Maple - The back side of his house faces Millhollow. He doesn't think that widening the street would solve the problem. We need to slow the traffic down. He has estimated how fast the car is going, and is sure they are going 80 - 90 mph. Kids use that street for a race track. He suggested if one side of the street was painted with no parking on it, it would alleviate cars having to pass the parked cars to get up and down the hill. If we can stop the fast traffic, we can stop a lot of danger. He has stopped some young people that drive fast and told them if he caught them going that fast again he would turn them in. He has turned them in and it doesn't do any good. The kids defy him because he takes that position. The problem is the speed. The city needs to patrol that street to stop the speeders. Sally Smith 285 Shoshone - She agreed with Owen Leishman and felt the police should give some speeding tickets. She agreed with Richard about curb and gutter not helping with the drainage problem. Her concern with the stop sign, is getting up the hill in the winter. It would have to be kept well sanded. She asked why people are built right on Millhollow. Who's responsibility is it. She also recommends that there be another farm to market road. Mayor said there is a 50 foot right-a-way and people have encroached with landscaping. Sally recommended that in the future the city catch that. Ken Benfield - 201 Millhollow - Eight or nine years ago he had brought in a petition requesting a stop sign. They assigned a committee and the majority came up with nothing. He thought a stop sign should be put up. Three vehicles have ran into the high school. By the city putting up a burm they are admitting liability. If a truck looses it breaks and goes into the high school and a student gets killed he thought the city was liable. If the road was made wider vehicles will drive faster and it will not alleviate the speed. He has two children who will go to high school and if a truck runs away and hits them, he will hold the city liable. That is a 25 mph zone and no one goes 25 mph down that road. If curb and gutters go in someone will park there and it will cut the visibility down. He is against widening the road and thinks there should be a stop sign put by Mrs Packer house and one by his house going down the hill. Put the stop signs up and see what happens and then go to phase 2. Steve Hart - He owns lot 11 in Millhollow and is in the process of buying lot 10. As soon as he told people he had bought these lots they said, keep you kids in the back yard. He thought the big hazard is the encroachment of the shrubbery. Cars parking on the road and kids running in between them is dangerous. He did not understand the street reconstruction, it looks pretty good right now. John Millar said we could probably widen it without tearing up what is there. Mayor Boyle - The same reason Ken mentioned about the liability is why the council had decided to do something on Millhollow. The situation is if you will do curb and gutter and street but when. A wider road is more safe and a stop sign should never be used to slow down traffic according to the safety books. Mayor Boyle read a letter from the Traffic Safety Committee {attached) recommending a stop sign at 350 South. Roger Mc Pheters - 275 Shoshone - he read a letter from Darrell & Annette Anderson (attached) both feel that Millhollow should be included. The two problems is speed and drainage. They recommend two stop signs. He talked about the increase of taxes. He stated that the city has not addressed all the issues and feel we need more time for another petition. He still felt that stop signs should be placed on Millhollow at South 2nd East and 350 South. Richard Smith - He agreed with Owen Leishman. If we widen the road there should be some parking concerns. The situation by Mc Pheters house should be checked by the safety committee at that intersection. Mayor Boyle stated that the next issue is the LID at Cresthaven. RE: CHRESTHAVEN LID John Millar explained the LID at Cresthaven. Proposed to repair or replace curb and gutter which has undermined or is not serviceable anymore and by replacing driveways by breaking off the back of the curb and overlaying the driveway over the curb. The other thing is to provide for drainage. ( estimate copy attached of costs) Joseph West - 125 Crestview - Asked if he would need his driveway fixed? John explained. John Bonner - 185 Crestview - He asked about the assessment on the storm drain on lot 13. That lot should have been included on the assessment for the storm sewer only. It is $500 or $73.00 per year. Joseph West - Asked where they got the costs for the curb and gutter. Those are taken from recent bids. Monte Howe - Idaho Falls - He was representing AMR Corporation. Asked if there would be an assessment on undeveloped lots. There would be. The overlay will be done next year. The city would crack seal this year. There will be two catch basins by Argus Clinger. Joseph West - Asked if it was a possibility that the city participates. Nile said we do not on curb and gutter but the city will do the street. Sidewalk replacement the city will pay half. RE: CORNELL LID Cornell LID - John Millar explained. We will do one block on Cornell. (copy attached) Joe Romney - 53 Millhollow and owns 250 East Cornell. He had questions about what is going on. John told him the LID on that street is a result of requests of people on that street. He wanted clarification on costs. He had a concern about a corner lot. He was not sure what they want to do with it. Could he get a bid on the portion that is not on the LID. Brad