D. Hancock, Attorney Richard Horner, Treasurer Pledge to the flag. RE: REPORT MADE BY JAY WIXON ABOUT THE SUNBIRDS PROGRAM Jay Wixon made a report on the trip to Arizona to present the Sunbirds program. RE: MAYOR BOYLE PROCLAMED CHILD PASSENGER SAFETY WEEK Mayor Boyle made a proclamation for Child Passenger Safety Week February 10 to 16. RE: APPROVAL OF THE MINUTES A motion was made by Glen Pond and seconded by Brad Liljenquist to approve the minutes. All Aye. RE: APPROVAL OF THE AUDIT 1 Bob Hardy from Rudd and Compa~'y was at the meeting to present the audit. He had met earlier with the financial committee and went over the audit in detail. Mr Hardy suggested that if we get more money in than we budget and spend it we need to open the budget. The city looks like it is in a good financial condition. A motion was made by Glen Pond and seconded by Bruce Sutherland to approve the audit. All Aye. RE: DISCUSSION ON WHO THE PLAN CHECKER WILL BE FOR THE CITY Mayor Boyle told the council that there would be a meeting Friday at 4:30 P. M. with Rulon Nielsen, Plan Checker. We will talk to him to see if his services can be used as our Plan Checker. RE: DISCUSSION OF OFF-STREET PARKING Betty Davenport representing Off Campus Housing was at the meeting. She and the mayor made a report on the two meetings that was held to discuss the off street parking. The committee has met and reviewed the list and then made an inspection of some of the parking lots. The mayor reminded the council that a motion was made earlier that they would have to comply by August of this year unless they came before this board and plead for an extension and those would be granted by the board. The mayor ask the attorney about the apartments that were built before 1968. The attorney said they would be grandfathered but would have to provide parking for their tenants and would have to have paving for any apartments built after that time. There is parking on lawns. We can enforce no parking on lawns. The council felt we should still go on a case by case bases. Glen Pond suggested that"~we need someone from the city at large to serve on the committee. RE: APPROVAL OF ROD HUGHES AS A NEW PLANNNING & ZONING BOARD MEMBER Mayor Boyle suggested that Rod Hughes be appointed as a new Planning Board member. A motion was made by Glen Pond and seconded by Darlene 79 Petersen to approve the appointment of Rod Hughes for the Planning Board. Those voting aye: Glen Pond, Farrell Young, Bruce Sutherland, Darlene Blackburn, with Brad Liljenquist abstaining. RE: DISCUSSION OF THE STOP LIGHT ON MAIN AND 2ND WEST AND APPROVED TO PROCEED Mayor Boyle discussed the stop light on Main and 2nd West. We had a meeting with the representatives from the Highway Department. The light was put in in 1971 and updated in 1981. They would let us pay 1/2 this year and 1/2 next year. They do feel we are on borrowed time on the old stop light. They would not be able to get new parts. They might be able to get old parts. We might be okay from one to five years at the most. It would cost us $20,000 this year and about $20,000 next year. Before they put the light in they would send a Traffic Survey Team in from Seattle, to survey all of Rexburg, Bruce Sutherland said whenever we do it, it will cost that much or more. A motion was made by Brad Liljenquist and seconded by Bruce Sutherland to go ahead with the light if we can pay half of it in this years budget and half of it in next years budget. Seconded by Bruce Sutherland. Discussion - Glen Pond ask which project would we do away with on street repairs this year to pay for it and ask if we could wait until spring. Farrell Davidson and Blair Siepert felt we should go ahead with it. The mayor said if we are going to do it this year we have to notify them by tomorrow. Bruce one reason is Farrell knows the situation of the streets and after listening about the situation he felt that this is important enough that we should proceed. The mayor ask for a vote on the motion. All Voting Aye. RE: AMENDMENT TO ORDIANNCE 681 PASSED Mayor Boyle read a resolution amending the legal description in Ordinance 681. In 1988 Chapples wanted a change of zoning and we went through all the hearings but when we started checking, we had the incorrect property description. (copy attached) A motion was made by Bruce Sutherland and seconded by Darlene Petersen to pass the ordinance. All Aye. RE: DISCUSSION OF ORDINANCE 715 Mayor Boyle read ordinance 715 to convey property to Ted and Edna Garner. In a previous meeting we had said we would transfer the property if someone would pay the legal fees. Ordinance 715 AN ORDINANCE EXPRESSING THE INTENTION OF THE CITY OF REXBURG TO TRANSFER CERTAIN REAL PROPERTY HEREINAFTER FULLY DESCRIBED BELONGING TO THE CITY OF REXBURG AND WHICH HAS CEASED TO BE USED FOR PUBLIC PURPOSES; PROVIDING THAT NOTICE OF SUCH INTENTION TO TRANSFER BE GIVEN AND THAT NO TRANSFER OCCUR UNTIL SIXTY DAYS HAVE EXPIRED FROM THE DATE AND PASSAGE OF THIS ORDINANCE, AS HEREINAFTER FULLY SET FORTH; AND PROVIDING THE EFFECTIVE DATE OF THIS ORDINANCE. A motion was made by Bruce Sutherland and seconded by Darlene Petersen to suspend the rules. Those voting aye: Bruce Sutherland Darlene Peterson Those voting nay: Brad Liljenquist Glen Pond Farrell Young Discussion - Glen Pond said he felt it has more value than the fees. Brad Liljenquist said he felt when we transfer property we need all the readings. Bruce Sutherland withdrew his motion and Darlene Petersen withdrew her second. The mayor declared that would be the first reading and the second reading would we at the next meeting. RE: AIC MEETING TO BE HELD IN JUNE AT MOSCOW The mayor told the council to plan on the AIC meeting in June at Moscow. RE: BUILDING PERMITS AND CHARGES FOR CHURCHES, SCHOOLS, AND GOVERNMENT v The mayor told the council that it was not in writings but it had been the custom to charge churches, school and government half price for building permits and ask the council if we should continue. The council felt we should enforce the ordinance and charge full price. RE: DISCUSSION OF THE NEW BUSINESS ORDINANCE The mayor also discussed the new business ordinance. The ordinance requires all apartments to be charged $1 per apartment of a minimum of $20. The council felt we should enforce the ordinance and charge all apartments because they are a business. RE: EXECUTIVE SESSION The mayor stated that we have a Tort Claim filed with the city. A motion was made by Brad Liljenquist and seconded by Glen Pond to go into an executive session. All Aye 1 After executive session the mayor called the meeting to order. RE: DENIAL OF THE TORT CLAIM FILED WITH THE CITY A motion was made by Glen Pond and seconded by Brad Liljenquist to deny the claim. All Aye. RE: APPROVAL OF THE BILLS A motion was made by Glen Pond and seconded by Brad Liljenquist to approve the bills. All Aye. A motion was made by Glen Pond and seconded by Darlene Blackburn to adjourn.
