A motion was made by Bruce Sutherland and seconded by Nyle Fullmer to
approve the minutes. All aye.
RE: ENGINEERING STUDY TO UP GRADE THE SEWER LAGOON
The mayor made a report on the engineering report for the sewer study.
We sent out five requests for bids and didn't receive any back except
Forsgren. We do have the approval from the State Department of
Environmental Quality to submit that application and we are on the list
to be funded. He said the contract would probably be on a cost plus.
A motion was made by Glen Pond that we accept Forsgren Associates to do
the engineering study to up grade the Sewer Lagoon and authorize the
Mayor and committee to negotiate the contract with Forsgren. The motion
was seconded by Nyle Fullmer. All Aye.
RE: LID FOR CRESTHAVEN, MILLHOLLOW, ASH, BIRCH, 1ST NORTH & 5TH
WEST
The mayor reported on the meeting with the Cresthaven neighborhood.
The consensus was that we would do an overlay next year. We would do
the LID to the sidewalks, curbs and gutters that need to be done while
we take care of the drainage. We got a letter from Blair Manwaring,
who wanted to be added to the LID. The council discussed putting an
LID in other areas around the schools for sidewalk. Bruce Sutherland
said we need to require sidewalk around the schools or feeders to
schools for safety sake. We need to do Millhollow. A motion was made
by Bruce Sutherland to include in the LID Millhollow and Cresthaven and
put out a feeler for Ash, Birch, 1st North and 5th West. Seconded by
Nyle Fullmer. All Aye
RE: WIDENING CORNELL & NEW CURB
Farrell Davidson told the council there was a concern about widening
and putting in new curb on Cornell. The mayor said he would do a spot
check with the people on that street.
RE: NELSON HAS SHEEP ON HIS PROPERTY
The mayor told the council he had some complaints that Nelsons had some
sheep on his property and ask Farrell Davidson to check it out.
RE: MOTION PASSED TO ADOPT RESOLUTION 91-4 ON LOCAL EMERGENCY RESPONSE
Mayor Boyle read Resolution 91-4 Adopting Local Emergency Response
Authority, and designating the Rexburg City Fire Department as the
local emergency response authority for hazardous substance incidents
occurring within the corporate limits of the city. A motion was made
by Bruce Sutherland and seconded by Nyle Fullmer to adopt the
resolution. All Aye.

RE: ORDINANCE 720 PASSED CHANGING THE ZONING ON THE PROPERTY NORTH OF
HARMONY HOUSE
Mayor Boyle read Ordinance 720 changing the zoning on the property on
the lot just North of Harmony House.
ORDINANCE 720
AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF
REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATE IN REXBURG, MADISON
COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN
THIS ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by Councilman Bruce Sutherland and seconded by
Councilman Nyle Fullmer that the rules requiring an ordinance of a
general and permanent nature to be read on three occasions be dispensed
with and that said ordinance be numbered 720.

Ordinance 720 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Nyle Fullmer and seconded by Farrell Young that
ordinance 720 be passed.

The roll showed all councilman present voting "Aye" carried, the Mayor
declared the majority of all the members of the city council had voted
for the passage of said ordinance, and that said ordinance was duly and
regularly passed. Mayor Boyle declared the motion carried.
RE: PROBLEMS WITH GARBAGE CONTAINERS - BID CHANGED TO SCHNEIDER
Farrell Davidson discussed the different problems with some of the
garbage containers. It will take 90 days for delivery. Farrell has
done some checking on the containers the council had chosen and found
there are some problems with them. Farrell recommended the Schneider.
Bruce Sutherland said he had checked and found they had good luck with
the Schneider. A motion was made by Nyle Fullmer and seconded by Glen
by Glen Pond to go with the Schneider. All Aye
Bruce Sutherland discussed how to charge on the multi pickup for more
than one container. He suggested that we charge 1/2 the regular rate
for the second one.
RE: REPORT ON MEETING WITH SOLAR ACCESS.
The mayor reported on the meeting with the Solar Access. He suggested
that we turn it to the Planning & Zoning. It would be easy to require
it with new plats. Most cities do it with covenants to limit the type
of trees.
RE: GERALD TAYLOR'S HOME
Gerald Taylor asked about the decision on Gerald Taylor's home. We
need to make a decision. The mayor said Gerald was going to get us
something in writing. We might have to compromise on it. If he cut
back on his garage on the north he would be within 3 feet of meeting
the set back. Bruce said he had understood that that would be the
compromise.
RE: ENERGY AUDIT OF CITY BUILDING - ADOPTING THE NORTH WEST ENERGY
CODE?
The other meeting we had last week was on the Energy Audit on city
buildings. We are going to request energy audits on the the City Hall
and Fire Station. Farrell thought it would be a good idea to do the
Tabernacle. The mayor told the council we need to decide if we want to
adopt the North West Energy Code. If we adopt it we will have to have
public hearings. We need to require buildings to be energy efficient.
A motion was made by Bruce Sutherland and seconded by Glen Pond to
approve the bills. All Aye