Liljenquist - He discussed Millhollow. He thought we should consider a compromise. One this is to put in stop signs and if we don't widen the road we need to clear the encroachment back to a 50 foot road. John Millar said we could establish a right-a-way line. The mayor said the safety book says a wider street is safer. Bruce said they build houses on that street and they are part of the city and the only street in the city without curb and gutter. Roger Mc Pheters - They have an unusual situation and will be hit hard. John Millar said the street was built when it was in the county and not built to city standards with curb and gutter. The council discussed areas where the curb and gutter is in front and back of a lot. Bruce said we should work out a compromise. Glen Pond pointed out that the drainage problem was brought up and we need to check on it. John Millar discussed some solutions. Glen said for the street to be consistent, it needs to be the same as north Millhollow. It was suggested that we stake out the street and put in railroad ties and make the people with encroachment move back. We need to give them a time limit. We could drop the LID until later. Glen also said we have a Traffic Committee and should do as they ask on the sign. Mayor Boyle said we need to get the police out to give some tickets. When the road breaks up we will have to take action. We can wait until the road is ready to be re-done. People don't need to take out lawn just the obstructions. I would like to cite deficiencies in the current draft Section 4-11 covering home occupations. Item 7 cites the use of normal traffic far neighborhoods. However, it is not defined how normal traffic would be measured. Item 17 references instructional classes and states that no more than six students or pupils would be on the premises at one time. If you had an eight hour day with six students per hour, that would constitute 12 students per hour on the premises. That is a total possible vehicular traffic increase of 96 vehicles per day. Home businesses negatively affect residential property value. This is an established economic fact. The operators of the businesses benefit because they are affectively subsidized by everyone else. They do not pay commercial real estate taxes; they do not pay commercial rates for their utilities and public services; they show a net gain of income at the expense of everyone else. If these exceptions were not made, there would be fewer vacancies in the business district. IDAHO 83440 Dear Sirs: Whereas the Rexburg City Council has proposed the widening and improving of Millhollow Road, south of 2r~d South and, Whereas a number of the residents of Millhollow have requested of this committee improvements toward safety and truck traffic on this street and, Whereas similar improvements in the City such as South 2nd East have proven successful to safety and traffic flow and, Whereas North Millhollow is improved to this point and creates a dangerous restriction of traffic at 2nd South and, Whereas there is a significant number of young children living on Millhollow and considerable room for future development, The `~exburg Traffic Safety Committee recommends the widening and improving of South Millhollow Road. This committee does suggest with these improvements the installation of a stop sign at 350 South and Millhollow Road, northbound to slow traffic entering the City on Millhollow and to necessitate trucks using this route to come to a full stop and begin their descent in low gear. We feel these steps will provide ~«any advantages to the residents of Millhollow Road and to the entire City of Rexburg. Rexburg Traffic Safety Committee August 11, 1991 Mayor Nile L. Box 245 12 North Main Rexburg, Idaho Dear Mayor Boyle: I have reviewed the Forsgren and Perkins file for correspondence discussing, the fact that it was their recommendation as consulting engineers and as City Engineers, that the Mill Hollow Subdivision not have any curb or gutter. It was felt that it was far better to have the water from the east side of the crest of Mill Hollow Road flow onto the adjoining lots and not be collected by a gutter to add to the already heavy run- off being collected in the gutters on the West side of Mill Hollow Road and then into the City's heavily strained storm drainage system. I have not as yet found any. discussion in letter form, but I did find a 24" by 36" drawing titled Proposed Mill Hollow Subdivision, dated April 6, 1976, in which the Forsgren and Perkins drawing shows the notation "no curb and gutter so that run. off does not build up". To comply to yozr- request for such substation, I am enclosing a copy of that part of the Proposed 1 Plan. I would also expect that the minutes of the meetings inwhich the Subdivision Plan was discussed and approved would very likely include such a discussion well. All our correspondence and most of our discussions with Forsgren and Perkins were with Larry V. Perkins, Partner.. It was my understanding that Larry made the presentations for the subdivision consideration and approval. I would like to also mention that all the improvements such as roads, sewer, water and utilities had I close city inspection before, during and upon completion of their installation. When someone says the roads were not made to city specifications, I can only say that we followed all the specification and passed all the inspections that were required of the City at that time. And as final proof one can look at how good of condition the road are to this day, after all these years. -2- I hope the enclosure showing the notation of no curb and gutter is what you wanted.
